Environmental Health Services has reviewed this proposal for a landscape materials yard. We
have no objections to the proposal, however, we do recommend that the following conditions be
part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. Submit a dust abatement plan to the Environmental Health Services, Weld County
Department of Public Health & Environment, for approval prior to operation.
2. The septic system serving the house shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and a
technical review describing the systems ability to handle the proposed hydraulic load. The
review shall be submitted to the Environmental Health Services Division of the Weld
County Department of Public Health and Environment. In the event the system is found to
be inadequately sized or constructed the system shall be brought into compliance with
current Regulations.
3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health
Services Division of the Weld County Department of Public Health & Environment. The
plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
1) The waste handler and facility where the waste will be disposed (including the
facility name, address, and phone number).
4. The applicant shall submit evidence from the Division of Water Resources that the existing
well can be used for both commercial and residential use.

We recommend that the following requirements be incorporated into the permit as "development
standards":
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a "solid waste" in the Solid
Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate toilet and handwashing facilities shall be provided for employees. The
employees shall be allowed to use the toilet facilities located in the residence.
7. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and
handled in a safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act and
Rules and Regulations thereof.
8. The facility shall provide an adequate water supply for drinking and sanitary purposes.
9. All tank batteries located on this application shall comply with the Above Ground Storage
Tank Regulations (7 CCR 1101-14).

The Weld County Public Works Department has reviewed this proposal; this project falls primarily
under the purview of the Use by Special Review Standards,Weld County Code, Chapter 23,Article
II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
Both WCRs 4 and 17 are designated on the Southwest Study Area Capacity Improvement Needs
as paved rural roads, which require 60-foot rights-of-way at full build out. There are presently a
60-foot rights-of-way. These roads are maintained by the Weld County. Pursuant to the definition
of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required
setback is measured from the future right-of-way line.
Traffic Count: The average daily traffic (ADT) count for WCR 17 was 77 vehicles taken in a 24-
hour period on March 1, 2001. The ADT count for WCR 4 was 102 vehicles taken in a 24-hour
period on June 11, 2001.
Access: Both accesses to the facility have been paved utilizing recycled asphalt. The access point
from WCR 4 is gated. This access has a dual purpose; it is the access to the facility and it is used
as an existing oil well site. The main access from WCR 17 has adequate cross culverts for
drainage at the site. The main portion of the site has an existing asphalt area, which
accommodates parking and loading of bulk materials.
REQUIREMENTS:
Off-Street Parking: The applicant needs to identify and place on the plat vehicle parking areas
and distinguish between equipment and employee parking.
Traffic Circulation/Loading Area. The northern access to WCR 4 shall remain gated and only
be used as a secondary access to the facility/oil well site.
Storm Water Drainage: The facility is located on the top of a hill. The surrounding property
appears to be in grasses or CRP. Any storm water run-off generated by this site would disburse
on the applicant's property. The applicant shall retain and release at a historical rate any additional
storm water that may be generated by the existing asphalt area and new bulk material unloading
areas.

The following comments arc made in response to the above noted site plan review. The
Uniform Fire Code, 1997 Edition, and other codes and standards referenced within the
Fire Codes as adopted by the Weld County Commissioners, governs these comments and
resulting requirements.
General Comments:
1. Outside storage of combustible materials; piles shall not exceed 20 feet in height,
150 feet in width, and 250 feet in length. Outside storage of combustible material
shall maintain 30 feet clearance any structure.
2. Combustible vegetation shall be kept clear of structures to a minimum distance of
30 feet.
3. There shall be no storage within 30 feet from any existing oil wells.
