In calendar year 2001, zero tons of gravel were mined, however, income received in calendar 2001 for gravel mined in 2000 was $98,181.00. Zero tons mined in 2001; zero tons mined in 2002. In years in which no mining occurs, the petitioner receives a royalty advance of$12,000.00 in each calendar year in which no mining takes place. Such royalty advance is a pre-payment of future royalties. The mine operator has advised the petitioner that mining on the property will not resume until the adjoining property has been fully mined. Therefore, mining is not anticipated to resume on this property until 2006 or 2007. Petitioner believes the value of this property for assessed valuation purposes to be $256,000.00. Existing gravel stock located on this property has not been mined from the property, but has been mined from the adjoining property and the petitioner receives no royalty or income from the gravel stockpile upon the property. This hearing will be held at the Weld County Centennial Center, First Floor Hearing Room, 915 10th Street, Greeley, Colorado. You have a right to attend this hearing and present evidence in support of your petition. The Weld County Assessor or his designee will be present. The Board will make its decision on the basis of the record made at the aforementioned hearing, as well as your petition, so it would be in your interest to have a representative present. If you plan to be represented by an agent or an attorney at your hearing, prior to the hearing you shall provide, in writing to the Clerk to the Board's Office, an authorization for the agent or attorney to represent you. If you do not choose to attend this hearing,a decision will still be made by the Board by the close of business on August 5,2002, and mailed to you on or before August 12, 2002. Because of the volume of cases before the Board of Equalization, all cases shall be limited to 15 minutes. Also due to volume, cases cannot be rescheduled. It is imperative that you provide evidence to support your position.
