W. ) KIRBY, LEONARD L. ROE and ) JUNE K. STEINMARK, ) Defendants . ) 1 . This is a proceeding for declaratory relief under C.R. S . 1973 , 13-51-101 et seq. and Rule 57 C .R.C . P . and for in- junctive relief , Rule 65 C . R.C .P . 2 . Donald K. Billings , James Hessler and Richard L. George are homebuilders and contractors actively engaged in business in Weld County, Colorado. Weld County Homebuilders Association , Inc. is a Colorado corporation representing the interests of home- builders and contractors in Weld County, Colorado . 3 . On December 26 , 1979 the Board of County Commissioners of Weld County passed a certain resolution , a copy of which is attached hereto , marked "Exhibit A" and made a part hereof. 4 . In addition to the resolution aforesaid as enacted by the Board of County Commissioners of Weld County, the fees of the Department of Planning Services were increased as illustrated by "Ehibit B" showing 1980 fees effective 2/13/80 , "Exhibit C" showing 1979 fees for similar purposes , "Exhibit D" showing 1978 "Building Valuation Data" , and "Exhibit E" showing 1980 "Building Valuation Data" , said exhibits being attached hereto , marked "Exhibits B, C, D , and E" and made a part hereof . "Exhibit F" , • attached hereto and made a part hereof, shows the building permit fees as increased. 5 . The said resolution, "Exhibit A" and the building permit fees increased thereunder, constitute discrimination against the Plaintiff builders, is unwarranted, arbitrary, unreasonable, excessive, unsupported, and is invalid, oppressive and confiscatory and bears no relation to the value of the privilege conferred. 6 . The said resolution, "Exhibit A" , in effect, imposes a tax in contravention of Section 3, Article X of the . Colorado State Constitution and places charges on those obtaining the permits which are in excess of actual costs and are devised to raise general revenue for. the County. 7 . The said resolution, "Exhibit A" , attempts to provide fees for the Planning Department by means other than a mill levy as required by state law. 8 . The said resolution is in contravention of the Home Rule Charter for Weld County, Colorado and specifically, Article III Section3-8 (b) , which states "Unless otherwise required by statute, the Board shall act only by ordinance in matters of legislation, contracts, appropriations, and disposition of real property, and by ordinance, resolution or motion, as may be appro- priate, in other matters. " 9 . The enactment of the said resolution, "Exhibit A" , violates C.R.S. 1973, 30-28-114 as amended in that the law requires "Such Board may also fix a reasonable schedule of fees for the issuance of such permits. " - the resolution establishing unreasonable fees. 10. The business conducted by the Plaintiffs is a valuable property and Plaintiffs have invested in their business a consider- able amount of money in machinery and special equipment for the purpose of construction and home building. The resolution, if implemented by the Defendants will place undue hardship on the Plaintiffs in their business, it will cause increasing numbers of individuals to be unable to afford homes in the County of Weld, it -2- will increase costs to an unreasonable extent in the County of Weld, and Plaintiffs claim that an injunction or restraining order is their only adequate remedy, since there is no adequate remedy at law and the damages are irreversible , noncompensable , and not capable of calculation. ].1 . The increase in building permit fees pursuant to the said resolution , "Exhibit A" , is not supported by substantial evidence . 12 . The Plaintiffs are entitled to judgment against the Defendants , that their officers , agents , and employees be forever enjoined and restrained from enforcing the said resolution , "Exhibit A" , and declaring that the resolution , txhibit A" , is void, illegal and of no force and effect, and unenforcible . 13 . Any and all fees paid pursuant to the said resolution , "Exhibit A" , should be returned to the individuals paying same subsequent to the adoption of said resolution . WHEREFORE, Plaintiffs demand judgment against Defendants , that their officers , agents and employees be forever enjoined and restrained from enforcing the adoption of the fee schedule pursuant to the resolution designated "Exhibit A" of this Complaint, that the Defendants be required to return any fees paid pursuant to the said resolution , "Exhibit A" , since its adoption, and Plaintiffs pray for a declaratory judgment under C . R.
