Overall they look great but there are some small changes as listed below. 1. in the detail of the entry the oil and gas setback is labeled as 150' while it is labeled as 200' in the over plan. 2. please remove all utility easements along with their corresponding labeling from the plat—I should have caught this earlier, I apologize. At the time of Final and after review by the Utility Board the easements will be shown on the plat. 3. remove the word 'dedication' in the County Road 21.5, Harpenden Ct and the entry road description. These roads will not be dedicated until Final. • 4. remove the word 'proposed' from the drainage easement along the eastern edge of Lot 1. 5. please label the book and page recording information for County Road 21.5 6. You had asked for a phone number for the Lupton Bottom Dich Company. Please contact Corky Cantrell, Superintendent, at(970) 785-2147. The agreement that.I submitted to you was faxed by Corky on the previous day. He did not have the signature page so I added the page that I had previously gotten from Lee Petrides. The Weld 45 Acre, LLC paid approximately $5,000 for permission to cross the ditch. 2. We filed four agreements with the Weld County Clerk and they are called out on the Change of Zone Plat. The Ditch Easement Agreement was filed at reception#3409048. The Ditch ROW Agreement (Crossing Agreement) was filed at reception#3409049. The Water Line and Road Sharing Agreement was filed at reception#3409050, and the surface agreement with Encana's predecessor was filed at reception#3409051. I am still a little confused about the information which we are including on the Change of Zone Plat as is our Surveyor,Mark Corbridge. We have no problem providing documentation relating to existing easements and uses as called for in Section 27-9-20,Paragraph J of the Weld County Code; however, we have never included lots, agreement recordation information, or easements which do not yet exist. These items are typically created by the Final Plat as part of the Final Review Process. Providing this information as part of the Change of Zone unnecessarily complicates the Change of Zone Plat and creates a very large potential for conflicts between the Change of Zone Plat and the Final Plat. Second, Steve Klen will be dropping off two paper copies of a revised Change of Zone Plat for your review. Mark Corbridge made most of the changes: however, we noticed a couple of things that Mark did not catch so I made two hand changes to the paper copies. The first change was to add the well identification numbers. It was our hope that we are close enough with these revisions that we can add this information prior to plotting the final mylars. The second change is to the entryway detail where the easements are shown incorrectly on the south side of Harpenden Lane. The easements south of Harpenden Lane need to reflect the actual easements as platted by Steve Klen for the initial Moorea Manor. Again,we believe this to be a minor change that we hope we could complete before running the final mylars. Third, Steve will also drop off a copy of the ditch company crossing agreement. In order to make sure we had the latest and geatest version we had Corky of the Lupton Bottom Irrigation Company fax us his official copy yesterday. The other issue is that during the hearing it was mentioned that an emergency access needs to be incorporated into the design of Moorea Manor for if and when oil and gas work is done on the well at the entry way. The first two lots in Moorea Manor are still owned by Steve Klen;, however,I am not sure whether he will be willing to allow a replat of his subdivision for the wider entryway. Any options if he refuses to allow this change. I also have had several conversations and a field review with the new Fort Lupton Postmaster,Lorena Buum. She will be forwarding her approval shortly. The road around the well head needs to be shown on the Change of Zone plat as does the modifications to the entry effecting both Moorea Manor South and North. The applicant has shown the location of the sign -what I need to make sure is that it meets all setbacks per the Weld County Code. Basically an illustrated map showing the location of the sign with all appropriate setbacks delineated on it. Once I have reviewed the new paper plats for both subdivisions and all supporting documents the applicant will submit the drawings (plats) on Mylar to our office to be recorded. After the Change of Zone plat is recorded you can start work on the Final Plat. You can download a new application form if needed off our County webpage at www.co.weld.co.us in the left column click on the Planning Department and then click on Land Use Applications, there you will find the PUD (Planned Unit Development) application. The Final Plat submittal information is in the back of the packet. Let me know if you have any questions. Finally, we need to (1)get a letter from the post office on the mailbox location and (2) evidence that the sign location meets all setback requirements. Regarding item 2, what would that evidence be? I want to bring the paper copy to our weekly staff meeting on Friday to discuss the reconfiguration of the main access in regards to the oil and gas access, school turn around etc. A new plat of Moorea Manor South will need to be submitted the question is will it be a corrected plat or an amendment to the final plat. I will let you know Friday afternoon, either way it will need to be submitted with the final plat submittal of Moorea Manor North. Other than that item Some corrections to the plat as noted so far 1. delineate the ditch and all applicable easements (include the recorded easement agreement information on the plat) 2. label the size of all the utility easements running between the lots 3. the utility easement along the southern edge of the property needs to be 20' 4. on lot 8 the 20' easement cuts