WORTH A a WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County o 0 Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, -4 Colorado has reviewed the request of Tom Worth and Charity E. Worth for an exemption from the definitions of "subdivision" 71; -C and "sub-divided land" in Section 30-28-101 (10) , CRS 1973, as amended, and Section 2-1 of the Weld County Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that Tom Worth and Charity E. Worth are owners of a certain parcel of land located in part of the Southwest Quarter of Section 28 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in Exhibit A, being hereby attached hereto and incorporated herein by reference, and WHEREAS, the Board of County Commissioners has considered the recommendations of the Department of Planning Services in this matter and has reviewed information submitted by the applicants. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the aforementioned parcel of land owned by the applicants, be and hereby is, declared to be exempt from the definition of "subdivision" and "sub-divided land" as set forth in Section 30-28-101 (10) , CRS 1973, as amended, and in Section 2-1 of the Weld County Subdivision Regulations, and further finds that said parcel of land shall be considered a single lot. Tom and Charity Worth raise Quarter Horses on their existing property. With less than six acres and the location of house, barns and corrals, there isn't adequate space to raise hay or pasture horses. The Worths wish to purchase 20 additional acres in order to provide the hay required and to be able to turn their horses out to pasture during the summer months. Dietrich and Christa Neckien have offered to sell them 20 acres but the property is not adjacent to the Worth parcel . As we understand, there must be an adjacency in order to qualify for a Subdivision Exemption. To help the Neckien/ Worth transaction meet this requirement, another good neighbor agreed to participate in this three way exemption request. Larry E. and Jacqueline Loesch own property adjacent to both the Neckiens and the Worths. They have agreed to exchange 10. 329 acres more or less adjoining the Worth property for 11 . 35 acres more or less of the Neckien property being purchased by the Worths.
