RE: Case No. PF-1066 (Torgerson/Pueblo Ice House, LLC PUD)
Dear Mr. Ogle:
Thank you for your recent e-mail up-date regarding the status Torgerson (Pueblo Ice
House, LLC) PUD application. This is to formally apprise you that, although Pierce Lateral had
prepared and presented an agreement for Mr. Torgerson's and Pueblo Ice House LLC's
consideration, the agreement was not signed and so Pierce Lateral withdrew the proposed
agreement as of June 29, 2006. Therefore, the current status remains that there is no agreement
between Pierce Lateral and the applicant in place concerning the pending PUD application.
As well, Mr. Torgerson indicated to us on June 29, 2006 that the subject property was
being sold, and the county records now indicate that the subject property is owned by Santa Fe
Warehouse and Storage Company.
At any rate, the applicant has not entered into an agreement with Pierce Lateral as
required in our April 24, 2006 response to the referral of this matter, and so Pierce Lateral
Company's objections and requirements concerning the application remain unchanged.
