The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS
Weld County Road Classification Plan (FHU): (June 2002) WCR 27 is a major arterial road, which requires
a 140-foot right-of-way at full build out. This road is maintained by Weld County at this location. The applicant
shall verify the existing right-of-way and the documents creating the right-of-way. If the right-of-way cannot be
verified, it shall be dedicated.
Traffic Counts: The average daily traffic count (ADT) for WCR 27 range from 4,000 to 9,000 between Ft.
Lupton and Brighton.
EQUIREMENTS:
Access: The applicant is identifying two access points to the parcel. The new northern access point is
proposed to be concrete pavement with 48" x 24' culvert to accommodate the Fulton Ditch crossing. This
access point shall accommodate the main proposed 80' x 60' prefabricated metal shop building and storage
areas. The southern access to the existing school building will become the new office accesses through Lot A
of the RE-1636. The applicant is indicating an egress/ingress easement across Lot A to Lot B. This sign-off
from the adjacent property owner of Lot A indicating that they are aware of the change in use of this easement
should be a part of the application.
Off-Street Parking and Circulation: The applicant is identifying a paved parking area adjacent to the office to
accommodate employees, customers, and vendors. The remaining portion of the lot shall accommodate
equipment/vehicle storage.
Storm Water Drainage: In reviewing the layout of the facility and the proximity to the new gravel operation to
the west, the Weld County Public Works Department recommends placement of the retention facility in the
southwest corner to obtain any run-off that may occur from the existing structure and paved parking lot areas.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
lanagement practices.

Dear Jacqueline:
Thank you for the opportunity to comment on Weld County Referral, Case No. USR-
1535 regarding a site-specific development plan and special review permit for a
potential business. The City does not object to the referral but would like to comment on
the following.
1) Lot B shows three (3) proposed accessory units located on the premises.
According to Weld County Zoning Code Section 23-3-30 any accessory building
constructed after 1981 shall not exceed four percent (4%) of the total lot area.
The three accessory units total 10,440 square feet. The lot size is 185,347.80
square feet.
Three accessory units = 10,440 ft2
Lot B = 185,347.80 ft2
10,440 / 185,347.80 = .056 (Exceeds the 4% code maximum)
2) The City of Fort Lupton understands the historical value and significance of the
old school house located on Lot B. Has the owner contacted the Colorado State
Historical Fund to determine if the school is listed on the state register? If it is not,
is the owner willing to seek historical designation?
3) The property is currently zoned agriculture. Would it make more sense to rezone
the property to a heavy commercial or light industrial district rather than issue a
Use by Special Review Permit? The City of Fort Lupton and the City of Brighton
recently completed a growth plan (pending adoption) that calls for most of the
area around WCR 6 and WCR 27 to be zoned commercial and industrial.

4) According to Weld County Zoning Code Section 23-3-30(E) a proposed office is
supposed to be incidental to the operation of the uses allowed by right. Is what
the owner proposing incidental to agricultural activities? The referral does not
make that clear.

Environmental Health Services has reviewed this proposal for an office, outdoor storage
and Maintenance of equipment. We have no objections to the proposal, however, we
do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the existing school house
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations. An application for a new septic system has been
applied for: #SP-0500383.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

A Site Specific Development Plan and Special Review Permit for a business permitted as a use
be right and/or use by special review in the Commercial Zone District (Office with a gross floor
area larger than three thousand square feet, outdoor storage, and maintenance of equipment) in
the A (Agricultural) Zone District.
1. A building permit is required for the change of use to the business use. The office
building will likely be classified as a B occupancy. The building will be required to meet all
current adopted codes, including accessibility requirements. Two complete sets of
engineer stamped plans will be required at the time of the permit application. All new
construction will also require building permits.
2. Buildings shall conform to the various codes adopted at the time of the permit
application. Current codes adopted by Weld County include; 2003 International building
code, 2003 International Mechanical code, 2003 International plumbing code, 2003
International fuel gas code, 2002 national electrical code, and chapter 29 of the Weld
County code.
3. Fire resistance of walls and openings, construction requirements, maximum building
height and allowable areas will be reviewed at the plan review. Setback and offset
distances shall be determined by the zoning ordinance.
