HomeMy WebLinkAbout20022574.tiff HEARING CERTIFICATION DOCKET NO. 2002-63 RE: SITE SPECIFIC DEVELOPMENT PLAN AND FINAL PLAN FOR A FOUR(4) LOT MINOR SUBDIVISION, S#1006, BLUE SKY ESTATES - GUY JENSEN A public hearing was conducted on August 28, 2002, at 10:00 a.m., with the following present: Commissioner Glenn Vaad, Chair Commissioner David D. Long, Pro-Tem Commissioner M. J. Geile - EXCUSED Commissioner William H. Jerke Commissioner Robert D. Masden Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Lauren Light Health Department representative, Pam Smith Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated August9,2002,and duly published August 14, 2002, in the Tri-Town Farmer and Miner, a public hearing was conducted to consider the request of Guy Jensen for a Site Specific Development Plan and Final Plan, S #1006, for a four (4) lot Minor Subdivision, Blue Sky Estates. Lee Morrison, Assistant County Attorney, made this a matter of record. Chair Vaad advised Kirk Goble, applicant's representative, that he has the option of continuing this matter to a date when the full board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Geile will listen to the record and make the determining vote. Mr. Goble indicated he would like to proceed today. Lauren Light, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Light gave a brief description of the location of the site, which consists of lots ranging in size from 3.9 to 7.9 acres. She stated there is a house on Lot 1, and the lots will be serviced by septic systems and taps, which are in place, from the Central Weld County Water District. She gave a brief description of the surrounding uses, and stated five referral agencies responded indicating no conflicts with their interests, and five responded with comments which have been incorporated into the Conditions of Approval and Development Standards. Ms. Light stated Mark Peterson,surrounding property owner,attended the Planning Commission hearing and expressed concern with the distribution of water from the Slate Ditch to the proposed lots. However, his concerns were resolved through a discussion of the proposed Covenants. Peter Schei, Department of Public Works,stated staff has no concerns with this proposal;however, they have included several conditions which will have to be completed prior to recording the plat. In response to Commissioner Masden, Mr. Schei stated the applicant will be required to construct 26-foot wide gravel roads, with two 13-foot lanes, surfaced with Class 6 road base material. Pam Smith, Department of Public Health and Environment,stated these are large lots and the perk rates indicate the soils are suitable for septic systems. 2002-2574 PL1580 n� : P27 HEARING CERTIFICATION - GUY JENSEN (S #1006) PAGE 2 Kirk Goble, The Bell 5 Land Company, represented the applicant and stated they have complied with or addressed the concerns expressed by the various referral agencies and County Departments. Mr. Goble stated they will be able to resolve any issues expressed by the Utility Board and the Department of Public Works. The concerns of the Slate Ditch and Mr. Peterson have been addressed. He stated Mr. Peterson lives on Lot A, and use of the ditch head gate, which is located north of Lot A, will be shared by Mr. Peterson and the residents of the development. He stated one resident will be designated as the contact person, so the Ditch Company will not have to deal with each separate property owner. Mr. Goble stated there is also an agreement with Mr. Peterson to share the cost of installing a division box. Responding to Chair Vaad, Mr. Schei submitted a copy of his Memorandum regarding the necessary improvements. Mr.Goble reviewed the Memorandum and stated the issues expressed by the Department of Public Works are separate from those of the Utility Board; however, the applicant is willing to comply with staff's requests regarding the width of easement. In response to Commissioner Masden, Mr. Goble stated the applicant has offered to pay cash-in-lieu fees to the Fort Lupton School District, to be paid upon recording of the final plat. He further stated the road width and cul-de-sac radius are adequate for the school bus. Responding to Commissioner Jerke, Mr. Goble stated the applicant purchased the taps three years ago for $7,100, which was significantly less than what they currently cost. Responding to Chair Vaad, Mr. Goble stated he and the applicant have reviewed and agree with the Conditions of Approval. No public testimony was offered concerning this matter. Commissioner Jerke moved to approve the request of Guy Jensen for a Site Specific Development Plan and Final Plan, S#1006, for a four(4) lot Minor Subdivision, Blue Sky Estates, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Masden, and it carried unanimously.There being no further discussion,the hearing was completed at 10:25 a.m. This Certification was approved on the 4th day of September 2002.
