Dear Ms. Lockman:
We have reviewed additional information submitted to this office on June 6, 2002
regarding the above referenced proposal to subdivide a 20.5 acre portion of an 80.318-
acre parcel into 4 single family residential lots of approximately 4.5 acre in size and to
change the zone from A (agricultural) to E (estates). In our previous letter dated May
21, 2002 we mentioned that the North Weld County Water District (District) has been
proposed as the source of water however no letter of commitment from the District was
previously included in the submittal material. Therefore this time a letter from the
District was submitted to this office. Based on the information from the above-
mentioned letter the District is able and intends to serve the proposed subdivision. The
letter dated July 11, 2001 indicates that the District is able to serve six lots as were
originally proposed. The District will supply treated water to the subdivision, charging
fees for the water supply on a per tap basis payable prior to the activation of the tap.
Based on current records on file in this office, the District currently has an adequate
uncommitted water supply to provide the water associated with this project.
Furthermore additional information regarding the well with Permit No. 227585
previously proposed to be used for lawn and garden irrigation of the residential lots was
also included in the submittal material. This information indicates that since the well
with Permit No. 227585 is located on an adjacent recorded exemption lot it has no tie to
the proposed subdivision. However please note that according to our records the well
with Permit No. 227585 was issued on August 1, 2000 as the only well on tract of land
of 40 acres described as the SW1/4 of the SW1/4 of Section 32, Township 8 North,
Range 66 West of the 6th P.M. The use of ground water from this well is limited to fire
protection, ordinary household use inside three (3) single-family dwellings and the
irrigation of not more than one acre of lawn and garden and the watering of domestic
animals. The proposed subdivision overlaps a portion of the land described in the well
with Permit No. 227585. With the creation of this subdivision if the existing well will be
located on a parcel of land less than 35 acres then that parcel may be subject to th= '
subdivision regulations and that well may not be used on a subdivided land due t. 1

Dear Ms. Lockman:
We have reviewed the above referenced proposal to subdivide a 20.5 acre
portion of an 80.318-acre parcel into 4 single family residential lots of approximately 4.5
acre in size and to change the zone from A (agricultural) to E (estates). The remaining
60-acre portion of the 80.318-acre parcel will be maintained as agricultural. The Water
Supply Information Summary included in the submittal material indicates that the
household use water requirements for the four residential lots and the 60-acre parcel is
1750 gallons per day (1.96 acre-feet per year) and the water requirement for the
watering of 240 head of livestock is 4800 gallons per day (5.37 acre-feet per year)
totaling 6550 gallons per day (7.33 acre-feet per year) for the subdivision and the 60-
acre parcel. The North Weld County Water District (District) has been proposed as the
source of water and based on the applicant's information an agreement has been
reached with the District. However no copy of the agreement or a letter of commitment
from the District was included in the submittal material.
Pursuant to Section 30-28-136(1)(h)(II), C.R.S. a municipality or quasi-
municipality, upon receiving the preliminary plan designating said municipality or quasi-
municipality as the source of water for a proposed subdivision shall file, with the board
of county commissioners and the state engineer, a statement documenting the amount
of water which can be supplied by said municipality or quasi-municipality to proposed
subdivision without causing injury to existing water rights. A report of this nature has not
been filed with this submittal.
In addition there appears to be a conflict between the number of lots the District
agreed to serve and the number of lots mentioned in the Water Supply Information
Summary Sheet. The applicant indicated that the District agreed to serve two lots,
however the proposal is for five lots. Also, there is a notation in the submittal materials
that an existing well with Permit No. 227585 will provide irrigation water. The Water
Supply Information Summary Sheet does not indicate any irrigation water requirement
for the subdivision or for the 60-acre parcel.

According to our records the well with Permit No. 227585 was issued on August
1, 2000 as the only well on tract of land of 40 acres described as the SW1/4 of the
SW1/4 of Section 32, Township 8 North, Range 66 West of the 6th P.M. The use of
ground water from this well is limited to fire protection, ordinary household use inside
three (3) single family dwellings and the irrigation of not more than one acre of lawn and
garden and the watering of domestic animals. Since this well is limited to the above
uses the applicant needs to provide specific information on how the well with Permit No.
227585 is plan to be used for irrigation.

the opinion the insufficient evidence has been submitted to show the proposed water
supply can be provided without causing material injury to existing water rights.

