CRS 1973 , as amended and Section 2-1 A. (3) of the Weld County
Subdivision Regulations.

Section 2-1 of the Weld County Subdivision Regulations adopted August 30, 1972.
The Department of Planning Services staff has reviewed this request and
reco rends that the request be approved for the followings reasons:

xx Fall in flood plain or a geologic hazard area
xx Agree with the Weld County Comprehensive Plan
xx Create new parcels elgible for building permits
xx Agiee with surrounding land uses
0nMENTS:
The subdivision exemption action will allow Mr. and Mrs. Harkis to sell off
a 1.5 acre, more or less, parcel with the improvements. Also, this action
would allow the Harkis' to join a 2.1 acre, more or less, parcel to their
adjacent property.
The Department of Planning Services staff has received no objections to
this request.

The reason why I and my wife are requesting a Lot Size
Variance (Parcel A) from weld County are as follows: ( 1 ) When
we purchased the property my father and I needed the land to
complete a sprinkler quarter, it protruded into its path. The
property was in a deteriated condition, both outside sheds and
the house. It took much cleaning and alot of repair. The
house still needs much work outside but is relatively good in-
side. We can't afford to keep the house up properly, make pay-
ments, and interest on the amount of rent we are getting for it.
4200.00 per month. (2) As you know, farming for profit is hard
in this day and age, and we do need the money to clear up some of
our debts at the bank. Combine, planter, cattle, tractor etc.
( 3) Remainder of land, Parcel B, is either sheds, corral, or
farm ground (sprinkler) goes through South west corner. We
hope to build a grainary on a portion of it in the future. ;>y
father (Richard E. Harkis) and I (Richard Eugene Harkis) own the
remainder of the qaarter section. (4 ) Peter and Bernice Wodnick
(Buyers) nave signed a form agreeing to give or sell water to us
for livestock or small miscellaneous uses.
Of these reasons, the main one is financial. We can ' t afford
to keep it up properly and also need the money . We plan to keep
Parcel B as part of the working farm. We don' t make a habit of
selling property, Our family has lived nere since 1908, so we

Re: Harkis Exemption
Dear Mr. Oxenfeld:
We have received the above referenced exemption proposal. This pro-
posal would divide a 3. 67 acre tract into two parcels. One of these parcels
has a house and a well. This parcel would be sold. The other parcel would
be retained by the owners who also own the remainder of this quarter section.
This parcel would be used for agricultural purposes although a water supply
may be required for purposes other than irrigation.
The purchasers of the residential lot have agreed to supply water to the
applicants. The well in question appears to be #10675 issued in 1962 to
Darrell Nichols for domestic purposes.
Our only concern regarding this proposal is that the water agreement is
not binding for future owners. Although we could issue a household use only
well permit for parcel B, it would not be applicable for any agricultural support
activities which are planned for this land. Thus , water for any such activity
would have to be furnished by the well on parcel A or by a well on the remain-
der of the quarter section.
We can recommend approval of this proposal since a water supply would
be available. Due to the restrictions of any permit we could issue and the
limitations of the proposed water agreement, we condition our recommendation
for approval upon there not being any major improvements which ye uld require
any significant amount of water without a more secure water source first being
obtained.
