Comment #2: We have been trying to "sort" through the following: We have never received a letter from the planning commission about the meeting, even though we live right next to the plant„however our neighbor did receive a letter dated February 25 stating there would be a meeting of the planning commission on April 16. We received a letter from Julie Chester in March stating that there would be a hearing on March 16,(dated March 14). We received the letter on March 18—the 16`h was on Saturday. We were sure the date should have been April 16, so we notified Hall-Irwin but never heard anything more until we heard from you. We have received a letter from the county commissioners for the hearing on April 24`h. We have not been able to "get together" with Julie by phone, we are playing "telephone tag" so haven't been able to talk to her more about the whole operation. We have reviewed the information regarding Hall- Irwin's application for amended use, and understand at the only change for which Hall-Irwin is requesting approval is the use of a small portion oft 'c existing site for a landscaping yard. We noted, however, that the notice regarding the amen eat and the site plan do not make clear what area of the existing site is being affected. On riday, I spoke with Chris Gathman of the Weld County planning department to clarify what ex tly is being done. He assured me that this amendment would impact at most a 3 acre area in th southwest corner, and that an increase in traffic to and from the landscape yard would be the ost noticeable change. Given that neither the site plan nor the notice provides a legal descripti of the area at issue, Prima asks that as a condition of the amendment Hall-Irwin provide a lega description of the area. Please also be advised that Hall-Irwin's noti e to Prima of the public hearing on this amendment was required to be provided to Prima at 'least 30 days in advance of that hearing. A berm was previously constructed from the entrance of the facility, proceeding north in front of the batch plant. It is in our opinion that there is no additional room for screening of the retail landscape sales area and we would be against screening or berming of this part of the facility. The landscape sales •• area will have a nice display yard and adequate landscaping. A landscape plan will be provided to the Department of Planning Services with the required Letter of Credit for the additional landscaping of the berm and the landscape yard. All requirements of the Flood Hazard Overlay District will be met. 1.D., 1.E., 1.F. and 6.A. After a meeting with Char Davis, Supervisor with the Weld County Department of Public Health and Environment (WCDPHE), it is our understanding that conditions 1.D., 1.F. and 6.A. can be omitted from the Conditions of Approval. Our current permits allow for the stock piling in the same areas which the landscape materials will be stock piled, therefore WCDPHE indicated that the Emission Permit would not require modification, the CPDS Permit from the Water Quality Control Division of the Colorado Department of Health did not need to be amended and the current dust abatement plan covers the uses within the landscape yard. As far as the septic permit is concerned, condition 1.E. indicates that the septic system in the Concrete Batch Plant needs to be re- evaluated. As explained to Ms. Davis, that septic system will not be utilized for this part of the facility. There is a septic system in the current modular office, which will be re-evaluated by a Registered Professional Engineer. The plan is to apply for a building permit for a new 14' X 70' modular office trailer as soon as the Board of County Commissioners gives approval. Through the building permit process the septic system will be re-evaluated. All requirements of the Weld County Building Inspection and Building Code, as well as the Flood Hazard Overlay District, will be met for the new office structure. A Flood Hazard Development Permit is being prepared by an engineer with Rocky Mountain Consultants and includes the new office structure. 1.H. through 1.J. Letters have been sent to each entity addressing their concerns. Copies will be forwarded you. 1.K. Hall-Irwin Corporation will enter into an Improvements Agreement for the landscaping and paving of the parking improvements, however, as an alternative we would also be willing to meet the landscaping and paving requirements prior to recording the plat.
