RESOLUTION RE: APPROVAL OF THREE-LOT RECORDED EXEMPTION #3232 - BOULDER CREEK ESTATES, LLC, C/O NANCY DAYTON, AND ERNEST PETERSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., determined at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into three parcels, as shown on the plat known as Recorded Exemption #3232, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and WHEREAS, the request for three-lot Recorded Exemption #3232 was submitted by Boulder Creek Estates, LLC, 8240 Creek Hollow Road, Boulder, Colorado 80301, c/o Nancy Dayton, 7691 Hygiene Road, Longmont, Colorado 80503, and Ernest Peterson, for property which is located in part on the following described real estate, to-wit: NW1/4 of Section 9, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A," said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 140.1 acres, 6.625 acres, and 5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land." BE IT FURTHER RESOLVED by the Board that Recorded Exemption #3232 by Boulder Creek Estates, LLC, do Nancy Dayton, and Ernest Peterson is approved, conditional upon the following: 1. Prior to recording the plat: A. The plat shall be titled: Recorded Exemption No. 1313-9-2 RE-3232 B. The applicant shall submit evidence to the Weld County Department of Planning Services that the existing septic system meets all requirements of the Weld County Department of Public Health and Environment. Any existing septic system which is currently not permitted through the Weld County Department of Public Health and Environment will require an Individual Sewage Disposal System (I.S.D.S.) evaluation prior to the issuance of the required septic permits. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. Regulations. 2002-0462 cC, : ' 4O,o/ RE3232 RE #3232 - BOULDER CREEK ESTATES, C/O NANCY DAYTON, AND ERNEST PETERSON PAGE 2 C. Lots A, B, and C shall be granted one shared access from Weld County Road 5. The applicant shall submit an Access Plan to the Weld County Department Public Works for review and approval. The plan shall indicate the type of right-of-way or easement along Weld County Road 5, the future right of way line for State Highway 119, and adequate distance between the access and intersection. Evidence of Department of Public Works approval shall be submitted to the Department of Planning Services. D. Lot C shall use the existing accesses from Weld County Road 7. A recorded copy of an agreement signed by all of the owners of the property crossed by the access shall be submitted. The access shall be for ingress and egress and shall be referenced on the plat by the Weld County Clerk and Recorder's reception number. The entrances to Lot C shall be gated in order to limit access in accordance with the request of the Weld County Sheriffs Office. E. The applicant shall contact the Colorado Department of Transportation (CDOT) to determine the future right-of-way line for State Highway 119. The future right-of-way line shall be delineated right-of-way reservation on the plat. F. CDOT has jurisdiction over all accesses to State Highways. The applicant shall contact CDOT to verify the access permit, or for any additional requirements that may be needed to obtain or upgrade an access permit to Lot A. G. The applicant shall provide to the Weld County Department of Planning Services with a copy of the access permit issued by CDOT, which grants access to State Highway 119, or written evidence that the applicant has complied with the requirements of CDOT. H. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert, contact the Weld County Department of Public Works to adequately size the culvert. The applicant shall receive approval from the Weld County Department of Planning Services to remove the proposed site from the boundary of Amended Use by Special Review Permit#1199 in accordance with Section 23-2-200.G of the Weld County Code. 2002-0462 RE3232 RE #3232 - BOULDER CREEK ESTATES, C/O NANCY DAYTON, AND ERNEST PETERSON PAGE 3 J. The applicant shall provide the Weld County Department of Planning Services with a certificate from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. K. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M, and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery, or 150-foot radius of any wellhead, shall require a variance from the terms of Section 23-6-10 of the Weld County Code. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) All construction or improvements occurring in the flood plain as delineated on Federal Emergency Management Agency FIRM Community Panel Map 080266 0850C, dated September 28, 1982, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld County Code. 4) The installation of any septic system within the One Hundred Year Flood Plan shall comply with the Weld County I.S.D.S. Flood Plain Policy. In accordance with the State of Colorado I.S.D.S. Regulations, no septic system shall be installed with in the floodway. 5) Prior to the release of building permits, the applicant shall submit a recorded deed describing the Lot upon which the building permit is requested with the building permit applications. The legal description on such deed shall include the Lot designation and Recorded Exemption number. 6) Prior to the release of building permits, the applicant shall submit evidence to the Department of Planning Services that Lots A, B, and C have an adequate water supply of sufficient quality, quantity and dependability. 2002-0462 RE3232 RE #3232 - BOULDER CREEK ESTATES, C/O NANCY DAYTON, AND ERNEST PETERSON PAGE 4 7) Building construction and building site plans must be submitted to the Mountain View Fire Protection District prior to construction. 8) Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 9) Subdivision Exemption #775 for a Public Utility Facility is located on the south end of Lot B. The facility was approved under Use by Special Review permit#1234 and shall be required to maintain compliance with all applicable Weld County rules and regulations. 10) Any disturbance of wetlands shall require the applicant to contact the Army Corps of Engineers for permits pursuant to Section 404 of the Clean Water Act. 11) Effective December 1, 1999, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Southwest Weld Road Impact Program Area 1. (Chapter 20, Article II, of the Weld County Code) 12) Lot owners should be informed that the City of Longmont has an existing composting facility and landfill in the vicinity. These facilities occasionally emit odors that are within State and County guidelines, but may nevertheless be found offensive. 13) Lot owners should contact the Colorado Department of Transportation prior to developing the property. Access to State Highway 119 will be re-evaluated and may result in limited movements of access and/or auxiliary lane improvements. 2. This three-lot Recorded Exemption was approved to bring an illegal parcel into compliance with the State of Colorado and Weld County's minimum lot size requirements. 3. The applicant shall submit a Mylar plat and a paper copy of the Mylar plat to the Weld County Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 24-8-70 of the Weld County Code. The plat shall be submitted within sixty (60) days from the date of approval by the Weld County Department of Planning Services. The Weld County Sheriffs Office has requested that the entrances to Lot C be gated in order to limit access. 2. Prior to recording the plat: A. The Weld County Department of Public Health and Environment was 2002-0462 unable to locate a septic permit for the septic system located on Lot A. Any existing septic system which is currently not permitted through the Weld County Department of Public Health and Environment will require an I.S.D.S. evaluation prior to the issuance of the required septic permits. We are enclosing one signed mylar of the exemption plat for signature by the Board of County Commissioners and recording. 2. The Health Department confirmed that there is an existing septic/leachfield permit for the Peterson lot. I believe that you already have a copy of this permit in your file. 3. Also enclosed is a copy of the original deed for the State Highway 119 right-of way. with reservations for 2 access points, from the State Highway Department. They gave us all of the information for the completion of the exemption plat. 4. We have also included a separate engineered drawing of the shared access for the lots. 5. A tax certificate is enclosed with these documents. 6. We have included a request to remove the proposed site from the boundary of Amended Use by Special Review Permit #1199. 7. All notes previously requested by the Planning Department have been included on the mylar. We believe that this completes our application for the recorded exemption. We would appreciate having the mylar recorded as soon as possible after BOCC signature so that the title company can verify the recorded plat prior to our closing. They have indicated to us that the Weld County Recorder is about 2 weeks behind in confirming recorded documents (entering on computer for verification). Enclosed with this letter, please find a copy of a letter from the Colorado Division of Minerals and Geology dated December 31, 2001, releasing the Boulder Creek Estates (BCE) property from any further reclamation responsibility. Also, please find a copy of the Extraction Plan drawing for USR 1199 as recorded by the Weld County Clerk and Recorder. The BCE parcel is highlighted in yellow. The area outlined in red was deleted from the boundary of USR 1199 on February 14, 2001, through Docket #2001-06a at the request of Ms. Katharine Oliver. The BCE parcel is currently under contract to be sold to the City of Longmont, and will become part of their open space holdings. Currently, the closing is scheduled for April 15, 2002; however, the City does not want to close until Weld County has released the parcel from USR 1199. I have also attached the section of the Weld County Code that refers to amending the property out of the Use by Special Review Permit. The property to the east is also amending out of the USR, but they still have a Board of County Commissioners hearing that has not even been set yet. I don't know which would be easier for you, waiting on the adjacent property and amending the USR at the same time, or doing it twice and doing the mapping requirements on your own. One of the girls at the Health Department did find an old septic permit for a rendering company. G19760236. I don't know if it is even the correct lot, but you may get lucky. The owner of the third 5-acre lot is Mr. Ernie Peterson. We have amended our plat to include Mr. Peterson's property. Our surveyor has completed a draft Recorded Exemption Plat which we are submitting for your final review. You also previously mentioned that an existing gravel mine permit would need to be amended to eliminate an asphalt batch site. The BCE property was released from the mining permit in December 2001. Copies of the State letter and inspection report are attached for your review. As I mentioned on the phone, a City of Longmont open space acquisition is contingent on the approval of this recorded exemption. RECORDED EXEMPTION QUESTIONNAIRE 1. Water supply: (a) Domestic water is available through Left Hand Water District. This utility service could supply water to the 6.625-acre parcel. However, a domestic water supply is not needed for the large parcel(140.1 acres) because its primary use will be as open space and wildlife habitat. (b) The City of Longmont is purchasing the historic irrigation water with the property which includes 2 share of Rural Ditch and 1 share of Smith and Emmons, although these water rights have been pledged for augmentation in an agreement dated January 10, 1980, between St. Vrain Ltd. and the Water Users Association of District No. 6. No irrigation water has been removed from the property. 