HomeMy WebLinkAbout20260020 Resolution Approve Amendment #1 to Extend Subrecipient Agreement for Community Development Block Grant (CDBG) Funds for Erie Home Rehabilitation Program (Project#24-4) and Authorize Chair to Sign — Town of Erie Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with Amendment#1 to Extend the Subrecipient Agreement for Community Development Block Grant (CDBG) Funds for the Erie Home Rehabilitation Program (Project #24-4) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Finance, and the Town of Erie, commencing December 31, 2025, and ending September 30, 2026, with further terms and conditions being as stated in said amendment, and Whereas, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Amendment #1 to Extend the Subrecipient Agreement for Community Development Block Grant (CDBG) Funds for the Erie Home Rehabilitation Program (Project#24-4) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Finance, and the Town of Erie, be, and hereby is, approved. Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign said amendment. This program consists of minor repairs and/or maintenance of ten (10) single-family, owner-occupied homes for low to moderate-income residents of Erie. The Town of Erie has requested an extension of the time of performance until September 30, 2026 so as to complete the repairs on these homes. Weld County CDBG Program staff requests the Board of County Commissioners authorize the Board Chair to sign the attached Amendment to Extend Agreement to extend the time of performance. The Weld CDBG grant to the Town is in the amount of$167,000. What options exist for the Board? 1. Concur with extension and approve Board Chair to sign. 2. Do not concur. Consequences: Authorizing signature of this Agreement is necessary for the project to move forward. Impacts: Assistance with minor home repairs will allow low- and moderate-income persons to remain in their homes— housing preservation. Costs (Current Fiscal Year/ Ongoing or Subsequent Fiscal Years): The grant award amount is capped at $167,000. Recommendation: Staff recommends option 1. WHEREAS the Grantee and the Subreciplent entered Into a Community Development Block Grant Subreciplent Agreement on February 12, 2025 (the "Agreement")and; WHEREAS both parties agree to extend the Subrecipient Agreement for an additional time period; and, NOW THEREFORE the parties agree to modify the following parts of the agreement: Section II TIME OF PERFORMANCE as set forth below. 1. Section II of the Agreement with the Subreciplent dated February 12, 2025 which states: Services of the Subreciplent shall start on the day of the Notice to Proceed and end on the 31"day of December, 2025 is hereby amended to read: Services of the Subreciplent shall start on the day of the Notice to Procced and end on the 30`"day of September, 2026. 2. L, 20Z10- 002-0 Town of Erie Resolution No. 25-217 A Resolution of the Town Council of the Town of Erie Approving an Amendment to Extend the Community Development Block Grant Program Home Repair Program Subrecipient Agreement with Weld County and the Colorado State Historic Preservation Office Whereas, on November 19, 2024, the Town Council approved the Community Development Block Grant Program Home Repair Program Programmatic Agreement with Weld County and the Colorado State Historic Preservation Office; Whereas, the parties wish to amend said Subrecipient Agreement to extend the term of services beyond December 31, 2025; Whereas, the extension will allow the Town and its partners to maintain program continuity, provide essential services to residents, and comply with applicable federal and state requirements; and Whereas, the Town Council finds that it is in the best interest of the Town, and necessary for the public health, safety, and welfare, to approve the Amendment to Extend the Subrecipient Agreement to ensure continued implementation of the Home Repair Program.
