HomeMy WebLinkAbout20022712.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING MOBILE HOME PERMIT, ZPMH #2330 - RAEANN SMITH AND ANGELA CONNER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 7th day of October, 2002, considered the request of RaeAnn Smith and Angela Conner, 23094 Weld County Road 30, Hudson, Colorado 80642, for a mobile home to be used as a Temporary Accessory to the Farm, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Part of the NW1/4 of Section 25, Township 3 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that, pursuant to Section 23-4-170 of the Weld County Code, said request should be denied for the following reasons: 1. Section 23-4-170.A.1. The applicant has not shown evidence that the occupant of the mobile home will be principally employed on the site. 2. Section 23-4-170.A.2. The applicant has not warranted the addition of an additional mobile home on the site for farm use. The parcel size of fifty-three acres is below the minimum lot size in the Agricultural Zone District. A site inspection revealed no apparent crops and no animal units. According to Chapter 22 of the Weld County Code, lots of less than 80 acres are not generally large enough to retain viable farming operations. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-4-of the Weld County Code, as follows: a. The mobile home will be occupied by persons principally employed at or principally engaged in the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis as follows: Evidence shall be submitted by the applicant or property owner by the first of each year for review and acceptance by the Department of Planning Services verifying that the mobile home occupant is principally employed at or engaged in the farming operation on the subject property. The evidence shall consist of tax records, employment agreements or other documentation as determined suitable by the Department of Planning Services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for temporary accessory farm use. The property owner has not shown any evidence that the occupant of the mobile home will be principally employed on the site. b. The mobile home is necessary for the effective and economic operation of the use and/or protection of the agricultural use. The Department of Planning Services has determined that there is not enough justification to warrant an additional mobile home on the site for farm use. The parcel size of fifty-three (53) acres, is twenty-seven (27) acres less than the minimum lot size in the Agricultural zone district. Upon a site inspection there with no apparent crops and no animal units. According to Chapter 22 of the Weld County Code, (Comprehensive Plan),lots of less than 80 acres are not generally large enough to retain viable farming operations. <2-o27/a_ The question as to whether or not a parcel of this size can house two dwelling structures is not under consideration. There are other options the applicant may seek to obtain this objective. The applicant has failed to establish just cause for the issuance of this structure. Should the Board of County Commissioners approved this request, the Department of Planning Services' staff recommends the following conditions be attached: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. A corrected deed with the correct legal description shall be submitted prior to release of the permit. 4. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1, 2 and 3 stated above. 5. The mobile home will be occupied by persons principally employed at or principally engaged in the operation of the use where the mobile home is located. The mobile home will not be used as an income source by the applicant for rental to persons who are not principally employed upon the lot. 7. The applicant shall submit documentation to the Department of Planning Services by October 1st of each year describing the status of the mobile home for accessory to the farm. This permit is temporary and shall terminate once the use ceases to exist, or at which time Planning Staff determines the use is no longer justified. The applicant shall have thirty (30) days to remove the mobile home from the property. 8. All derelict vehicles located on the property must be operational with current license plates, be screened from all adjacent properties and public rights of way,or be removed from the property.All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights-of-way. 9. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 10. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, H, I, M and R in Table 3-A of the 1997 Uniform Building Code, shall be constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall require a variance from the terms of the Section 23-6-10 of the Weld County Code. 11. Any future structures or uses on site must obtain the appropriate zoning and building permits. 12. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.)regulations. 13. Weld County Road 30 is designated on the Weld County Transportation Plan Map as a collector status road,which requires 80 feet of right-of-way at full build out.There is presently 60 feet of right- of-way. This road is maintained by Weld County. 14. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant to Section 15-1-10 of the Weld County Code. 15. The primary residence is occupied by the mobile home resident's parents. Over the past several years the property and all buildings have fallen into disrepair. The property is in a severely dilapidated condition. The barn's roof was badly damaged. The other sheds are also in need of repair. The fencing is not in usable condition. All of the livestock waterers are not functioning. The mobile home resident's responsibilities will include the following. The first stage is to renovate the barn so that it is both functional and updated. Restoration will be done on all sheds. The fencing will need to be repaired and modernized. Our comments and requirements are as follows: COMMENTS: WCR 30 is designated on the Transportation Plan Map as a collector status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application.
