RE : ACCEPT PETITION AND AUTHORIZE VACATION of A PORTION OF RIGHT-OF-WAY
OF FORMER WELD COUNTY ROAD 62 .2 AND RESERVE EASEMENTS FOR
UTILITIES AND ACCESS TO ADJACENT PROPERTIES AND THE NO. 3 DITCH
WHEREAS, the Board of County Commissioners of Weld County, Colorado , pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado , and
WHEREAS , on June 1 ! 2005, the Board of County Commissioners accepted a Warranty
Deed for Poudre River Trail property from Mary Jane Duran- Blietz on a location adjacent to the
Poudre River in the SE1 /4NWI /4 and the NEI /4SW1 /4 of Section 33, Township 6 North , Range 66
West of the 6th P. M . , Weld County, Colorado , and
WHEREAS , the acceptance of such property obviated the need for locating the Poudre River
Trail on the former roadway of Weld County Road (WCR ) 62 . 2, extending easterly from its
intersection with WCR 29 , to the north-south centerline of Section 33 , Township 6 North , Range 66
West of the 6th P . M , , Weld County, Colorado, being more fully described in the attached Exhibit "A, "
and
WHEREAS , said portion of WCR 62 . 2 is not needed for the safety and welfare of the
traveling public; however, easements for utilities , and access to adjacent properties and the No . 3
Ditch , are necessary, and are more fully described in the attached Exhibit " B, " and
WHEREAS, the Weld County Department of Public Works has presented the Board with
a petition for the vacation of said portion of WCR 62 . 2 , reserving those easements described in the
attached Exhibit " B , " and
WHEREAS, the adjoining landowners were mailed ten days notice of a public hearing set
fortune 12 , 2006 , to consider the vacation of that portion of Weld County Road right-of-way which
is described above , and
WHEREAS , the Board of County Commissioners heard testimony and reviewed all other
evidence presented therein by staff and the public , and
WHEREAS , the evidence showed that the vacation of that portion of WCR 62 . 2 and
reservation of the easements described in Exhibit "B" will not leave any land adjoining the roadway
without an established public road or private access easement connecting the land with another
established public road , and
WHEREAS, at the public hearing on June 12 , 2006 , the Board of County Commissioners
deemed it advisable to vacate said portion of WCR 62 . 2 , with said vacation to become effective
upon recording as required below, reserving those easements described in the attached Exhibit " B ."

NOW, THEREFORE , BE IT RESOLVED by the Board of county commissioners of Weld
County, Colorado , that the portion of WCR 62 . 2 extending easterly from its intersection with
WCR 29 , to the north-south center line of Section 33 , Township 6 North , Range 66 West of the 6th
P . M . , Weld County, Colorado, being more fully described in the attached Exhibit "A", be, and hereby
is vacated .
BE IT FURTHER RESOLVED by the Board that those easements described in the
attached Exhibit " B1" be , and hereby are , reserved by the Board for current and future use .
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be , and hereby is ,
directed to record this Resolution in the records of the Weld County Clerk and Recorder.
The above and foregoing Resolution was , on motion duly made and seconded , adopted by
the following vote on the 12th day of June , A. D . , 2006 .

way described in the attached Exhibit "A" for the former Weld County Road 62 .2 be declared
abandoned and vacated by Weld County, reserving, however, those easements set forth in the
attached Exhibit "B ."

Existing utilities within the right-of-way or holding a recorded interest to use or cross this
right-of-way, may include, but are not limited to, oil and gas pipelines, sewer, gas, water, or
similar pipelines and appurtenances, ditches or canals and appurtenances, and electric, telephone,
and similar lines and appurtenances .
As support for this petition, Petitioners state that the majority of the right-of-way has not
been maintained by Weld County since the early ! 980's, and that no part is within a City or Town
or a County, other than the County of Weld; that no portion of the right-of-way is shown as part
of an approved or recorded subdivision plat, map, or unincorporated community legally filed
prior to any regulations controlling subdivisions; that the right-of-way is not used by the public;
that vacation of the right-of-way will not leave any land adjoining said roadway without an
established public road or private-access easement connecting said land with another established
public road.
