HomeMy WebLinkAbout820704.tiff L ✓✓(/ SUMMARY OF PROCEEDINGS AT STATE BOARD OF SOCIAL SERVICES MEETING September 10, 1982 The Board adopted the following rules which were approved for consideration at previous meetings: Document 1. Revisions to the County Personnel Merit System Rules Concerning Grant- ing County Departments of Social Services Complete Flexibility in Es- tablishing Overtime Compensation Policies. These rules include provi- sions for the county departments of social services to construct and adopt individual overtime policies, subject to the approval of the State Department of Social Services. 2. Revisions to the Income Maintenance Rules Concerning Certain Provisions of the AFDC Program.. These revisions include clarification of Aid to Families with Dependent Children rules in order to comply with final regulations based on the Federal interpretation of the Omnibus Recon- ciliation Act of 1981 regarding earned income, immediate and monthly reporting requirements, nonrecurring lump-sum income, employment dis- regards, and the method of prorating initial payments. 3. Revisions to the Food Stamp Rules Concerning Local Level Fraud Hearings and Certain Claims Procedures. These revisions include provision for county/district food stamp offices (at their option) to conduct local level administrative fraud hearings, procedures for such hearings, client rights at such hearings, and also, clarification concerning certain claims procedures. 4. Revisions to the Food Stamp Rules Concerning Permitting County Food Stamp Offices to Retain 25 Percent of Amounts Recovered Due to Over- issuance of Food Stamps for Reasons Other than Recipient Fraud. These rules include provisions allowing the counties to retain 25 Percent of all food stamp nonfraud cash payments that result from client error. 5. New Rules Establishing Goals for the Reduction of Foster Care Place- ments of Children in Accordance with the Federal Adoption Assistance and Child Welfare Act of 1980. These rules include provisions con- cerning the reduction of the number of children in foster care for periods in excess of 24 months at the rate of 3 percent each year through FY 1988. 6. Revisions to the Income Maintenance Rules Concerning Clarification of Length of Institutional Stay for Medical Eligibility Purposes and Application of Amortization Procedures Regarding Property Transfer in Reference to Medicaid Eligibility. These rules include provi- sions concerning the amortization of transferred property for Medi- caid purposes, the definition of institutional status to include the requirement for a full calendar month's length of stay, and clarification of eligibility under the SSI definition of disability or blindness. COLA � , /1)44 Summary of Proceedings At State Board Meeting - 2 - September 10, 1982 The Board adopted the following emergency rules: Document 7. Revisions to the Services for the Aging Rules Concerning Allocation Formula for Distribution of Funds to Area Agencies on Aging. The 1980 census determined changes in the elderly poverty population of the State. The formula for allocation of Older Americans Act funds mandates that the most equitable distribution of funds be done as soon as possible so that the greatest amount of resources becomes available to the citizens of the areas of greatest need. Any delay diminishes meeting that great need and affects the health, safety, and welfare by not serving those citizens adequately, such as an in- sufficient nutrition program to meet the nutritional requirements of those in need. 8. Revisions to the Income Maintenance Rules Concerning FY 82-83 Low Income Energy Assistance Program (LEAP) Basic Benefits. These re- visions implement the 1982-1983 State Plan for the Low Income Energy Assistance Program (LEAP) Basic Benefits and incorporate input from county departments of social services and other inter- ested organizations which resulted in changes designed to improve the program and provide additional clarification in the rules governing the program. Adopted emergency effective November 1, 1982, to allow for receipt of federal funds for the program. Further- more, delay in implementation would deprive clients of benefits for which they would otherwise be eligible. 9. Revisions to the Income Maintenance Rules Concerning FY 82-83 Low Income Energy Assistance Program (LEAP) Emergency Home Heating Program. These revisions implement the 1982-1983 State Plan for the Low Income Energy Assistance Program (LEAP) Emergency Home Heating Program and incorporate input from county departments of social services and other interested organizations which re- sulted in changes designed to improve the program and provide addi- tional clarification in the rules governing the program. Adopted emergency effective October 1, 1982, to allow for receipt of federal funds for the program. Furthermore, delay in implementa- tion would deprive clients of benefits for which they would other- wise be eligible. 10. Resolution Terminating the Colorado Refugee Services Program effective midnight, September 30, 1982. The resolution rescinds the refugee services program rules as of September 30, 1982, until legislation is passed by Congress or a grant award to cover 100 percent of this federally-funded program is authorized by the Department of Health and Human Services. Adopted emergency since no grant award for the first quarter of federal fiscal year 1983 has been made which would provide continued funding for the Colorado Refugee Services Program. Summary of Proceedings At State Board Meeting - 3 - September 10, 1982 Document 11. Revisions to the Food Stamp Rules Concerning Changes to Coupon Allotment Tables Reflecting Changes in the Thrifty Food Plan. These revisions increase the Coupon Issuance Tables in the Food Stamp Program to conform with federal program changes which go into effect October 1, 1982. Adopted emergency due to the federal implementation date of October 1, 1982. Furthermore, delay in implementation would deprive clients of immediate benefits for which they would otherwise be eligible. 17. Revisions to the Medical Assistance Rules Concerning Removal of Requirement for Social Security Numbers, or Application for Social Security Numbers, as a Requirement for Medicaid Eligibility for Children in Foster Care. These revisions delete the requirement for a social security number or application for a social security number for Medicaid eligibility for children in Child Welfare Foster Care. Adopted emergency effective September 10, 1982, to eliminate inappropriate quality control errors. Furthermore, delay in imple- mentation would deprive clients of immediate benefits for which they would otherwise be eligible. The Board approved the publication of the following rules for adoption consideration at the next regular meeting: Document 12. Revisions to Income Maintenance Rules Concerning COIN 80 Conversion and Intercounty Transfer Requirements. 13. Revisions to Food Stamp Rules Concerning Implementation of Coupon Account and Destruction Report (FNS-471) and Elimination of References to Obsolete Forms. 14. Revisions to Medicaid Rules Concerning the Financial and Statistical Report for Nursing Homes (MED-13) to Conform with Federal Require- ments and Provide Additional Information. 15. Revisions to Medicaid Rules Concerning Deletion of Recipient Health Resource Information Form (MS-10). EXECUTIVE DIRECTOR RULE-MAKING SESSION At an open, public session on September 10, 1982, the Executive Director adopted the following rules: Revisions to the Child Welfare Manual Eligibility Reporting Manual and the Financial and Medical Eligibility Reporting Manual Concerning Instructions for Medical Resource Codes. Summary of Proceedings At State Board Meeting - 4 - September 10, 1982 DEPARTMENTAL DEVELOPMENTS 1. The Board approved a Plan for Alternatives to Out-of-Home Placement for Grand County. 2. The Board approved Amendments to the Plan for Alternatives to Out-of-Home Placement for El Paso County. 3. The Board also approved a Weld County Community Work Experience Program Plan.
