Statement of Compliance with C.R.S. § 30-28-213(2)(a)(III)
Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, C.R.S. § 30-28-213(2)(a)(III) states the following:
"(2)(a) On or before December 31, 2025, the board of county commissioners of a
county with a population of twenty thousand or more according to the 2020 federal
census shall do one of the following:
(III) Adopt an ordinance or resolution that establishes that the county does not intend
to adopt an ordinance or resolution in accordance with subsection (2)(a)(I) or (2)(a)(II)
of this section and that the county permitting agency will continue to utilize the county's
existing permitting review process for EV charger permit applications."
Now, therefore, be it resolved by the Board of County Commissioners of Weld County,
Colorado, that the Board does not intend to adopt an ordinance or resolution in
accordance with C.R.S. § 30-28-213 (2)(a)(I) or (2)(a)(II) and that the Weld County
Planning Department will continue to utilize the County's existing permitting review
process for EV charger permit applications, as found in Chapters 23 and 29 of the Weld
County Code as authorized by C.R.S. § 30-28-213(2)(a)(III).
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Resolution, on motion duly made and seconded, by the following vote on
the 31st day of December, A.D., 2025:
