BOX 25128 , OKLAHOMA CITY, OKLAHOMA 73125. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 14th day of May, 1980 at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Cities Service Gas Company, P.O. The attached Development Standards being recommended and adopted for the Special Use Permit. 2 . No building or electrical permits shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit and the property owners signature have been placed on the Special Use Permit plat and the plat has been delivered to the office of the Department of Planning Services . Cities Services Gas Company I DEVELOPMENT STANDARDS 1. The permitted use on the hereon described parcel of land shall be for the installation and operation of a natural gas transmission compressor station and all uses permitted by right in the Agricultural Zone District. Major facilities shall be limited to those shown hereon which includes: a. A single family residence and garage for station personal. b. One (1) natural gas engine/compressor unit with future expansion to two (2) such natural gas engine/compressor units. c. Auxiliary and related equipment as shown with future expansion to include a second compressor building 2. The engine/compressor unit(s) may be in operation 24 hours per day and 365 days per year. 3. All accesses shall have the approval of the Weld County Engineering Department and/or State Highway Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department and/or State Highway Department. 4. All construction, electrical work and fabrication will be done in accor- dance with the Weld County Building Code. 5. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 6. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 7. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 8. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment of the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 9. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. The plans for the compressor station have been approved and certificated by the Federal Interenergy Regulatory Commission. Compressor stations are needed to keep the gas flowing at intervals along the line. He was asked if this was the last one they would install in Colorado? He stated there will be one in Yuma and one at Merino next year. The compressor stations are permanent installations which will last as long as the natural gas supply lasts. Discussion from the Audience - There was none. MOTION: Bob Ehrlich moved the Department of Planning Staff Recommendations and Development Standards be accepted by reference and forwarded to the Board of County Commissioners with recommendation for ap- proval. Statements required by the Procedural Guide for Special Use Permit Applications, which are not included in the attachments, are as follows: (1) The proposed facility is a natural gas transmission compressor station to be used in the transportation of natural gas in interstate commerce, as certificated by the Federal Energy Regulatory Commission, Washington, D. C. The station will be manned 8 hours per day and unattended for 16 hours per day. Normally, there will be no more than two permanent employees on site. Pollution effects will be minimal . There will be no water discharge. A permit for the construction of these facilities has been obtained from the Colorado Department of Health, Air Pollution Control Division. A copy of this permit is attached. The average sound level at the property line is estimated to be 52dBA. This, of course, depends on the magnitude of the ambient sound level condition at this location. The operation of this facility will not materially affect the sound level outside Cities Service Gas Company 's property . The compressor station will compress natural gas which is a combustible material. However, the compressor station will incorporate monitoring and automatic shut-down , r Page 2 March 4 , 1980 devices to handle leaks and prevent fire. If a fire does occur it will be confined to the facility site. This facility is designed in accordance with federal regulations . As this facility will not be patronized or visited by the public, no traffic congestion will occur as a result of the operation of this facility. (2) Sewage disposal will be by means of a septic tank and leach field or lagoon. All sewage facilities will be constructed and operated in accordance with all state, local, and federal regulations . (3) Water will be supplied by a ground water well at a maximum rate of 30 gallons per minute. A water well permit was filed with the Colorado Division of Water Resources on January 31, 1980, and a copy is attached. Box 25128 Oklahoma City, Oklahoma 73125 Attn: Tom Inman The following comments are in relation to your request for site and soil information for three areas under consideration for construction of - microwave towers. The first area of consideration is a tract location in the SE4 of Section 20, Twp. 12N, Range 67W. As shown on the location map, the site appears to be located on the soil type Otero sandy loam, 3 to 9 percent slopes. This is a deep, well drained soil with a rapid permeability, medium to rapid surface runoff and a low erosion hazard. Some of the soils in this area may have shale and sandstone within 60 inches of the surface. This soil should exhibit good bearing strength for slab on grade construction. However, it is very susceptable to wind erosion due to its light surface texture. Surface protection of any disturbed areas should be of prime 1 consideration by either use of mulches or revegetation. The second area of consideration is the tract located in the SE4 of section 22, Twp. 7N, Range 58W. As indicated by the location map, the site is on two soil types. They are Terry fine sandy loam, 0 to 3 percent slopes and Weld