2. Sewage disposal is available to the 6.625-acre parcel through St. Vrain Sanitation District. The 140.1-acre parcel will be used as open space and wildlife habitat and will not need any sewage disposal system. 3. The Boulder Creek Estates LLC property has been used for recreation, camping, fishing and hunting by the owners. One of the ponds on the property had been used for water skiing. Prior to BCE's ownership, the property was gravel-mined by Western Mobile and then LaFarge. Although reclamation has been completed, BCE and LaFarge have only recently applied to the State Mined Land Division for release of their financial bond. Prior to gravel mining the property was farmed, however, reclamation of the land into three large ponds and the agreement to pledge the historic water rights for augmentation of these ponds, has precluded agricultural use of the property except for some livestock grazing. Weld County approved a Subdivision Exemption No. SE 775 in 1999 for the lease of a microwave/communications tower facility. This facility would be located on the proposed 6.625-acre lot. 4. This recorded exemption is being requested by the property owner and the City of Longmont to facilitate an open space acquisition of the larger parcel (approximately 140.1 acres). The City does not want to acquire the 6.625-acre parcel, in part, because it is physically separated from the large parcel—it sits up on top of a cliff, above the St. Vrain Creek. It also adjoins properties with existing light industrial/office use, so the owner would like to retain it for that potential use. The City intends to preserve the larger parcel as open space/wildlife habitat, with limited public access. 5. The proposed 6.625-acre lot is located just south of State Highway 119, in the northwest corner of the property. This property is accessed from the old City of Longmont landfill road. The property is currently vacant except for the microwave tower facility at the south end of the parcel. This facility was approved previously through a Weld County subdivision exemption. There is an old graded access to the lower portion of the property along the eastern boundary of the 6-acre parcel. The owner will convey an easement to the City of Longmont at closing, for a non-public maintenance and patrol access to the 140-acre parcel that lies north of the St. Vrain Creek. The City of Longmont intends to preserve the 140-acre parcel as open space and wildlife habitat with limited public access. In spite of past mining activities this land has excellent wildlife habitat, in part because of the confluence of Boulder and St. Vrain Creeks on the property and the existence of many old cottonwoods, willows and shrubs that were saved along these riparian corridors. The mining reclamation created a large pond on the 140-acre parcel which also encourages wildlife, particularly waterfowl. Golden Eagles, herons, raptors, deer, fox, coyotes and many species of birds have been observed on the property. 6. As mentioned previously, the 6.6-acre parcel in the northwest corner of the property sits on top of a cliff or bluff, overlooking the rest of the property. Both Boulder Creek and St. Vrain Creek traverse the larger parcel and their confluence is just south of Highway 119 in the northeast corner of the property. There is one large pond on the property. The City of Longmont purchased the adjoining 75- acre parcel to the east from Boulder Creek Estates LLC in July of this year. That parcel has two ponds on it and adjoins Weld County Road 7, the property's historic access. 7. Any proposed structures will meet minimum setback for the proposed, 6+ acre lot. 8. The owner is not willing to place a conservation easement on the proposed 6-acre lot. The City of Longmont is purchasing the larger parcel in furtherance of its open space plan to preserve/conserve critical wildlife habitat, the associated water rights and natural resources. 9. No primary building envelope is proposed for either parcel. 10. Approval of this recorded exemption request will facilitate a municipal open space acquisition and implement the City of Longmont's goals and policies relative to preservation of natural resources, wildlife habitat, wetlands and agricultural land conservation. Although preservation of the majority of the land is for wildlife habitat and passive recreational use,the open space acquisition also achieves Weld County's Agricultural Goals and Policies as defined in Goal A3. 11. The 147-acre property lies within the Weld County Mixed Use Development boundary. Surrounding land uses include: The old Longmont landfill property to the west, light industrial uses to the northwest;reclamation/gravel mining to the north; an active gravel mine on the northeast; vacant/proposed development land to the east of Weld County Road 7; City of Longmont open space adjoining the property on a portion of the east boundary; farmland, rural residential and subdivision development to the south as well as an existing 40-acre industrially zoned property(Temperature Processing). 12. The Weld County Code anticipates mixed use development within this area. 13. Approval of the Recorded Exemption will allow the City of Longmont to acquire a large expanse of land that will be preserved as agricultural open space. This land adjoins other lands owned by the City on both the east and west boundaries of the property.
