RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A VETERINARY CLINIC -
ROBERT E. AND MAURY L. MILLER
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 26th day of October, 1983 , at the hour of 2 :00
o ' clock p.m. in the Chambers of the Board for the purpose of hear-
ing the application of Robert E. and Maury L. Miller, P.O. Box
626, Johnstown, Colorado 80534, for a Use by Special Review for
a veterinary clinic on the following described real estate,
to-wit:
The Ez NWa, Section 32 , Township 5 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado.
WHEREAS , Section 24. 4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence pre-
sented in this matter, and having been fully informed, finds
that:
1. The submitted materials are in compliance with the
application requirements of Section 24. 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24. 4 . 2 of the Weld County Zoning Ordinance as follows :
a. The proposal is consistent with the Comprehensive
Plan in that the policies of the Plan promote
agribusiness and agriculturally oriented industry
so long as they do not create negative impacts on
the environment or the County. The proposal is
consistent with the intent of the Agricultural
Zone District and is allowed as a Use by Special
Review. The use is both compatible with exist-
ing agricultural activities and with land use which
is contemplated to be agricultural in the
Comprehensive Plan.
b. The Johnstown Planning Commission recommends

c. No overlay districts affect the site of the
veterinary clinic, however, the northeast tip
of the 80 acres under consideration lies within
the 100 year flood plain.
d. Operation and Design Standards provide adequate
protection of the health, safety and welfare of
the immediate area and the County.
NOW, THEREFORE , BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application for
a Use by Special Review for a veterinary clinic on the herein-
above described parcel of land be, and hereby is, granted sub-
ject to the following conditions:
1. The attached Operation Standards being adopted.
2 . The approved Operation Standards shall be placed on
the Special Review Permit Plat. The Use by Special
Review Permit Plat shall be delivered to the Depart-
ment of Planning Services.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of
October, A.D. , 1983.

OPERATION STANDARDS
MILLER VETERINARY CLINIC

1. The uses permitted shall be a veterinary clinic and facilities as
described in the application materials on file with the Department of
Planning Services.
2. The veterinary clinic shall comply with all applicable Weld County
Health Department and Colorado State Health Department regulations.
3. The applicant shall comply with the design standards for Use by Special
Review, Section 24.5 et seq. of the Weld County Zoning Ordinance.
4. The applicant shall comply with the Operation Standards for Uses by Special
Review, Section 24.6 et seq. of the Weld County Zoning Ordinance.
5. The Use by Special Review shall be limited to the plans shown hereon and
governed by the Operation Standards stated above, and all applicable Weld
County Regulations. Any material deviations from the plans and/or
Operation Standards as shown or stated above shall require the approval
of an amendment of the Use by Special Review Permit by the Weld County
Planning Commission and the Board of County Commissioners before such
change from the plans and/or Operation Standards are permitted. Any
other changes shall be filed in the office of the Department of Planning
Services.
6. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Operation Standards. Noncompliance
with any of the above stated Operation Standards may be reason for revocation
of the Use by Special Review Permit by the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated October 10, 1983, and duly
published October 13, 1983, in the La Salle Leader, a public hearing was held
for the purpose of considering a Use by Special Review for a veterinary clinic.
Before the hearing commenced, the Chairman Pro-Tem, John Martin, reminded the
applicant that because only 3 Commissioners were present, the applicant may
request that this hearing be continued. The applicant, Robert Miller, said
he wished to proceed today. Russ Anson, Assistant County Attorney, then
read this request for a Use by Special Review for a veterinary clinic into
the record. Rod Allison, Planning Department representative, read the favorable
recommendation, with conditions and Development Standards, from the Planning
Commission into the record. Dr. Robert Miller, the applicant, was present and
came forward to answer questions of the Board. After discussion, Commissioner
Brantner moved to approve this request for a USR, with the conditions and
Standards as recommended. Commissioner Johnson seconded the notion and it
carried unanimously.