The Weld County Public Works Department has reviewed this zone change request. Comments
made during this phase of the subdivision process may not be all-inclusive, as other concerns or
issues may arise during the remaining application process.
COMMENTS:
External Roadways:
❑ WCR 86 is classified by the County as a local road and requires a 60-foot right-of-way. This
right-of-way shall be shown on the final plat. The existing 60-foot right-of-way shall be
verified by the applicant and the documents creating the right-of-way noted on the final plat.
If the right-of-way cannot be verified, it will be dedicated on the final plat.
❑ WCR 86 is a gravel road. This development will introduce approximately 50 additional
vehicle trips per day to the roadway system. The applicant will be required to enter into an
agreement with the County to proportionately share the cost of improving WCR 86. The cost
will be based on a proportion of the traffic generated by the development to the existing
traffic.
Internal Roadways:
❑ Internal roads shall meet Weld County criteria for a PUD. The internal roadway right-of-
way shall be sixty (60) feet in width including cul-de-sacs with a sixty-five (65) foot radius,
and dedicated to the public. The typical roadway section of interior roadway shall be shown
as two 12-foot paved lanes with 4-foot gravel shoulders on the final plat. The cul-de-sac
edge of pavement radius shall be fifty (50) feet. Stop signs and street name signs will be
required at all intersections. The roadside drainage shall be contained within the right-of-
way.
❑ Intersection sight distance triangles at the development entrance will be required. All
landscaping within the triangles must be less than 3%2 feet in height at maturity, and noted on
the Landscape Plan. The bus stop bench and mailboxes must be outside the sight distance
triangles.

o The applicant shall provide a pavement design prepared by a professional engineer along
with the final plat submittal.
o Roadway and grading plans along with construction details will be required for the final plat.
o The applicant shall determine the name of the internal road. Two different names are
recorded on submitted plans: Griffith Street, and Rachel Drive.
o Easements shall be shown in accordance with County standards and / or Utility Board
recommendations on the final plat.
Drainage:
o A final drainage report stamped, signed and dated by a professional engineer licensed in the
State of Colorado shall be submitted with the final plat application. The 5-year storm and
100-year storm drainage studies shall take into consideration off-site flows both entering and
leaving the development. Increased runoff due to development will require detention of the
100-year storm developed condition while releasing the 5-year storm existing condition.
o The final drainage report shall include a flood hazard review with FEMA maps.
o Final drainage construction plans, conforming to the drainage report, shall be submitted with
the final plat application.
RECOMMENDATION:
We recommend approval of this Change of Zone application. The following Conditions of
Approval shall be fulfilled prior to final plat acceptance.
Conditions of Approval:
I. The right-of-way shall be verified and shown on the final plat for WCR 86. If the right-
of-way cannot be documented, it will be dedicated on the final plat.
2. The applicant will be required to enter into an agreement with Weld County to
proportionally share the cost of improvements to WCR 86. The applicant shall submit a
proposed agreement with the final plat application.
3. The internal roads shall -nareot—W-elel•-ceunly_ciiteizia—for a PUD and address the above
issues.
4. All landscaping within the site distance triangles must be less than 3%z feet in height at
maturity, and noted on the Landscape Plan. The bus stop bench and mailboxes must be
outside the sight distance triangles.

plat. Indicate stop signs and street names on final roadway plans.

Weld RE-9 School District with district offices located in Ault Colorado
has adopted a methodology to determine the in-lieu payment for
residential dwelling units sufficient to provide adequate educational
opportunities to new residential developments. The School District
Methodology has been developed in a manner so as to fairly
apportion the cost of acquiring school sites made necessary by
residential development.
The total in-lieu payment per dwelling unit is $759. Payment should
be hand delivered or mailed to Weld RE-9 School District, Box 68,
Ault, Colorado 80610. A receipt will be mailed to the party
requesting the exemption and a copy to Weld County Officials.

