HomeMy WebLinkAbout820570.tiff RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A DOG KENNEL AND BREEDING FACILITY - JOSEPH AND DONNA STREIT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 15th day of September, 1982, at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Joseph and Donna Streit, 15163 Barley Avenue, Ft. Lupton, Colorado 80621, for a Use by Special Review for a dog kennel and breeding facility, on the following described real estate, to-wit: Lot 7, Block 66, Aristocrat Ranchettes Sub- division, 2nd Filing, Weld County, Colorado WHEREAS, Section 24. 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The submitted materials are in compliance with applica- tion requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not encourage urban use to expand in a rural area. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The activites proposed will be compatible with exist- ing agricultural and rural residential uses in the neighborhood, as well as the projected development in the future. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the application for a Use by Special Review for a dog kennel and breeding facility on the hereinabove described parcel of land be, and hereby is, granted subject to the follow- ing conditions : 1. The attached Standards for Use by Special Review be adopted; 2. That Standard Number 1 be amended to include the follow- ing: "The kennel operation shall not exceed twenty (20) adult dogs over six months of age. " 3. The plat for the use permit be placed of record by the Department of Planning Services staff prior to any building permits being issued on the site. A six (6) foot wooden privacy fence shall be constructed on the north and west side of the kennel in order to screen the kennel from lots to the north and west. 3. The Planning Commission recommended that the request be approved. Donna Streit and her attorney, Ron Lind, were present. Mr. Lind stated that in addition to the six foot wooden privacy fence to be constructed on the north and west side of the kennel a six foot fence will be installed around the entire property to provide adequate security. Mr. Lind stated that they have more than an adequate water supply. There was no one in attendance at the hearing in opposition to the granting of the Use by Special review. Commissioner Steinmark made a motion to approve this request, the Planning Commission's conditions and standards, and, further, that standard #1 be amended to include, " The kennel operation shall not exceed twenty adult dogs over six months of age." The dog breeding facility will have a capacity of not more than thirty (30) dogs enclosed in a fenced enclosure of one hundred ninety (190) feet by fifty (50) feet attached to an existing shed of 19.3 feet by 12.3 feet. The facility will be shielded from the surrounding area by a chain link fence and trees, probably evergreens and Russian olives. Also, the applicants plan to build a privacy fence across the rear of the enclosure. Initially the applicants intend to have twenty (20) dogs and never • more than thirty (30) dogs. They will be American Pit Bull Terriers, which applicants show at sanctioned Point Shows. Although this bred has been used as a fighting animal , the applicants strongly believe that such use is inhumane and will use every effort to assure that such use will not be made of their dogs. The animals are friendly and generally quiet. These animals will be securely fenced and , if necessary, in- dividually chained to avoid any possible fighting or undue noise. Lighting in and around the enclosure will be natural and will not raise the temperature of surrounding lots. The confinement area is approximately sixty (60) feet from the residence located on the lot and one hundred ninety (190) feet from the public right-of-way. No outside employees will be hired to operate the facility. The applicants who reside at the residence will do all the work. The dogs will be sold by the applicants through newspaper advertisements and by word of mouth. Some will also be sold at Point Shows, which do not occur on the premises. The maximum number of visitors to the facility will probably not exceed four (4) per month.The lot has direct access to a public street (Barley Avenue) and parking is available adjacent to the residence. No increase use of the public right-of-way or further curb cuts onto the public right-of-way are anticipated. The enclosure for the dogs will be cleaned daily. Waste will be stored in sanitary receptacles and disposed of on a regular basis, but no less than once a week. The receptacles will prevent the waste from degrading the air and water quality of the area. Special fly catchers will be installed in the spring and fly powder will be put in the waste receptacles to kill flies and prevent their propagation. There will also be located on the premises an electric bug killer to reduce the fly and bug population. v Water will be suociied ov the Aristocrat Ranchettes ' ater Project, Inc. Fire protection will be supplied ty the Fort Lupton Fire Depart- ment. Potential noise problems from the dogs will be handled by a pri - vacy fence, as mentioned above, as well as landscaping. Any noise from the dogs housed in this facility will be less than that already existing from free roaming animals in the Aristocrat Ranchettes area. Landscaping will include various trees surrounding the enclosure. The applicants particularly are anxious to shield the west side of the property thus blocking any view of the enclosure from the public right- of-way and adjacent property. This proposal is consistent with the Weld County Comprehensive Plan, since the proposal does not remove land from argicultural use. Aristocrat Ranchettes is a rural subdivision, which existed prior to the present County regulations. It is zoned "A" Agriculture, that is rural residential in character with one to two acre lots. The land in the subdivision has not been used for agricultural production, other than "hobby" purposes for practically twenty (20) years. Prior to that the area was pasture land. No irrigation water or water rights are in- volved in this proposal . The "A" Agricultural zone has been retained by the County in the case of pre-existing residential subdivisions in order to preserve the rural nature of the area and to allow and encourage uses which might not be appropriate for urbanized areas. An example is the raising of animals as a hobby in this particular subdivision. The proposed kennel use is compatible with the rural character of the surrounding area and uses. Aristocrat Ranchettes presently has several animal farms, which are consistent with the existing surroundings and uses. The proposed kennel is also compatible with the future development of Aristocrat Ranchettes. Since plotted, Aristocrat Ranchettes has developed a par- ticular rural character with many diverse uses. Most of these uses antedate the County Comprehensive Plan. The use of this lot as a well - planned conscientiously operated breeding facility, with a maximum of thirty (30) animals, would be a benefit to the area. The animals will be located on the rear portion of the lot, buffered from the neighbors and the road. The animals will be located in an en- closure and will never be allowed to run free or present any hazard to the health or safety of the neighborhood. Further it will have no adverse impact on the agricultural interest of Weld County, or the environment. It is the intention of the applicants that all phases of the operation will comply with all County and State health standards and regulations pertaining to air quality, water quality, noise emissions and sanitary disposal systems as described above. The kennel facility will be open to inspection by the Weld County Health Department and constructed , operated and maintained pursuant to Colorado Regulations on Breeding Kennels.
