Prior to recording the Site Plan Review plat, the applicant shall address the following to the "Deepartment of Planning Services' satisfaction: yr. The applicant shall address the requirements (concerns) of the Weld County Paramedic Services, as stated in the referral response received November 14, 2006. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. (Department of Planning Services) The applicant shall submit a dust abatement plan for review and approval to the Environmental Health Services, Weld County Department of Public Health & Environment. Evidence of their approval shall be submitted to the Weld County Department of Planning Services. (Department of Public Health and Environment) The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application for the Vinyl Paint Shop from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment. Alternately, the applicant can provide evidence that they are not subject to these requirements. Evidence of Weld County Department of Public Health and Environment approval shall be submitted to the Weld County Department of Planning Services. (Department of Public Health and Environment) The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. Evidence of their approval shall be submitted to the Weld County Department of Planning Services. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). (Department of Public Health and Environment) The applicant shall submit to the Weld County Department of Planning Services one of the following for the two accesses on the east side of the site: 1) A recorded copy of any agreement signed by all of the owners of the property crossed by the access. The access shall be for ingress and egress and shall be referenced on the plat by the Weld County Clerk and Recorders reception number. 2) Evidence that the access is dedicated as right-of-way by Weld County. (Department of Planning Services and Public Works) �✓ The applicant shall provide to the Weld County Department of Planning Services a copy of the access permit issued by the City of Brighton which grants access to County Road 2, or written evidence that the applicant has complied with the requirements of the City of Brighton. (Department of Planning Services) SPR-402 WPD, LLC Page 2 The existing office and the proposed office located north of County Road 2 shall adhere to the 25 foot setback requirement per Section 23-3-250.A.4.a of the Weld County Code. Evidence of such shall be submitted to the Weld County Department of Planning Services. (Department of Planning Services) The applicant shall complete and submit the appropriate zoning and building permit applications and pay the appropriate fees to the Weld County Department of Planning Services for the mobile home located on the property. (Department of Planning Services) The application shall submit a Landscape / Screening Plan in accordance with Section 23-3-250.A.5, delineating the following information: 1. An installation schedule which specifies when the landscaping will be installed on site. (Department of Planning Services) 2. No more than eighty-five percent (85%) of the total area of a lot in any Commercial Zone District shall be covered. Land shall not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably landscaped. (Department of Planning Services) 3. That portion of a lot in any Commercial Zone District which abuts a public or private street right-of-way shall be landscaped for a distance of ten (10)feet, measured at a right angle from the lot line towards the interior of the lot. Sidewalks and driveways may pass through the required landscaped areas. (Department of Planning Services) 4. Uses in Commercial Zone Districts involving outdoor storage of vehicles, equipment, or materials when permitted shall be screened from public rights of- way and all adjacent properties. (Department of Planning Services) 5. A landscape maintenance schedule which specifically states who will perform the maintenance on site and that maintenance is on-going and shall not end upon final acceptance by the Department of Planning Services. (Department of Planning Services) 6. The landscape / Screening Plan shall address Section 23-3-250.B.7 of the Weld County Code regarding property maintenance. (Department of Planning Services) K. The applicant shall submit a Private Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all landscaping, transportation (access drive, parking areas, etcetera) and non-transportation (plant materials, fencing, screening, water, signage etcetera). The applicant shall submit to the Department of Planning Services an itemized landscaping bid for review. The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the Site Plan Review plat, or the applicant may submit evidence that all the work has been completed and approved by the Department of Planning Services and the Department of Public Works. The vicinity map shall be delineated on the plat in compliance with Section 23-2- % 160.V.6 of the Weld County Code, specifically illustrating the parcel and surrounding parcels. (Department of Planning Services) , " The approved Landscaping /Screening Plan. (Department of Planning Services) The sight distance triangles shall be delineated on the plat. Any existing landscaping within the sight distance triangles shall be removed and relocated. (Department of Public Works) 6!