A public hearing was conducted on December 6, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem Commissioner William H. Jerke Commissioner Robert D. Masden - EXCUSED Commissioner Glenn Vaad - EXCUSED Also present: Acting Clerk to the Board, Jenny Luna County Attorney, Bruce Barker Planning Department representative, Kim Ogle The following business was transacted: I hereby certify that pursuant to a notice dated September 15, 2006, and duly published September20,2006,in the Fort Lupton Press,a public hearing was conducted on October4,2006, to consider the request of Strear Farms Company, c/o Duke Energy Field Services, Inc., for a Site Specific Development Plan and Use by Special Review Permit #1561 for a Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility, in the A(Agricultural) Zone District. At the request of the applicant,the Board deemed it advisable to continue the matter to December 6, 2006, at 10:00 a.m., to allow the applicant additional time to continue working to resolve concerns expressed by the surrounding property owners at the Planning Commission hearing, and to present the application before a full quorum of the Board. On December 6, 2006, Bruce Barker, County Attorney, made this a matter of record, and advised the applicant's representative, Keenan Wall, Witwer, Oldenburg, Barry,and Johnson, LLP,that he has the option of continuing the matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes. Mr. Wall stated the applicant submitted a memorandum, marked Exhibit I, requesting a continuance of the matter for at least three months, in order to address sound concerns at the site. Kim Ogle, Department of Planning Services, stated the applicant has requested a continuance of the matter to March,2007. Upon conferring with the Acting Clerk to the Board regarding available hearing dates, Mr. Wall requested that the matter be continued to March 28, 2007, at 10:00 a.m. No public testimony was offered concerning this matter. Commissioner Long moved to continue the request of Strear Farms Company, c/o Duke Energy Field Services, Inc.,fora Site Specific Development Plan and Use by Special Review Permit#1561 for a Mineral Resource Development Facility,including an Oil and Gas Support and Service Facility, in the A(Agricultural)Zone District,to March 28,2007,at 10:00 a.m. The motion was seconded by 2006-2770 PL1855 C('. ley fa), / /0-7-4-7/O4, HEARING CERTIFICATION - STREAR FARMS COMPANY, C/O DUKE ENERGY FIELD SERVICES, INC. (USR#1561) PAGE 2 Commissioner Jerke, and it carried unanimously. There being no further discussion, the hearing was completed at 10:40 a.m. This Certification was approved on the 11th day of December 2006.
