RESOLUTION
RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT#1230 -
JOHN EICHHORN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated July 14, 1999, the Board did approve Use by Special
Review Permit#1230 for an Agricultural Service Establishment in the A (Agricultural) Zone
District for John Eichhorn on the following described real estate, to-wit:
Part of the NW 1/4 of Section 19, Township 7 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, on December 20, 2001, the Department of Planning Services
administratively approved Recorded Exemption #3249, with Condition of Approval #2.J which
states, "Section 23-2-200.G and Section 23-2-260.D is required to address the partial vacation
of the Use by Special Review#1230 on the proposed Lot B," and
WHEREAS, in accordance with Sections 23-2-200.G and 23-2-260.D, the Board has
received a request from John Eichhorn, 38568 Weld County Road 13, Fort Collins, Colorado
80524, for the partial vacation said Use by Special Review Permit #1230, as well as a revised
map illustrating the vacated portion of the property and the existing permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said partial vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Use by Special Review Permit#1230 be, and hereby is, partially
vacated as indicated on the revised map.

SUBJECT: Request for Partial Vacation of USR 1230
An Agricultural Services Establishment
to sell light industrial and farm machinery
John J. Eichorn, applicant
Mr. Eichorn is requesting to vacate the eastern portion of USR 1230 located in part of the NW4
and part of the NE4 of Section 19, Township 7 North, Range 67 West of the 6'h P.M. Weld
County, CO.
Per staff comments, as a Condition of Approval for Recorded Exemption 3249, Item 2.J states
"Section 23-2-200. G. and Section 23-2-260. D. is required to address the partial vacation of the
Use by Special Review (USR-1230) on the proposed Lot B."
The Department of Planning Services is in support of this request and recommends approval.

RE: Modification of USR 1230 boundary due to RE 3249
Dear Mr. Ogle:
I am seeking to vacate the eastern portion of my USR 1230,
as a condition for approval of my RE 3249. I have included a map indicating that
portion being vacated.
