This application has been prepared by established guidelines found in the Weld County Code,Section 23-2- 260,Use by Special Review Application Requirements,and the most current Weld County Procedural Guide for a Use by Special Review Application as found on the Weld County Web Site. 1. Explain, in detail, the proposed use of the property. The proposed use of the site will remain consistent with the Agricultural Zone District and surrounding property uses. Pre-manufactured office building(s)will be moved to this site as a field office for Petro-Canada's LaSalle field personnel. The intended use of the property as an Oil and Gas Support and Service operation as defined in the Weld County Code Section 23-1-90. This use is a Use by Special Review in the Agricultural Zone District(23-3-40.A.2)and shall also adhere to the definition of"Oil and Gas Support and Service" found in Section 23-1-90 of the Weld County Code. The desired use of the property is for an office for field personnel, storage, and additional parking of vehicles associated with the office use. The location of these uses are illustrated on attached plats. The applicant respectfully requests a simultaneous Building Inspection plans examination and building permit issuance pending approval and plat recording of this application. The applicant respectfully requests this review also include the review and permit for the use of manufactured structures per the provisions of Section 23-4-130 of the Weld County Code,if applicable,by current County standards. Approximately twenty (20) field personnel will access the site in the morning,park their personal cars on site, leave the site in a company vehicle and return at the end of the day to retrieve their personal car, leaving the company vehicle on site. Two (2) personnel will remain as staff at the office. The area surrounding the office and personnel parking will be fenced with a 6-foot chain link fence. 2. Explain how this proposal is consistent with the intent of the Weld County Code,Chapter 22 (Comprehensive Plan). This Use by Special Review application has been prepared utilizing the process outlined in the Weld County Code and Procedural Guides. The Guiding Principles of the Comprehensive Plan found in Section 22-1-120 states,"Land use changes must afford flexibility based on the specific location and the particular circumstances encountered within this locality. It is also important to weight the cumulative impacts that specific land use changes will have." This proposal is respectful of the surrounding uses and meets a need for Petro-Canada Resources(USA)Inc.to locate a field office in the LaSalle vicinity. The impact to surrounding properties is anticipated to be minimal as the office will be accessed by approximately twenty staff members. The uses proposed will be compatible with the future development of the surrounding area as permitted by the existing zone district and with future development as projected by Chapter 22 of this Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The operations conducted on site are confined to the enclosed area and building. Most activities occur on contract jobsites. • The property is not located within the I-25 Mixed Use Development area. • The property is not located within an Intergovernmental Agreement Boundary or standard Urban Growth Boundary. • The site is located within the Greeley—Weld Airport Authority overlay district. The applicant has made contact with the Greeley-Weld Airport Authority. Mr. Michael Reisman indicated the location does not warrant an Avigation Easement or other agreement. • Surrounding land uses include agricultural uses including the following Special Use Permits: existing Oil and Gas Support and Service operations, a Confined Animal Feeding Operation, a 4,000-head Dairy, Private Air Strip, Roping Arena, and a turf farm. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. This application has been filed in accordance with Article 2,Division 4,Chapter 23 of the Weld County Code, starting with Section 23-2-200. Application materials submitted comply with Article V of Chapter 23 of the Weld County Code (Overlay Districts). • The property is not located within the I-25 Mixed Use Development area. • The property is not located within an Intergovernmental Agreement Boundary or standard Urban Growth Boundary. • Use by Special Review Design Standards as found in Section 23-2-240 of the Weld County Code were consulted in preparing this application. The site is located within the Greeley — Weld Airport Authority overlay district. As stated previously, no agreement or easement documents are required per Mr. Reisman. The intended use of the property is for an Oil and Gas Support and Service operation as defined in the Weld County Code Section 23-1-90. This use is an Use by Special Review in the Agricultural Zone District (23-3-40.A.2) and shall also adhere to the definition of"Oil and Gas Support and Service"found in Section 23-1-90 of the Weld County Code. The end use shall include an office for field personnel(pre-manufactured), storage, and additional parking of vehicles associated with the office use. The plat includes a storage area to be used for the storage of new and used miscellaneous