ZONE DISTRICT FOR A MINOR SUBDIVISION WITH FOUR (4) RESIDENTIAL LOTS -
ELVA GRIFFITH / RIC HANSEN
A public hearing was conducted on September 18, 2002, at 10:00 a.m.,with the following present:

Commissioner Robert D. Masden
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated August 30, 2002, and duly published September 4,
2002, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request
of Elva Griffith for Change of Zone #589 from the A (Agricultural) Zone District to the E (Estate)
Zone District for a Minor Subdivision with four(4) residential lots. Lee Morrison, Assistant County
Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services,
presented a brief summary of the proposal and entered the favorable recommendation of the
Planning Commission into the record as written. Ms. Lockman gave a brief description of the
location of the site and surrounding uses. She stated the site will be served by septic systems,and
the North Weld County Water District has indicated the taps will be adequate to serve the
residences and the limited number of animal units allowed in the E (Estate) Zone District. She
stated ten referral agencies reviewed this proposal and each responded favorably, and the
applicant does have an agreement with the mineral owner. Ms. Lockman explained that Elva
Griffith has sold the property to Ric Hansen, therefore, she requested the Board add a Condition
of Approval requiring the applicant to submit a current deed for the property. Pam Smith,
Department of Public Works, stated this development will have large lots with suitable soils for
septic systems, therefore, staff does not anticipate any problems.
Mikal Torgerson, M. Torgerson Architects, P.C., represented the applicant. In response to Chair
Vaad, Mr. Torgerson stated he and the applicant have reviewed and agree with the Conditions of
Approval, as modified. No public testimony was offered concerning this matter. In response to
Commissioner Geile, Ms. Lockman stated a Recorded Exemption was done on this property in
2001, to divide off a parcel for an Elk Farm.

Commissioner Long moved to approve the request of Elva Griffith, and completed application of
Ric Hansen, current owner,for Change of Zone#589 from the A(Agricultural)Zone District to the
E (Estate) Zone District for a Minor Subdivision with four (4) residential lots, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval as entered into the record. His motion also included adding a new Condition of Approval
#1.A to state, "The applicant shall submit a deed which indicates current ownership," and reletter
as appropriate. The motion was seconded by Commissioner Masden, and it carried unanimously.
There being no further discussion, the hearing was completed at 10:45 a.m.
This Certification was approved on the 23rd day of September 2002.
