RE: APPROVE GEOGRAPHIC INFORMATION DATA PRODUCT AGREEMENT AND
AUTHORIZE CHAIR TO SIGN-NORTH FRONT RANGE WATER QUALITY PLANNING
ASSOCIATION
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Geographic Information Data Product
Agreement between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and the North Front Range Water Quality Planning Association,
commencing upon full execution of said agreement, with further terms and conditions being as
stated in said agreement, and
WHEREAS,after review,the Board deems it advisable to approve said agreement,a copy
of which is attached hereto and incorporated herein by reference.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Geographic Information Data Product Agreement between the County
of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
and North Front Range Water Quality Planning Association be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreement.
The above and foregoing Resolution was,on motion duly made and seconded,adopted by
the following vote on the 26th day of June, A.D., 2006.

NORTH FRONT RANGE WATER QUALITY PLANNING ASSOCIATION
GEOGRAPHIC INFORMATION DATA PRODUCT AGREEMENT
The North Front Range Water Quality Planning Association("Association") has
developed a Geographic Information Data Product("product") which establishes the
service area boundaries for the management agencies within the Association's
jurisdiction. This product was developed for use by the Association and its member
entities ("members") with the assistance of the City of Loveland and incorporates
information obtained from both Larimer and Weld Counties. The Association maintains
ownership of this product. No part of this product may be copied, reproduced, or
transmitted in any form or by any means whatsoever, including, but not limited to,
electronic, mechanical, photocopying, recording, scanning, or by any information or
retrieval system for any non-approved purpose without the express written permission of
the Association. Unrestricted use of this product on member computers or on member
contractors' or agents' computers for purposes of wastewater planning shall be
considered approved purposes and no written permission shall be required for such use.
Members shall not license, sub-license, assign, lease, release,publish, transfer, sell,
permit access to, distribute, allow interactive rights to, or otherwise make available the
product or any portion thereof in any form or media now known or hereinafter created to
a third party accept for approved purposes. Members agree to notify their employees,
agents, and any contractors of the restrictions contained in this Agreement and to require
all agents and contractors using this product for approved purposes to sign an agreement
containing the same restrictions found in this Agreement.
This product is distributed "as is"to members for internal use only. Members use and
rely upon this product and the information contained therein at their sole risk and
expense. Members understand and acknowledge that the information contained in this
product is subject to constant change and that the accuracy and completeness cannot be
and is not guaranteed by the Association. Under no circumstance shall this product be
used for final design purposes. The Association makes no warranties or guarantees,
either expressed or implied, as to the completeness, accuracy, or correctness of this
product, nor does the Association accept any liability arising from any incorrect,
incomplete, or misleading information contained in this product.
The Association is not responsible and shall not be liable for any direct, indirect,
incidental, consequential, punitive, or special damages, whether foreseeable or
unforeseeable, arising out of the use of this product, inability to use this product, or any
breach of this Agreement.
By signin is agreement,members are accepting the conditions of this Agreement.
