RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0600278
AGAINSTJANET PRESLEY AND WILLIAM AND LAURA REYNOLDS FOR VIOLATION
OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Janet Presley and William and Laura Reynolds,VI #0600278, are allegedly in
violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of September, 2006, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Janet Presley and William and Laura Reynolds were not present or
represented at said hearing, although all parties were notified of said hearing by Department of
Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Janet Presley and William and Laura Reynolds to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties.

REMEDY
To bring the property into compliance, the permit for the manufactured home shall have all inspections
completed. The existing mobile home shall be removed from the property prior to a certificate of occupancy
being issued.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney for
immediate action as there have been no inspections since July 14, 2006.
CASE HISTORY
May 22, 2006 Letter to remind permit will expire on June 19, 2006.
June 21, 2006 30-day violation letter issued
August 8, 2006 10-day letter to remove existing mobile home and complete the building permit for
the manufactured home.
August 23, 2006 Certified letter mailed indicating the violation case is scheduled before the Board of
County Commissioners.
September 6, 2006 Phone call to Mr. and Mrs. Reynolds. I left a message advising of the date and time
of the violation hearing. He returned my call and stated he had received a TCO that
is valid until September 13, 2006. He will fax me a copy of that as we have no
record of a TCO being issued.

The property referenced above remains in violation of the Weld County Code. I have scheduled a meeting
with the Board of County Commissioners on September 12,2006,at 10:00 a.m., to consider the violations.
The property is in violation of the following Section of the Weld County Code:
Chapter 29,Article Ill "Building Permits"
Section 29-3-290 "Manufactured home certificate of occupancy."
To bring your property into compliance:
The permit for the manufactured home shall have all inspections completed and a
certificate of occupancy issued. The existing mobile home shall be removed from the
property.
This meeting will take place at the Weld County Planning Department Office, 918 10th Street, Greeley,
Colorado. It is recommended that you or a representative be in attendance at this meeting to answer any
questions the Board of County Commissioners might have regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation,the action necessary to correct the violation,and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please

Dear Ms. Presley:
I have previously contacted you regarding the building permit for a manufactured home at 7522 County Road
31. That permit is currently in violation as the expiration date was June 19, 2006; however, a certificate of
occupancy cannot be issued until the existing mobile home has been removed from the property. Permit
number BCS-060312 for an uncovered deck was issued on July 28, 2006, and that permit will expire on
January 29, 2007.
To resolve this issued, all inspections must be completed on permit number PRS-053091 and the existing
mobile home removed within 10 days from the date of this letter. Failure to do so will result in a meeting being
scheduled with the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's Office for legal action.

This notice is to remind you that the above noted permit for a manufactured home at 7522 County Road 3lwill
expire on June 19, 2006, and all required inspections have not been completed. Section 29-7-130 of the
Weld County Code states that a certificate of occupancy shall be obtained on all mobile, manufactured, or
factory-built homes no later than one hundred eighty(180)days after the permit is issued. In the event the
certificate of occupancy is not issued by the expiration date, a meeting may be scheduled with the Board of
County Commissioners to review the violation. The Board will determine if an extension is warranted or if the
case should be referred to the County Attorney for legal action.