The Weld County Health Department has reviewed this proposal. The applicant is requesting to create 4 lots, with a
minimum lot size of 4.55, and an overall density of one septic system per 5.1 acres. This meets the current
Department policy.
The application has satisfied Chapter 24 of the Weld County Code in regard to water and sewer service. Water will
be provided by North Weld County Water District and sewer will be provided by individual sewage disposal systems.
The minimum proposed lot size (4.55 acres)coupled with the overall density of one septic system per 5.13 acres
meets the current Department policy. No'will serve' letter from North Weld County Water District was provided in
the application materials.
No additional soils data was included in the Change of Zone application materials. In the sketch plan materials a
geotechnical report from Advanced Professional Engineering, Inc. was included in the application. At that time,
Advanced Professional Engineering conducted a review of USDA Soil Survey for the site. That data supports the
use of conventional septic systems, although underlying sandstone is anticipated on portions of the site. Because
of the natural depression on the two western lots, care will be necessary in siting the septic systems to prevent the
potential flooding of those septic systems.
It is noted that the submitted Change of Zone plat already includes notes. These notes refer to PUD requirements.
It should be noted that this application is a Minor Subdivision.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from the North Weld County Water District.
2. A Weld County septic permit is required for each proposed septic system, which shall be installed in
according to the Weld County individual sewage disposal system regulations. Each septic system shall
be designed for site-specific conditions, including, but not limited to: maximum seasonal high
groundwater, poor soils, and shallow bedrock.
3. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control
Division of the Colorado Department of Public Health and the Environment. Silt fences shall be
maintained on the down gradient portion of the site during all parts of the construction phase of the
project.
4. During development of the site,all land disturbances shall be conducted so that nuisance conditions are
not created. If dust emissions create nuisance conditions, at the request of the Weld County Health
Department, a fugitive dust control plan must be submitted.
5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development
that disturbs more than 5 acres of land'must incorporate all available and practical methods which are
technologically feasible and economically reasonable in order to minimize dust emissions.
6. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in
duration,the responsible party shall prepare a fugitive dust control plan,submit an air pollution emissions
notice, and apply for a permit from the Colorado Department of Public Health and Environment.
7. "Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall be placed
on any recorded plat.

The Weld County Sheriff's Office would support this project with the following requests.
There is not mention in the plans whether the road into this minor subdivision will be deeded
over to the county or maintained by the subdivision. If it is maintained by the subdivision, there
needs to be plans put into effect to maintain the road into perpetuity. This should include a snow
removal and maintenance on the road so that emergency vehicles are able to access this minor
subdivision under any weather condition.
Signage at the entrance of the minor subdivision should be graphical in nature making it
easy for emergency responders to find residences within the subdivisions, perhaps even including
resident's names. Additionally, addresses should be clearly marked at each lot.
If the road is not deeded to the county then owners of the lots should be made aware that
there are substantial limitations on the enforcement powers of the county on private road ways in
/'IN regards to traffic enforcement.

1. Building permits shall be obtained prior to the construction of any building.
2. A plan review is required for each building. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when applying for
each permit.

3. Buildings shall conform to the requirements of the codes adopted by Weld County at the
time of permit application. Current adopted codes include the 1997 UBC, 1998 IMC, 1997 IPC,
1999 NEC and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado registered engineer.
Engineered foundations shall be designed by a Colorado registered engineer.
5. Building height shall be limited to the maximum height allowed per UBC Table 5-B. Wall and
opening protection and limitations shall be in accordance with UBC Table 5-A. Separation of
buildings of mixed occupancy classifications shall be in accordance with UBC Table 3-B and
Chapter 3. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 1997 Uniform Building Code for
the purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with the Bulk Requirements from Chapter 27 of the
Weld County Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback requirements.
Offset and setback requirements are measured to the farthest projection from the building.
7. A Flood Hazard Development Plan shall be submitted for buildings constructed within the
100-year flood plain.

After reviewing the Griffith subdivision located on cr. 86 which contains four 5 acre lots, I on
behalf of the Ault Pierce Fire Department find that the current fire protection in this area should
be sufficient to cover the additional four homes in this subdivision. These homes will be treated
by the fire deparirnent as all other rural homes are and in the event of a fire we will shuttle water
to the scene by tender from the nearest hydrant.
