HomeMy WebLinkAbout20061018.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0400345 AGAINST LOUIS PEREZ FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Louis Perez, VI #0400345, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of April, 2006, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Louis Perez was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. CASE HISTORY March 23, 2004 Initial complaint received. September 28, 2005 Initial inspection completed. September 29, 2005 Five day compliance Dncouragement letter issued. October 12, 2005 Violation letter issued,; October 25, 2005 Rose Perez, wife of the property owner called. They were considering a change of zone and had agreed to come in and speak with a planner. October 26, 2005 Mr. & Mrs. Perez met with Planner Chris Gathman. They were then going to look into being annexed into the town of LaSalle. 2006-1018 January 17, 2006 I called property owners for an update. Then they were transferred to speak with Planner Sheri Lockman. January 18, 2006 Violation letter re-issued. February 14, 2006 Office visit with Planner Sheri Lockman. They had a meeting set up with the town of LaSalle to possibly be annexed. February 28, 2006 Mr. Perez called and said that at this time he felt he would just rather clean up the property. March 27, 2006 Letter sent to property owner indicating that the violation case was scheduled before the Board of County Commissioners. NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand materials are stored or handled, including but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials and bottles. A COMMERCIAL JUNKYARD may also include the storage or keeping of DERELICT VEHICLES registered under the property owner and/or tenant's name. This definition does not include COMMERCIAL VEHICLES. If the Zone district allows,the NONCOMMERCIAL JUNKYARD shall be totally enclosed within a building or structure or visually SCREENED from all adjacent properties and public rights-of-way.
