RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600223
AGAINST EDWARD AND CAROL HERSON, DBA EDCOM FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Edward and Carol Herson, dba EdCom,VI#0600223, are allegedly in violation
of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of September, 2006, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Edward Herson, property owner, was present at said hearing, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Edward and Carol Herson, dba EdCom to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties.

Currently the property is in violation of Chapter 23, Article 111(3), Division 1 of Sections 23-3-20, 23-3-30,
23-3-30.D, 23-3-40 and 23-3-40.R and Chapter 23,Article IV(4), Division 2 of Sections 23-4-70.B,

REMEDY
To bring the property into compliance the following shall occur:

RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

Dear Mr. & Mrs. Herson:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on September 12,2006,at 10:00 a.m.,to consider
the violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article Ill, Div 1 "A(Agricultural) Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.D "Home Occupations."
Section 23-3-40 "Uses by special review."
Section 23-3-40.R "Any use permitted as a Use by Right, an Accessory Use, or a Use
by Special Review in the Commercial or Industrial Zone Districts, provided that the
property is not a Lot in an approved or recorded subdivision plat or lots parts of a map or
plan filed prior to adoption of any regulations controlling subdivisions. PUD development
proposals shall not be permitted to use the special review permit process to develop."
Chapter 23, Article IV(4), Division 2 "Signs."
Section 23-4-70.8 "No sign shall be erected at or near the intersection of any road or
driveway in such a manner as to obstruct free and clear vision of motorists, or at any
location where, by reason of the position, shape or color, it may interfere with, obstruct
the view of, or be confused with, any authorized traffic sign, signal or device. Signs
located at an intersection must be outside of the sight distance triangle. Signs which
could potentially affect vehicle traffic shall be reviewed by the Department of Public
Works and the Colorado Department of Transportation, if applicable."
Section 23-4-70.C "No sign other than traffic control signs,except as expressly allowed
by Colorado Revised Statutes and/or permitted by the Colorado Department of
Transportation, shall be erected, constructed, or maintained within, over, or upon the
right-of-way of any county, state or federal road or highway within the County."
Appendix 23-C "Beacons, Roof Signs, Pennants, inflatable,tethered balloons, Portable
Signs and strings of light bulbs used for commercial purposes other than traditional
holiday decorations are not allowed in any zone district."

To bring the property into compliance:
In the Agriculture Zone District, you are allowed 1 (one) 16 sq ft sign; however, during
my inspections, I have noted several smaller(satellite)signs, 1 large sign on a movable
trailer(otherwise known as a PORTABLE SIGN), several satellites connected to a shed
with additional COMMERCIAL MESSAGES and 1 large sign secured to the ground.
Furthermore, the presence of a sign requires at a minimum, a building permit (see
definitions listed below).
COMMERCIAL-MESSAGE: Any sign wording, logo or other representation that,directly
or indirectly names, advertises or calls attention to a business, product, service or other
commercial activity.
PORTABLE SIGN: Any sign not permanently attached to the ground or other permanent
structure, or a sign designed to be transported, including, but not limited to, signs
designed to be transported by means of wheels; signs converted to A- or T-frames;
menu and sandwich board signs; balloons used as signs; umbrellas used as advertising;
and signs attached to or painted on vehicles parked and visible from the public right-of-
way, unless said vehicle is used regularly and customarily in the normal day-to-day
operations of the business.
In order to operate a commercial business"EdCom"from your property address,a Home
Occupation permit is necessary. Completion of this paperwork would allow you to
continue to advertise your home address and/or phone number.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary
to correct the violation, and that you were given sufficient time to remedy this violation. If you have any
questions concerning this matter, please call me.

The presence of an office or'hub'for your business"EdCom"at your residence necessitates
at a minimum a Home Occupation permit. For your convenience, I have enclosed the
application. The planners would be able to assist you with any questions regarding this
application as well.
Furthermore, the Weld County Code allows a property owner (in the Agricultural Zone
District) 1 (one)sign not to exceed 16 sq ft in size. In order to exceed the maximum nu rnber
of sign(s), a Use by Special Review permit is necessary. For questions, I suggest you speak
to one of our"On-Call"Planners. To better serve the public,we have 2 locations open. Our
North office is located at 918 10th Street, Greeley,Colorado. At our North office,an"On-Call"
Planner is available, Monday thru Thursday from 7:30 a.m. - 11:30 a.m. Our Southwest
office is located at 4209 CR 24.5, Longmont,Colorado. At our Southwest office,an"On-Call"
Planner is available Monday thru Thursday from 12:30 p.m.-4:30 p.m. You do not need to
schedule an appointment, because individuals are seen on a sign in basis. Neither office will
have a planner available on Fridays for walk-ins. To better serve you, please bring this
letter with you.
The Weld County Code does not make provisions for movable signs (such as on trailers)or
for signs when situated within the road right-of-way. If you are aware of other signs which
potentially violate the Weld County Code, please feel free to make a complaint.
COMMERCIAL MESSAGE: Ant sign wording, logo, or other representation that, directly or
indirectly, names, advertises or calls attention to a business, product, service or other
commercial activity.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from
June 19,2006,to correct this zoning violation. Failure to do so will result in this office scheduling the violation
before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's
Office for legal action.

Furthermore, I noticed several signs, of which, most are not considered to be legal signs. For example, the
Weld County Code does not allow signs on movable structures (i.e. the truck bed/trailer). Additionally, all of
the satellite dishes are not approved signs. The Weld County Code would allow 1 (one) 16 square foot sign
with a building permit.