equipment such as pipe, tanks, separators, etc. Adequate provision has been made to protect the health, safety and welfare of the inhabitants of the neighborhood and the County. Operation Standards as found in Section 23-2-260 of the Weld County Code were consulted in preparing this application as stated previously in application materials. Conditions of Approval and Development Standards will ensure the proposed use upholds the purpose and intent of the Weld County Code, Chapter 23 as listed in Section 23-1-40. Such Conditions of Approval and Development Standards as found in the Weld County Code, Referral Agency responses and Staff Comments shall be considered and appropriately incorporated into the final use and site design. n 4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. Surrounding land uses include agricultural and Special Review uses as stated previously. The proposal is consistent and compatible with the existing and future land uses, including a similar use on property located adjacent and west of this site as well as USR-1517 located north and adjacent to the site on the same legal parcel. These two Use by Special Review permits are contiguous on one legal parcel. Each does not create a separate legal lot,just separate uses covered by separate Special Use Permit applications. 5. Describe, in detail,the following: a. How many people will use this site b. How many employees are proposed to be employed at this site? c. What are the hours of operation? Twenty(20)people with utilize this site for short periods of time during the early morning and at the end of a regular business day(5 p.m.). One to Two (1 to 2)persons will occupy the building during regular business hours of 8 a.m.to 5 p.m. Employees may access the site on an as-needed basis before 8 a.m. and after 5 p.m. d. What type and how many structures will be erected (built)on this site? The only new building to be located at this site will be the pre-manufactured office building(s). Parking will be placed around the building as illustrated on the attached plans. A six(6) foot fence will be placed around the building and parking area. e. What type and how many animals, if any,will be on this site? This is not applicable. f. What kind (type,size,weight) of vehicles will access this site and how often? There will be nineteen' -ton pick-up trucks at the location for a short period of time in the early morning. A 4WD %ton SUV will also be on site during regular business hours. g. Who will provide fire protection to the site? The Kersey Fire Protection District. h. What is the water source on the property? Central Weld County Water District. Please see attached letter. i. What is the sewage disposal system on the property? An engineered septic system will be utilized on this location. Design specifications have been included for review and approval by the Weld County Department of Public Health and Environment as part of the applicant's respectful request for a simultaneous Building Inspection plans examination,building permit,and septic permit issuance pending approval and plat recording of this application. Please see letter from Northern Colorado Geotech, Doug Leafgren, P.G., attached. j. If storage or warehousing is proposed,what type of items will be stored? The plat includes a storage area to be used for the storage of new and used miscellaneous equipment such as pipe, tanks, separators, etc. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. Landscaping is not proposed with this amendment as the use will occur internal to the entire site. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Appropriate site clean-up from construction operations will be completed. 8. Explain how the storm water drainage will be handled on the site. Historic drainage will not be altered. The applicant does not anticipate"major run-off'due to the absence of large impervious surfaces at this location. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. The site is located directly underneath the Approach Surface of the main north/south runway at the Greeley- Weld County Airport, and, subsequently, within the Airport Zoning Overlay District as adopted by Weld County ordinance. However, given the distance of the site from the airport, and elevation of the Approach Surface over that site, the placement of typical single story structures should not have any impact on the height zoning limitations contained in the Weld County ordinance. Additionally, since the existing and/or proposed use of the site is commercial and/or industrial in nature, the activities which will take place on the site are not considered an incompatible land use for the airport. For that reason, an avigation easement over the property will likely not be requested by the airport during the referral review period. However, since the property is located directly underneath the approach path for the airport's main runway,the ...land owners can reasonably expect an increasing number of aircraft overflights over time. For that reason, it is likely that trough the referral process, the airport would recommend to Weld County that a notation concerning the proximity of the site to the airport be placed on the official plat and recorded.