loam, 0 to 3 percent slopes. The Terry fine sandy loam is a moderately deep, well drained soil with sandstone usually found at depths of 20 to 40 inches. This soil has a moderately rapid permeability, slow surface runoff and a low erosion hazard. It exhibits good surface strength that should be adequate for slab on grade construction. The surface of this soil is sus- ceptable to wind erosion when exposed, and surface protection should be of prime importance during construction. Mulches and revegetation are methods to provide this protection. Weld loam is a deep, well drained soil with slow permeability, slow surface runoff and a slight erosion hazard. This soil exhibits weak supportive strength which may not be acceptable for the type of construction being considered. It also exhibits a shrink-swell potential that may preclude desired use. A soil engineering analysis should be made for this soil to determine proper design perimeters. . v The third site under consideration is located in the NW4 of Section 28, Twp. 8N, Range 61W, and from the location map appears to be made up of the soil type Platner sandy loam, 0 to 3 percent slopes. This is a deep, well drained soil with slow permeability, low surface run- off, slight erosion hazard and a moderate soil blowing hazard. The main limiting factor for this soil is the presence of a heavy clay loam between 8 and 20 inches which has a very high shrink-swell factor. Any foundations or slab on grade will have to be specially designed for use in this area. Enclosed for your information are the descriptions for the individual soils and copies of the soil maps for the three areas. This informa- tion is provided on a general basis and does not preclude the necessity for on-site investigations or soil engineering analysis, should features other than these described above be found. This soil is suited to most of the irrigated crops commonly grown in the area, although some restrictions will occur because the soil is only moderately deep. Row crops can be irrigated by furrows or sprinklers . Flooding from contour ditches and sprinkling are suitable methods of irrigation for close grown crops and pasture . Most of the area is planted to winter wheat which is Limo/ alternated with summer fallow to allow moisture accumulation. Normally, precipitation is too low to make beneficial use of fer- tilizers. ' Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to control wind and water erosion. The potential native vegetation on this site is dominated by sand '::•:: $ bluestem, sand reedgrass and blue grama. Needle-and-thread, switch- grass, sideoats grama and western wheatgrass are also prominent. Potential production ranges from 2200 pounds per acre in favorable years to 1800 pounds per acre in unfavorable years. When range condition deteriorates , sand bluestem, sand reedgrass and switch- grass decrease and blue grama, sand dropseed and sand sage increase. Annual weeds and grasses invade the site as range condition becomes . poorer. In cropland areas , habitat favor- able for ring-necked pheasants, mourning doves , and many non-game species can be developed by establishing wildlife areas for nesting and escape cover. For pheasants, the inclusion of undisturbed nesting cover is vital and should be included in plans for habitat development: -this is especially true in areas of intensive agriculture. Rangeland wildlife , • exemplified by the pronghorn antelope, can be assisted and encouraged by development of livestock watering facilities , proper livestock r ': grazing management, and range reseeding where needed. The underlying sandstone is the most limiting feature of this Terry soil. Neither septic tank absorption fields or sewage lagoons will - '" . operate properly. Site preparation for dwellings is more costly. - - Environmental and beautification plantings of trees and shrubs may be difficult to establish. This soil does , however, have good potential for recreational development, such as camp and picnic areas , and playgrounds. Where irrigated this soil is suited to all crops adapted to this area, including corn, sugar beets , beans , alfalfa, small grains, and onions. 4g An example of a suitable cropping system is alfalfa 3 to 4 years followed by corn, corn for silage , sugar beets , small grain, beans and back to alfalfa. Some conservation practices such as land leveling, ditch lining and pipelines may be needed for proper water applications. Station site containing 15. 0 acres more or less. Lessee's failure to make payment or tender of any periodic pay- ment when due shall not operate to terminate or impair any provision of this lease but Lessee shall make such periodic payment within sixty (60) days after written notice from Lessor. It is agreed that the consideration herein- before recited, together with each herein provided periodic payment, shall operate, cover and be held to be full consideration and compensation to Lessor for all privileges, rights, and each option granted Lessor under this lease. It is agreed that Lessee shall have the right to terminate this lease at any time by giving 60 days notice in writing to Lessor of its intention to terminate this lease. The Lessee shall have the right to assign this lease or to sublease said premises, in whole or in part. Lessee shall have the right to remove all property placed by it upon said premises at any time and within a reasonable time after the termination of this lease. Lessee shall have the right of ingress and egress at all times during the operation of this lease, and at the expira- tion thereof, Lessee shall return the premises peaceably to Lessor in as good condition as when received, reasonable wear and tear, damage from the elements, fire, acts of God, or other casualty excepted.
