WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,by Resolution dated June 26,2002,the Board approved Change of Zone#602 for a PUD (Planned Unit Development) Zone District for 618 lots with R-1, R-2, R-3, and R-4 (Residential)Zone uses, 31 lots with C-1, C-2, and I-1 (Commercial and Industrial)Zone uses, and 239 acres of common open space, including a community clubhouse for Riverdance PUD,do Mike Siegrist, on the following described real estate, to-wit: Part of Section 35, and the SW1/4NW1/4 and the NW1/4SW1/4 of Section 36, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services staff recommended the vacation of Change of Zone#602 due to the re-zoning of the property through Change of Zone, PZ#1078 for Saint Vrain Lakes, and WHEREAS, the Board has received a request from current property owner Carma Colorado, Inc., 9110 East Nichols Ave, Suite 180, to vacate said Change of Zone #602, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. The request for vacation of prior zoning [Riverdance PUD] was not addressed in staff comments as a condition of approval prior to recording the plat for the Saint Vrain Lakes PUD, case number PZ-1078, approved March 15, 2006.
