Subject: USR-1523 Referral
Upon review of my case files and computer, an open Violation (VI-0500176)was noted. The Violation was
initiated due to the operation of a"bird kennel"and storage of commercial equipment without the necessary
permits. Legal counsel determined these types of game birds to be classified as"Household Pets"as defined
in the Weld County Code. This violation has not yet been presented to the Board of County Commissioners
through the Violation Hearing process. Please be advised that I have received complaints from at least 2
surrounding property owners.
This Use by Special Review application, if approved, will bring the property into compliance. If denied, the
number of birds will be reduced not to exceed 4(four)per legal lot and all commercial equipment and storage
shall be removed; otherwise, the Violation case will proceed accordingly.

Re: USR-1523
This project lies above the irrigation ditch owned by the New Coal Ridge
Ditch Company, which is an extension of the ditch owned by the New
Consolidated Lower Boulder Reservoir and Ditch Company. This response is
made on behalf of both companies.
From the materials enclosed with the Referral, and personal inspection, it
appears that the building envelope lies outside the Companies' easement, the
fenced pens may encroach upon the easement, in particular our"off-side" service
road. From time to time, we must use that road for heavy equipment to service
and maintain the ditch. Because our easement is very old (circa the 1870's) and
of a prescriptive nature it is likely not recorded. There is likely a recorded
easement in favor of the Northern Colorado Water Conservancy District dated in
the mid 1950's. However, NCWCD's recorded easement is not necessarily
identical in dimension with our prescriptive easement. Frequently developers,
and others, mistakenly assume that the NCWCD recorded easement is the only
easement they need be concerned with.
In the present case we are concerned that the applicant (or the County)
not assume that the fenced pens are outside our easement. We would be happy
to meet on-site with you and the applicant, if this would be of help.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 18 has been annexed by the Town of Frederick. They have over jurisdiction over all accesses to their
system. Please contact the Town to verify the access or for any additional requirements that may be
necessary to upgrade the access point.
WCR 16.75 aka Dream Acres is a local gravel subdivision road. This road is maintained by Weld County.
parcel is split by the South Platte Canal. The application consists of three parcel.
REQUIREMENTS:
Access: Utilize both existing accesses to the properties. The home access is located is from WCR 18, and
the business access is from WCR 16.75.
Storm Water Drainage:
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.

Environmental Health Services has reviewed this proposal for a 4000 game birds and a
home business-storage of concrete forming equipment . We have no objections to the
proposal, however, we do recommend that the following conditions be part of any
approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
:1 The applicant shall submit a waste and manure handling plan, for approval, to
/ the Environmental Health Services Division of the Weld County Department of
Public Health & Environment. The plan shall include at a minimum, the
following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to operation:
A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. The
applicant shall inquire with the Water Quality Control Division (WQCD) of the
Colorado Department of Public Health and Environment at
www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater
discharge permit. Alternately, the applicant can provide evidence from WQCD that
they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan".
6. The facility shall be operated in a manner to control flies.
7. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
8. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
9. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
10.Adequate toilet and handwashing facilities shall be provided. The toilet facilities
located in the residence shall be used.

11.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
12.The facility shall utilize the existing public water supply. (Central Weld County
Water District)
1IIf applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
14.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Jacqueline,
Please change my development standard #1 second sentence to read:
"Such wastes shall be removed at the end of each brood. The brood shed wastes will be disposed of by
spreading on the applicant's pasture grass. Dead birds shall be removed daily and disposed of by a commmercial
hauler at least weekly."

Hello
