We've reviewed the "draft" agreement you proposed for the Guy Jensen
Subdivision. We agree to accept Mr. Jensen's proposal the pay cash-in-lieu
of land fee of $500 per new lot, for a total of $1,500, to be paid when the
final plat is recorded.
When I spoke with Mrs. Debbie Sterling, Coordinator of Transportation, she
had some concerns about the 65' radius in the cul-de-sac. She feels that any
bus we have could turn within that radius if there were no vehicles parked in
the cul-de-sac, but if there were parked vehicles, some of our buses might
have a problem. However, she said that we would probably put the bus stop
out on the side of WCR 23, unless the subdivision was at the end of the route
and it did not make sense to go on past.
I've gone ahead and signed the "draft" agreement. Please consider the radius
of the cul-de-sac to ensure that a bus could turn around if we decide that
that is the preferred mode of operation.
We appreciate your understanding and cooperation on this issue of great
importance to the School District. If you have any questions or need

stating that you and he had discussed the preliminary addresses for Guy Jensen's
proposed subdivision Blue Sky Estates and rejected them. I contacted Linn
Dodge at Weld County Department of Planning Services, and have received new
addresses based on the roads East-West direction. Enclosed is the fax with the
new proposed addresses I received. Please review them at your earliest

Thank you for the opportunity to review the proposed change of zone for Lot B of
RE-2303. The Fort Lupton Planning Commission reviewed this request at their
November 13, 2001 meeting and has the following comments:
1. Please ensure that this subdivision mitigates its own impacts by
contributing a proportionate share toward public services such as schools,
fire protection, roads and other public services and infrastructure.
2. The Commission does not have a concern about this subdivision in
particular; however, if this type of development were approved
consistently in the areas surrounding the city, there would be significant
impacts to our municipal infrastructure and services.
3. Please ensure that this development proposal meets the requirements of
the intergovernmental agreement between the City and County regarding
Section 3.2 - Development Outside Urban Growth Area. Since the
subdivision is not a typical cluster subdivision, this proposal may not meet
the definition of"Non-Urban Devclopment" as define; in Section 2.2.
The Planning Commission minutes are attached for background information.

The Weld County Department of Public Health and Environment has reviewed this proposal. The
proposed development is for 4 lots,with a minimum lot size of 3.76 acres. The overall density of one
septic system per 5 acres meets current Department policy.
The application has satisfied Chapter 24 of the Weld County Code in regard to water service. Water
is to be provided by the Central Weld County Water District. Tap agreements from Central Weld
County Water District were provided in the application materials.
The application has satisfied Chapter 24 of the Weld County Code in regard to sewer service.
Sewer will be provided by individual sewage disposal systems. As discussed above, the overall
density meets the current Department policy.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from the Central Weld County Water District
2. A Weld County Septic Permit is required for each proposed septic system and shall be
installed according to the Weld County Individual Sewage Disposal System Regulations.
Each septic system shall be designed for site-specific conditions, including but not
limited to maximum seasonal high groundwater, poor soils, and shallow bedrock.
3. The applicant shall obtain a storm water discharge permit from the Water Quality Control
Division of the Colorado Department of Public Health and the Environment, if required.
Silt fences shall be maintained on the down gradient portion of the site during all parts of
the construction phase of the project.
4. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance conditions, at the
request of the Weld County Health Department, a fugitive dust control plan must be
submitted.
5. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and
practical methods that ae technologically feasible and economically reasonable in order
to minimize dust emissions.
6. "Weld County's Right to Farm" shall be placed on any recorded plat.

(Final Plat)
The Weld County Public Works Department has reviewed this final plat request and has the
following comments.
COMMENTS:
o Remove the Primary Road cross-section from the Final Plat.
o The applicant shall modify the Primary Road cross-section on Plan/Profile for the Driveway
for Blue Sky Estates Plat to show a 26-foot gravel road without shoulders.
o The applicant shall prepare covenants stating that the homeowners will bear the burden of
maintaining the internal road, Blue Sky Drive. The County will not assume maintenance of
unpaved subdivision internal roadways.
o The applicant shall address the access to the oil well unit near the southwest corner of Lot #1.
o Intersection sight distance triangles at the development entrance will be required. All
landscaping within the triangles must be less than 3% feet in height at maturity, and noted on
the Landscape Plan.
o The drainage report shall use a design storm period of 5-years for residential land use as
outlined in Table 24.2 in Weld County Code Sec. 24-7-120 Storm Drainage Requirements.
Recalculate and resubmit the drainage report for review by Public Works.
❑ The applicant shall include in the final drainage report a map outlining off-site and on-site
watersheds with appropriate labels and areas identified. There was no map attached with the
report.
❑ A final drainage report stamped, signed and dated by a professional engineer licensed in the
State of Colorado shall be submitted with the final plat application. The 5-year storm and
100-year storm drainage studies shall take into consideration off-site flows both entering and
leaving the development. Increased runoff due to development will require detention of the
100-year storm developed condition while releasing the 5-year storm existing condition.
o The final drainage report shall document and review FEMA maps to determine if flood
hazards exist.
o Final drainage construction plans, conforming to the drainage report, shall be submitted.
Show culvert locations, lengths and sizes.
❑ The applicant shall show the Slate Ditch right-of-way on the final plat.

❑ The applicant shall show a utility easement of 20-feet in addition to the Slate Ditch right-of-
way on the final plat next to the north boundary of Lot#1.
o The applicant shall show a utility easement of 20-feet in addition to the Panhandle Eastern
Pipe Line Company easement on the final plat along the eastern side of Lot#1 and Lot #4.
RECOMMENDATION:
The following Conditions of Approval shall be fulfilled prior to recording the final plat.
Conditions of Approval:
1. The applicant is required to address the items outlined above in the Comments.
2. All elements of this application phase shall be submitted before the review continues.
3. Issues of concern must be resolved with Public Works prior to recording the final plat.

Dear Sir or Madam:
It has come to my attention that each of the lots planned in this subdivision is to be granted one
share of Slate Ditch Water.
Slate Ditch will not allow more headgates in this area. The existing headgate that supplies water
to two lots in this area is located at the northwestern corner of the land owned by Jenson. This
headgate supplies water to Jenson and Peterson. No provision has been made and,to my
knowledge, no provision has been planned to distribute irrigation water to the individual lots.

Irrigation water has caused friction between Jenson and Peterson and resulted in a call to the
Sheriff's office.
I think it is in the best interests of all parties involved, including Slate Ditch to design permanent
facilities to distribute water to the individual lots,each lot capable of getting irrigation water and
applying it to the land without impacting neighboring lots. I urge the Board to make such design
a condition of approval. Further, I feel it is appropriate that Slate Ditch approve said design.