Supporting Documents
1. (a) The nronosal for an agricultural residence veterinary clinic is
consistent with the :(eld County Comprehensive Plan, as evidenced
on name 123 of the Plan, wherein it is stated that, "The expansion
of amri=:rusiness and industry will be encouraged.
(b) leterinary medicine is an integral part of agriculture, and would
be consistent with a district which is zoned for agricultural use.
(c) The use of the land for a veterinary medical facility is consistent
with all surrounding land use, which is agricultural.
(d) A veterinary medical facility, which would be used in the treatment
and care of large and small animals, is compatible with the future
development of the surrounding area in that it is directly related
to agriculture, and agriculture is the projected use for this area
as indicated by the future land use map.
(e) The northeast tip of the 80 acres under consideration lies within the
100 year flood plain. However, this use by special review permit •
will not apply to that particular area.
(f) The proposed use is to be located in a present residence and a
present agricultural use building (barn), and would not consume
any productive agricultural land.
(g) The practice of veterinary medicine does not present a potential
health, safety or welfare hazard to the inhabitants of the neighborhood
or the county. Any animals treated at this facility will be adequately
confined in such a manner that no hazards to the surrounding neighborhood
will exist.
EXHIBIT E - Agricultural Residence Veterinary Clinic Proposal
Proposed Operation and Use
5. (a) ie propose to establish a veterinary medical clinic on our eighty
acres of agricultural land, utilizing the existing facilities.
Large animals (primarily horses and cattle) are to be examined,
treated and housed in an existing occupied barn. Part of the barn
is to be used for housing cats and dogs within a completely enclosed
and insulated facility. The basement area of the existing residence
is to be used as a combination office, laboratory and small animal
(domestic nets) surgical and treatment facility. A proposed future
building, if needed, would contain the office and hospitalization
facilities.
(b) The barn is located 75 feet from the residence, and the office is to
be in the basement of the present residence.
(c) Office hours are to be during daylight hours, and the maximum number
of employees is anticipated to be three (3).
(d) The maximum number of clients anticipated daily is approximately
twenty (20).
(f) The maximum animal census anticipated to be at the veterinary clinic
at any one time is as follows:
Horses - five (5)
Cattle - ten (1O)
DO7S - twenty (20)
Cats - twenty (20)
Other - five (5)
(g) No additional structures are planned at this time. Future expansion,
however, may require a separate building for office and hospitalization
facilities (see paragraph "a") and/or a caretaker's residence.

5. (h) '/ehicular traffic anticipated will be automobiles, nickun trucks,
stock trailers and farm trucks, with an anticipated frequency of
one vehicle every 30 to 45 minutes. The access roads to County
toad 154 are County Roads 151 and 52.
(i) An in_nlace septic system will be utilized.
(j) "o stockpile, storage or waste areas will need to be utilized.
(k) Local weekly disposal services will be utilized for removal of
debris, junk and wastes. County animal disresal services will be
used as necessary for dead animal removal.
(1) The oreration will require no further construction.
(m) Landscaping of the residence, including £encinm, nlanting of grass,
trees, shrubs and installation of cement walkways is currently in
nrogress . In addition, land has been leveled, fences built and
nasture grass has been seeded around the barn and outlying areas. A
gravelled access road and narking area have been provided for the
proposed clinic facility.
(n) The need for reclamation procedures is not anticipated in this type of
business venture. In the event that the basement clinic would not be
used for the intended purpose, it would be used as a traditional
residence basement. The barn and corrals will be used for the owners'
rersonal use.
(o) Fire extinguishers -placed at strategic locations are to he used for
fire protection.

housing cats and dogs within a completely enclosed and insulated
facility. In addition, some small animals will be housed in the
basement clinic of the residence in a completely- enclosed, insulated
and sound-proofed kennel room. Future outdoor kennel expansion, if
needed, would house animals only during daylight hours, and would be
constructed in such a manner so as to provide for minimum noise
disturbance.

1. No boarding of animals except for those being retained
for medical care is permitted. Boarding of pets for
compensation requires application to the Colorado
Department of Health for such a license and compliance
with all applicable rules, regulations and construction
standards.
2. A septic system permit is required if the proposed
clinic building becomes a reality. Such a permit
is obtainable from our office.
3. The Colorado Noise Statutes, Section 25-12-101 et,al.
must not be exceeded. Animal noise must not create