/ The applicant shall provide at a minimum thirty-four (34) parking stalls for this facility, of which two (2) must meet the requirements of the Americans with Disabilities Act. The dimensions of the parking stalls shall adhere to Section 23- 4-30 and Appendix 23-A of the Weld County Code. This site will be required to meet all requirements of the Americans with Disability Act (ADA). ADA parking spaces are twenty (20) feet by eight (8) feet with five (5) foot aisles. A minimum of one space must be van accessible with an eight (8) foot aisle. An accessible path shall be required from the building to the public right-of-way. Furthermore, the ramps from the parking area shall identify a landing area for non-ambulatory users of this facility. (Department of Planning Services) The applicant shall delineate the location of curb stops in the parking areas per Section 23-4-30.D of the Weld County Code. (Department of Planning Services) The applicant shall show the type of lighting that will be used on site in conformance with the Weld County Code. (Department of Planning Services) 9� The location and dimensions of any proposed signs per Article IV Division 2 of `"""��` the Weld County Code. (Department of Planning Services) yv. Section 23-3-250.A.6 of the Weld County Code addresses the issue of trash collection areas. Areas used for storage or trash collection shall be screened from adjacent public rights-of-way and adjacent properties. These areas shall be designed and used in a manner that will prevent wind or animal scattered trash. (Department of Planning Services) yf. The applicant shall remove the word temporary from the proposed office building. (Department of Planning Services) The following notes shall be placed on the plat: 1. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 2. In the event that a portion of the building is proposed to be leased or sold to another party in the future, the applicant shall submit a copy of the lease of sales agreement and information regarding the proposed use of the leased portion to the Weld County Building Inspection Department, Mc View Fire Protection District, and the Department of Planning Services r review. Based upon the Gaxwt, ga,SA-hnl SPR-402 WPD, LLC Page 4 proposed use and/or impacts of the leased portion, the Department of Planning Services may require a new Site Plan Review application. (Department of Planning Services) 3. In accordance with the Weld County Code, no land, building or structure shall be changed in use or type of occupancy, developed, erected, constructed, reconstructed, moved or structurally altered or operated in the Commercial and Industrial Zone District until a Site Plan Review has been approved by the Department of Planning Services. (Department of Planning Services) 4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100, C.R.S., as amended), shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health and Environment) 5. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,C.R.S., as amended. (Department of Public Health and Environment) 6. Waste materials shall be handled, stored and disposed of in a manner that controls fugitive dust, blowing debris and other potential nuisance conditions. (Department of Public Health and Environment) 7. The applicant shall operate in accordance with the approved "waste handling plan." (Department of Public Health and Environment) 8. The facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone District, as delineated in 25-12-103, Colorado Revised Statutes. (Department of Public Health and Environment) 9. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. (Department of Public Health and Environment) 10. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. (A Septic system application has been obtained by the applicant- SP-0600344). (Department of Public Health and Environment) 11. Adequate hand washing and toilet facilities shall be provided for employees and patrons of the facility. (Department of Public Health and Environment) 12. The facility shall utilize the existing public water supply. (City of Brighton) (Department of Public Health and Environment) 13. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health and Environment, Water Quality Control Division. (Department of Public Health and Environment) 14. The operation/property shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. (Department of Public Health and Environment) 15. A building permit application must be completed, and two complete sets of engineered plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. The new construction and/or change of use shall conform to the requirements of the 2003 International Building Code, the 2005 National Electrical Code and Chapter 29 of the Weld County Code. (Department of Building Inspection) 18. Setback and offset distance shall be determined by the 2003 International Building Code and Chapter 23 of the Weld County Code, (Offset and setback distances are measured from the farthest projection from the structure). Prior to the release of building permit, the applicant shall submit evidence of approval from the Brighton Fire Protection District to the Weld County Building Department. (Department of Building Inspection) 20. Landscaping materials as indicated in the approved Landscape / Screening Plan shall be maintained at all times. Dead or diseased plant materials shall be replaced with materials of similar quantity and quality at the earliest possible time. (Department of Planning Services) 21. Lighting shall comply with the requirements and standards for off-street parking spaces per Section 23-4-30.E, Section 23-2-250.D and Section 23-3-250.B.6 of the Weld County Code. (Department of Planning Services) 22. All structures, including signs, on site must obtain the appropriate building permits. (Department of Planning Services) 23. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program. Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. The property owner shall allow any mineral owner the right of ingress or egress for the purposes of exploration, development, completion, recompletion, re-entry, production and maintenance operations associated with existing or future operations located on these lands. (Department of Planning Services) 2. Prior to issuance of the Certificate of Occupancy: A. The applicant plans to abandon the existing septic system and replace with a new septic system for the existing building, modular office and proposed modular office. The applicant shall abandon the existing septic system according to Weld County Code 30-7- 70 requirements. (Department of Public Health and Environment) B. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. A stormwater discharge permit may be required for a development / redevelopment / construction site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. The contractor Don Kutz is working with the various subcontractors in completing the utility connections and Dennis Renley from the Building Department is allowing Leed to move-in with a temporary approval until the ADA ramp is built and inspected. Bruce Barker has approved the Letter of Credit with minor changes. Wells Fargo Bank and Pat Daniel are completing the document. I will email a scanned image of the completed letter prior to mailing the original to your office. I believe with this, we have completed the requirements you listed -to be able to get the necessary extension on the Violation Hearing set for March 11. I am including a construction schedule for the moving of the existing modular office at the Leed Site. All underground utilities have been installed, inspected and approved, we are waiting on the companies responsible for the actual moving of the structures to come in on March 5-7. The Transportation Road Impact Fee, as sent by Tom Honn has been paid for in the amount of$5,248.00. See attached copy of receipt. The permit has been submitted for the Cover-all building. All engineering reports have been included and we are waiting for a final review from the Building Department. We have the Letter of Credit for the improvements being processed. I will forward it for your approval as soon as it is complete. I need to know if you are still requiring a violation hearing next week or if our continued commitment to resolve the outstanding issues have been sufficient for you to postpone? The proposed letter does not follow the county specimen but the applicant believes it meets the intent of the specimen. On a side note this case is scheduled to go before the BOCC at the March 11, 2008 violation hearings so any input before then would be greatly appreciated. Thanks for all your help. Always, my understanding and intent was to meet the site plan issues first, while moving the office modular and resolving the Cover-all building violation second. I did get a call from Maureen in the Building Department - the permit that we submitted in September of last year, to move the existing modular office, has been approved and released - Thank-you! As we discussed, this is a tight timeline - attempting to meet the criteria of moving the existing- occupied office and getting the unresolved building violations resolved. All this, BEFORE the site plan can recorded and the violation hearing March 11 cancelled. As you have requested, we are now getting schedules of construction, times allotted for field inspections and shutdown and restart of the existing office facilities. Once we record the plat, the building will be moved?!) 02/08/2008 • • Page 3 of 5 • Finalize improvements agreement (You have the final estimates and agreement, we are in the process now of creating a Letter of Credit for the benefit of Weld County. • Address the Department of Public Works concerns regarding the frontage road (Parallel access next to CR 2 will be blocked this week) I have reviewed the PDF of the plat and as I stated in our previous meeting the applicant can either keep the buildings on the plat as show in draft#3 or show a building envelope on the plat but not both. It's not necessary for both to be shown therefore please revise the plat to show one or the other. (Thanks! this is the first time I've been aware of this review and comment) The improvements agreement that you sent today will need to be reviewed the Department of Public Works and the Department of Planning Services once we have finished our review (in approximately a week) I will let you know so that you can submit the collateral and I will schedule a hearing with the BOCC for acceptance of the collateral. (Wells Fargo Bank is working to have the final documents ready as soon as we get approvals) The Weld County Department of Planning Services wrote staff comments in December 2006 with a list of conditions since then those conditions still have not been fully addressed. Because of the amount of time it has taken the applicant to record the plat (Section 23-2-160.W of the Weld County Code) the case was forward to zoning compliance. The Weld County Zoning compliance Officer Bethany Salzman wrote the applicant a letter dated 12/5/07 indicating that they had until 2/5/08 to finish the last remaining conditions. The violation hearing is scheduled for March 11, 2008 if the above conditions have been met before that time the violation hearing will be canceled and the case closed. (I could continually go over the challenges this project has encountered, but the fact is, Pat Daniel is intent on getting this done, expeditiously. We must know what is required to stop this violation hearing since the previous submittals were evidently not adequate to delay this action or communication broke down so that responses were lost or not received.) While there is approximately a month before the violation hearing please be advised that all the above conditions need to be complete and the plat recorded in order to correct the violation. I would be more then happy to set up a meeting with