Cheryl Jesser, Town Clerk (w/o encl.) /u/cic /f��%i�z�� �j , tC 2006-2765 IMPACT REPORT FOR THE STEWART 1 AND 2 ANNEXATIONS TO THE TOWN OF KEENESBURG, COLORADO The proposed annexation is a serial annexation known as the Stewart 1 and Stewart 2 Annexations to the Town of Keenesburg, and involves the annexation of two parcels of property lying in the Southwest Quarter of Section 26, the Southeast Quarter of Section 27, and the Northeast Quarter of Section 34, Township 2 North, Range 64 West of the 6`h P.M., Weld County, Colorado, and contains a portion of the right-of-way of Weld County Road 16. As required by C.R.S. § 31-12-108.5(a), the following information is provided: 1.. Annexation maps for the Stewart 1 and Stewart 2 Annexations are enclosed, which show the annexation's proximity to the Town of Keenesburg, the present and proposed boundaries of the Town, and the vicinity of the annexation. 2. The vicinity map shows the present streets, including Weld County Road 16, Interstate 76, and existing Keenesburg streets and roads. No streets exist within the property to be annexed and no municipal utilities exist on the property or are connected to the property. 3. The land to be annexed is currently vacant. The owner has requested at approximately 32 acres in Section 26 be zoned R-1 residential for an anticipated 52 homes, and approximately 12 acres in Section 27 and 160 acres in Section 34 be zoned Agricultural with minimum lot size of 2 '/9 acres. No draft annexation agreement is available at this time. All municipal services currently provided to residents of the Town of Keenesburg will be extended to the territory to be annexed when development occurs. Water and sewer service will be provided by the Town of Keenesburg. All utility extensions, streets, and other infrastructure improvements will be financed or built, or both, by the owner or developer at the time of development; no financing or construction of infrastructure improvements will be completed by the Town. The following districts exercise control or have taxing authority within the area to be annexed: Weld County; Aims Junior College (a/k/a Aims Community College); School District RE-3J; Southeast Weld Fire Protection District; Central Colorado Water Conservancy District; Lost Creek Groundwater Management District; Southeast Weld Conservation District; and Weld Library District. The owner's current development projections could result in an additional 122 single family lots; however, specific development plans or applications have not been filed by the owner. No statement regarding the effect of the proposed annexation upon the local school district has been received, and no estimate of the number of students to be generated has been provided. Therefore, no estimate as to capital construction required to educate additional students to be generated by this proposed annexation is available. As required by C.R.S. § 31-12-108, School District RE-3J was provided notice of this annexation by certified mail. WHEREAS, a petition for annexation of certain property to be known as the Stewart 1 Annexation has been filed with the Town Clerk of the Town of Keenesburg,Colorado,and referred to the Board of Trustees of the Town for a determination of substantial compliance with applicable law; and WHEREAS, the Board of Trustees wishes to permit simultaneous consideration of the subject property for annexation and zoning, if requested in the petition; and WHEREAS, the Board of Trustees has reviewed the petition and desires to adopt by Resolution its findings in regard to the petition. In establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tradt or parcel of real estate or two or more contiguous tracts or parcels of real estate, has/have been divided into separate parts or parcels of real estate without the written consent of the land owner or land owners thereof, except and unless where such tracts or parcels are already separated by a dedicated street, road, or other public way. 4 . In establishing the boundaries of the territory proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate comprising twenty (20) acres or more which, together with the buildings and improvements • situated thereon have an assessed valuation in excess of $200, 000 for ad valorem tax purposes for the year next preceding the filing of the written petition for annexation, has/have been included within the territory proposed to be annexed without the written consent of the land owner or land owners. 5 . The territory proposed to be annexed dos not include any area which is the same or substantially the same area in which an election for an annexation to the Town of Keenesburg was held within the twelve months preceding the filing of this petition. 6 . The territory proposed to be annexed does not include any area included in another annexation proceeding involving a town other than the Town of Keenesburg. 7. The territory proposed to be annexed is not presently a part of any incorporated town, town and county, or town. 8 . The property owned by each petitioner is described on each separate signature sheet and, when needed, described more fully in the exhibits attached hereto and incorporated herein by reference. _ 9. The signer (s) of this petition comprises (s) more than fifty percent (50%) of the land owners and owning more than fifty percent (50%) of the property, excluding public streets and alleys, and any land owned by the annexing municipality, and are, in fact, owners of one hundred percent (100%) of the property set forth in Exhibit "A" attached hereto and incorporated herein by reference.