the corner of the property-the utility easement should follow the exterior boundary of the property 5. delineate all the fire hydrants as outlined in the fire districts letter 6. the legal description of the property in the header and the property description is incorrect it should be the S2 of the NW4 7. the signature blocks all refer to the year 2004 and should reflect the current year 8. please add a name to the property owners signature block-weld 45 acres, Ilc+ 'name' • items to be completed from the resolution 1. something in writing from the post office regarding the mailbox location 2. evidence that the sign location meets all setback requirements I will email you on Friday to let you know the status of the second access for oil and gas reasons and the reconfiguration of Moorea Manor North for the main access. These items are provided to satisfy requirements outlined in paragraphs 1.A through 1.L which are needed prior to recording the approved Change of Zone Plat Generally, this project has not changed substantially since our Change of Zone Submittal on August 18, 2004. We have made the following changes in response to review comments: 1. Removed perimeter trails and open space. Provided a larger centralized open space area. 2. Added entryway improvements to accommodate school, postal and law enforcement comments. 3. Negotiated new master agreement with the Lupton Bottom Ditch Company. 4. Satisfied requirements of the Encana Oil Company. 5. Provided new landscape plan prepared by Frederickson Group. We believe these changes will allow us to complete a desirable community as well as address all Weld County Criteria. Following is an item by item response to issues raised through the Change of Zone process: Ms.Jacqueline Hatch, Plhr Q Weld County Department of Planning Services April 13,2006 Page Two 1.A. Attached is the response letter from the Weld County Public Works Department dated September 20, 2004. This letter recommends approval of the Change of Zone. All Department of Public Works comments have been addressed. A Final Drainage Report and Final set of construction plans will be submitted as part of the Anal Plat Submittal Process. 1.B. Revegetation of the project is included to stabilize construction impacts and enhance permanent vegetation. Please keep in mind that construction will be limited to the 60' wide road right-of-way only. The revegetation process is being directed by two documents as follows: 1. Landscape Plan prepared by the Frederickson Group. This plan to be approved by Weld County. 2. The Country Acres Resource Team °Small Acreage Management: A Manual for Success°which was secured from the local SCS office and is incorporated into the subdivision covenants. The cover sheet of this 126 page manual is attached. 1.C. A detail of the expanded entryway is attached which shows the identification sign, neighborhood mail delivery unit and pedestrian shelter for school children. This access meets all ADA requirements as shown on the final grading and roadway plans. Attached are written approvals from the school district and post office. 1.D. Please see the detail provided for item 1.C. The final construction plans will provide horizontal and vertical design elements as well. 1.E. Subdivision identification sign proposed for this project will be approximately 4'X 8' and located as shown on the final plans. A separate sign permit and details will be provided prior to installing the sign as part of the construction process. The landscape plan provides information for revegetation of disturbed areas as well as plantings for the open space and median areas. 1.G. The landscape plan will provide information on reseeding in open areas. Prior to completing this information, Deane Frederickson of The Frederickson Group met with Weld County Staff to review applicable requirements. 1.H. Attached is a copy of the referral response from the Weld County Department of Planning Services dated August 19, 2004. 1. Landscaping plans are attached. 2. A detailed agreement with Lupton Bottom Ditch Company has been completed. 3. Horse usage on the property will be limited and horse trails have been removed. 4. Native irrigation will be controlled by the HOA as existing water rights allow. 5. The DOW has no comment and will not respond. 6. Oil and gas issues were summarized before the County Commissioners. 7. Improvement Agreements will be completed as part of the Final Submittal. 1.1. Attached is the response from the Platteville / Gilcrest Fire Prevention District dated August 24, 2004. We have agreed to these requests. Final construction plans will show the proposed changes and additional fire hydrants. Final construction plans will be available as part of the Final Plat approval process. We attended the Platteville Planning Commission meeting on September 14, 2004 and their letter does accurately reflect the discussion we had with the Planning Board. While they want this development to conform to Platteville Development Criteria, it is impossible to meet this criteria which includes sanitary sewer,curb,gutter and sidewalks,wider streets, and annexation. Since we are not within the Platteville Urban Growth Area, are not eligible for annexation, and not within three miles of this sewer system,we do not feel these comments are appropriate and are certainly not consistent with large lot rural subdivisions. 1.K. An agreement between Moorea Manor North developers, the Weld 45 Acre, LLC, and the developer of the Moorea Manor Subdivision, Steve Klen, is attached. This agreement addresses the sharing of costs for utilities and roads. 1.L. The specific items 1 — 8 were addressed by Absolute Surveying and included on the Change of Zone Plat. The appropriate notes outlined in Paragraph 2 have also been added to the plat. Two paper copies of the Change of Zone Plat and the Landscape Plan are also included for your review.