you and the applicant to once again go over these conditions just let me know when you are available. (I appreciate you wanting to compress the timeline, but there are many factors out of our control in attempting to meet all of the criteria you've laid out, prior to the hearing date. Now that we know the plat is accepted, we'll provide the Mylar plat for recording along with the Improvement Agreement - BUT to have the outstanding building violation resolved and the modular building relocated, is beyond scheduling possibilities with the conditions we must meet. In fact, I have emails sent on 12/17/07, 1/2/08, 1/29/08, asking specific questions or sending additional information to Michelle (with no email response), then another 1-day before this letter was written, on 2/4/08 to you both, again with no acknowledgment. To reiterate, the owner of the property, WPD, LLC and its Manager - Pat Daniel have taken over this project from Leed - so any correspondence should be to him and/or me as representative for this project. This information was emailed on December 17, 2007 and should be noted in the file. I have sent PDF documents on the final site plan and notes - per Michele - for her final approval on January 29, 2008. I am waiting for her approval prior to creating Mylars for recording. As Michelle and I have discussed on multiple times, this project is very close, but it has many facets that had to be incorporated into the overall project approval, ZPMH permits, Commercial Building Permits, Septic and a recent Building Permit Violation, not to mention the various people previously making decisions for Leed/WPD. All of these have been or are being completed and we are now on the final stretch to meeting County criteria. We now have revised bids from contractors on the proposed improvements and will have a completed improvement agreement for Michelle's review this week. I would request that any staff that is directly associated with this project be included in our discussion -either by email or personally on Wednesday. Part of the challenge is reconstructing the discussions and agreements that have transpired over the past year. You have stated in our phone conversation that it was my responsibility to get the letters of approval from each department. In talking briefly with David Snider from Public Works - he stated that any information that is accepted by his department would have to come directly from you and the Planning Department and kept with the SPR application file. This again makes it very difficult for me to control the transfer of information or even help with reconstruction of data that has transferred during these months of discussion/negotiation if his understanding of the process is accurate. If so, it appears that you and the Planning Department still controls the transfer of information for the approvals and we will need your help in getting this accomplished. Still wanting to create a more professional view from CR 2, it has been decided to utilize wrought-iron fencing and landscaping to screen this parking area. The other change that came from staff comments is the area utilized for product display. Historically the western edge of the property was where finished product was viewed from U.S. Hwy 85. Because of the requirement to be along a public R.O.W., it is now relocated along CR 2 and the easterly property boundary as shown on the revised site plan. All previous comments have been addressed, notes revised/corrected and site plan adjusted per previous redline comments. Please be aware that parking and landscaping is shown in the future R.O.W. area, but we have created additional parking north of the modular buildings, just in case the R.O.W. development necessitates the removal of these improvements. Also, enclosed you will find a revised improvement agreement that reflects the added landscaping. Comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Comments ❑ The external roadways are capable of handling anticipated traffic from the proposed facility. ❑ The site is located north and adjacent to WCR 2 (168th ave.) which is under the jurisdiction and maintenance of the City of Brighton. REQUIREMENTS: Access: The site shall be accessed from the existing private drive bordering the east side of the property. The applicant shall identify this private access drive as an ingress/egress easement for the mutual benefit of the lots adjacent to the drive (parcel numbers 147131000069 and 147131000096). This shall be an established easement documented and shown on the final plat. The ingress/egress easement must be documented by the County Clerk and Recorder and the recordation placed on the Site Plan Map. The second access identified at the south property line shall be coordinated with the City of Brighton. If Brighton does not permit access from this location it shall be abandoned and permanently fenced. The "frontage road" south of the property poses multiple safety hazards with several access points and shall be eliminated by the applicant. All mail to the site should be delivered to a location at the private drive access. The final determination can be coordinated with the postmaster and planning staff. Parking: All parking for the site must be off street and internal. The applicant shall identify and separate employee and visitor parking spaces. Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or planting. ADA requirements shall be met for this site. Parking Lots shall conform to all standards of the Americans with Disabilities Act. Public Works recommends striping of the parking to identify the ADA space(s)with the appropriate symbols and signs. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 2 S 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 6.
