RE: APPROVAL OF RECORDED EXEMPTION NO. 617 - GARY AND MARY
CRAWFORD
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 617, being the property of Gary
and Mary Crawford, described as part of the SW4 , Section 17 ,
T5N, R66W of the 6th P.M. , Weld County, Colorado, being more par-
ticularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, does
not come within the purview of the definition of the terms "sub-
division" and "subdivided land" , pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973 , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners that the hereinabove described parcel of land owned by
Gary and Mary Crawford be, and hereby is , exempt from the defini-
tion of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following: 1) the applicant shall reserve
a fifty (50) foot right-of-way width from the centerline of West
28th Street for future arterial right-of-way needs , as expressed
by the City of Greeley; 2) the applicant shall provide for a
one-hundred-fifty (150) foot lot depth instead of the one-hundred-
two (102) feet, as indicated for Lot "A" . Lot "A" shall be de-
signed to meet the minimum lot size requirements of one (1) acre
for the County in the Agricultural Zoned District. These require-
ments are intended to satisfy policies for the County as
well as the City of Greeley; and 3) the applicant shall submit a
mylar plat with the above stipulations to the Department of
Planning Services ' Office to be recorded in the office of the Clerk
and Recorder. The plat shall be drawn in accordance with the

requirements of Section 9-2 C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within ninety (90) days
from the date of approval by the Board.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 1st day of
June, A.D. , 1983.

Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Gary and Mary Crawford for a recorded exemption. The parcel
of land on which this request is being made is described as part of the
SW4, Section 17, T5N, R66W of the 6th P.M. , Weld County, Colorado.
The property is located approximately 1.5 miles west of Greeley on Weld
County Road 56 (i.e. , West 28th Street) . The property contains approxi-
mately 4.993 acres of Class IIIe, IVe irrigated soils and VIe nonirriagated
soils.
The request is to divide the property into parcels of 3.993 acres and
1.0 acres, more or less. The intent of this recorded exemption is to
provide a buildable lot for their daughter and her family.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The request complies with Section 9-2 C. of the Weld
County Subdivision Regulation Submission Requirements;
2. The request complies with Section 9-2 E. of the
Subdivision Regulations as follows:
- The 4.993 acres, more or less, under consideration will
allow uses which are consistent with the intent clause
of the Agricultural Zone District. The uses will be
compatible with existing surrounding uses;

- The proposal was reviewed by the city of Greeley and was
found to comply with their long-range Comprehensive Plan;
the subject site is within Greeley's 30 year growth boundary;
- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land divi-
sion complies with the Weld County Comprehensive plan, there-
fore the proposed use is consistent with efficient and
orderly development;
- The proposal does not exist in an overlay district area;
- The City of Greeley (i.e., Gold Hill Line) has indicated
adequate water service is available for this proposal;
- The proposed lots are not part of a recorded exemption
within the last five (5) years;
- The two lots proposed will have adequate access from West
28th Street;
- The Weld County Health Department has indicated, in a
letter dated May 12, 1983, that both lots will have
adequate sewage capacity.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall reserve a fifty (50) foot right-of-way

List of determinations
A) This proposal is consistent as it is our intent to adhere to the same principles and
course with respect to our district and our neighbors.
B) Due to the numerous trails,general open spaces , light traffic,-and neighbors with similair
interests makes this a very desirable area for the horse person. Iv,e spent my lifetime
working up to this and would do nothing inconsistent or compatible with existing land
uses.
C) The city of Greeley informs me this area is in their thirty year growth ring.This request
should not he so drastic as to interfere with future development, even in the year 2013..
D) Information given me by the Weld Co. Planning and Zoning indicate our location is not
with-in anv overlay district.
H) The proposed site is conducive to an effecient and orderly use of the existing landscape
and structures. The proposal is explained in detail in part four of the application
requirements.
F) As I understand from the weld Co. Planners , that through a mutual agreement, the City
of Greeley accept the greater authority in regards to long range comprehensive planning.
I further understand the Weld Co. Planners have no comprehensive plans for this area.
H) The proposed land division is bordered by west 28th. St. (659 ft. frontage) on the south
which is the access.
I) Construction is in progress on a 54 inch water main which runs within 100 feet of proposed
building site. Water taps are available from the city of Greeley Public Works Department.
J) The light soil and gradual decline of the terrain are conducive to an excellent. septic
tank and leach-field. It was tested in 1979 and is in compliance with Weld County Health
Departments requirements.
K) Records indicate that property was purchased March 2cd. 1972 by Galen and Janet Nation.
We, Gary and Mary Crawford bought the pronerty from the Nation,s on April 19, 1979.
L) It is my intent to describe the proposed land use explicitly and honestly and in no way
will evade Weld Co. requirements.
M) I recognize and exercise all standards set by Weld County Health Dept. The proposed land
use will not deter from present safety and sanitary conditions self imposed in regards
to the corrals, barns , and general upkeep of the property.

1) The purpose and nature of this request is an attemt to qualify for a building permit.
2) Up to this point I have not been able to obtain very much positive information. It is
my sincere hope I may confer with and accept competent information from the planning
board which possess the scope and authority.
3) This proposal consists of a home for my daughter and her family.
4) This will be cohering to the same principles and in congruence with the district.
5) Greeley planners inform me this area is with-in the thirty year growth ring. The recent
6) oil and gas drilling in our immediate area may or may not have much effect on housing
development in the future.Any structure we intend to build will be of such small scale
it is inconceivable to realize why it won,t blend in future development.There are examples
presently in the city limits where small farms have been surrounded by housing and the
original houses and- other structures do not detract from an orderly growth and development.
7) This proposal should not be affected by an overlay district regulation as there are no
rivers, airports, or any other major geological changes present or proposed on or near
may property.
8) Copy of deed or purchase contract. Enclosed in proposal.
9) If the proposal is accepted the lot will be surveyed from the existing five acre tract.
The intent will then be to build a home for my daughter and her family. This will allow
my family to be on a near enough yet far enough basis. My daughter is a working mother
and this would allow mutual convenience' for baby sitting and school bussing. My job requires
nights away from home, and my son-in-law works straight nights. The ladies can conveniently
stay with one as neither my wife or my daughter like to stay alone at night. On my tour
of duty my son-in-law takes over feeding, regular chores, and minor maintenance. My wife,s
health no longer allows her to perform even the lightest duties.
