RE : GRANT MOBILE HOME PERMIT NO. 511 - BEN AND BETTY BEIERLE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners on the 16th
day of December, 1981, considered the request of Ben and Betty
Beierle for a mobile home as a temporary residence in addition
to a principal dwelling for use during a medical hardship on
a parcel of land which is to be occupied in an A-Agricultural
Zone District, more particularly described as follows:
Part of the NEq of Section 5, Township 1 North,
Range 68 West of the 6th P .M. , Weld County,
Colorado.
WHEREAS , the Board of County Commissioners, having heard
the applicants , finds that said request should be granted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the request of
Ben and Betty Beierle for permission to place a mobile home
as a temporary residence in addition to a principal dwelling
for use during a medical hardship for eighteen (18) months,
at which time said medical hardship will be reviewed, on the
above described parcel of land be, and hereby is , granted.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 16th
day of December, A.D. , 1981.

No slope exists on the site or surrounding area. The parcel of land has one
existing improvement; a house. The mobile home would use the same existing
driveway as the house.
The Caimacar Ranchettes Subdivision exists directly south of the applicants parcel.

STATEMENT
to the
Weld County Board of County Commissioners
regarding the
Hearing concerning the Beierle request for a zoning change
We, the undersigned landowners having property within 500 feet
of the Beierle property, request the hoard to deny the request for
a zoning permit to place (for an indefinite period) a house trailer
on the Beierle property.
Such placement of a house trailer would constitute a nuisance
to us. We have a right to expect continued protection from zoning
regulations which influenced our past decisions on the purchase of
property in the area and in the maintenance of a living quality
standard that is important to us. The proposed placement of a
trailer house would specifically violate our desire for low density
housing and to live in absence of trailer houses. We submit that
the existing zoning regulations prohibiting denser housing and
trailer houses in our area are evidence in themselves that such
could constitute a nuisance.
We understand that if the request were approved it would be
for a "temporary" but undetermined period. Medical conditions
could conceivable last for 20 or more years, thereby exceeding
the period of average house occupancy. i^'e submit that approval
under such terms wouldoin practical terms , be a. "permanent" action
in relation to us.
We believe this situation to be a question of inconvenience
to the Beierle ' s versus a nusiance to we nearby landowners . :7e
believe that a suitable alternative to a trailer house exists to
accommodate the medical hardship. The Beierle residence is a
large two-story house that should have ample room.
In circumstances such as this , the burden of inconvenience
should rest with the party seeking a change. We therefore believe
that an equitable finding by the board is the denial of the permit
request.

Dear Commissioners:
We were very disturbed to learn that the public hearing,
that I was notified of by mail on October 20 , regarding a
request by Ben and Betty Beierle for a zoning permit for a
mobile home was changed from November 11 to November 9. We
planned to attend the hearing and present our opposition to
the approval of the request. Since we ,were notified of the change
on November 10, we were deprived of the opportunity to present
our case.
Since there are some significant issues involved in
this case, that we believe the board did not consider, we
respectfully petition the board to rescend its findings of
November 9 and reschedule the hearing.
We would appreciate early notification of your decision
regarding our request for a rehearing so we will have sufficient
time to prepare for the hearing or proceed with alternative
actions. We are confident all of us can persue this matter
in a fair and equitable manner.
