RE: ASSESSMENT OF COST OF IMPROVEMENTS FOR LOCAL IMPROVEMENT
DISTRICT #1981-2 REGARDING ELMORE ROAD
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the total cost of paving improvements, together
with all necessary incidental improvements within Local Improve-
ment District #1981-2 in Weld County has been definitely ascertained,
and
WHEREAS, the Board of County Commissioners has determined to
assess the cost of improvements against the property included
within the district and specifically benefited by the construc-
tion of improvements, and
WHEREAS, a statement showing the whole cost of the improve-
ments and an assessment role showing the amount of each assessment
has been prepared and filed in the Office of the County Clerk and
Recorder, and
WHEREAS, the Board of County Commissioners has considered
the special benefits accruing to each lot or tract of land in the
district by reason of the making of the improvements and has
determined that the apportionment of the assessments for said
improvements is in accordance with such benefits, and
WHEREAS, a notice of apportionment of the improvements and
of the hearing on complaints and objections was published in The
Johnstown Breeze on January 7, 1982, and
WHEREAS, on January 27, 1982 , at the hour of 7 : 00 o 'clock p.m. ,
the Board of County Commissioners held a hearing to receive and
determine any complaints and objections and for the purpose of
confirming the apportionment, and
WHEREAS, no complaints or objections were received.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado:

1. That the cost of the improvements and the apportionment
of the same as set forth in the attached notice is hereby approved
and confirmed. Said apportionment is hereby declared to be in
accordance with the special benefits which the property in the
district will receive by the reason of the construction of said
improvements. The share of said cost is hereby assessed to and
upon each lot or tract of land within the district in the propor-
tions and amounts set forth in the assessment role as filed in the
Office of the County Clerk and Recorder and as shown on the attached
notice and which is made a part hereof and incorporated herein by
reference.
2. That the whole cost of constructing and installing
asphalt paving improvements has been definitely ascertained and
that amount is $29 ,246. 68. Said amount including cost of inspec-
tion, collection, incidentals and interest as allowed by law.
3 . The County of Weld will pay for County rights-of-way,
frontage and school bus turn-around in the amount of $1, 361. 64 .
4 . Payment may be made to the County Treasurer at any time
within thirty (30) days of January 27, 1982 , the effective date of
this assessing resolution. At the expiration of said thirty-day
period, the County Treasurer shall return the local assessment
role to the County Clerk and Recorder, therein showing all payments
made thereon, with the date of each payment. Said role shall be
certified by the County Clerk and Recorder under the seal of the
County and by her delivered to the County Treasurer with his
warrant for the collection of the same. Failure to pay the whole
assessment within said thirty-day period shall be conclusively
considered and held an election on the part of the property owners
interested, whether under disability or otherwise to pay in
installments.
5. In the event any owner of real estate shall fail to
pay the whole of such assessment against his or her property
within thirty days , then the whole cost of the improvements so

assessed against such property shall be payable in ten (10) equal ,
annual installments of principal plus interest at the rate of
thirteen percent (13%) per annum. The first of said installments
of assessment shall be due and payable on January 30, 1982
, and the remainder of annual installments of assess-
ment and interest shall be due and payable successively on the
same day each year thereafter until all are paid in full.
6. Failure to pay any installment, whether of principal or
interest when due, shall cause the whole of the unpaid principal
to become due and collectible immediately and the whole amount of
the unpaid principal and accrued interest shall thereafter draw
interest at the rate of one percent (1%) per month or fraction of
a month until the day of sale of the property as provided by law.
At any time prior to the day of sale of the property, the owner
may pay the amount of all unpaid installments , with interest at
one percent (1%) per month or fraction of a month, and all penalties
accrued, and shall thereupon be restored to the right thereafter to
pay installments in the same manner as if default had not been
suffered. The owner of any property not in default as to any
installment or payment may, at any time, pay the whole of the
unpaid principal with interest accruing to the maturity of the
next installment of interest or principal.
7. The County Treasurer shall institute foreclosure pro-
ceedings on behalf of the County against any property within the
district which is in default in the payment of any special assess-
ment levied against such property or any installment thereof.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
January, A.D. , 1982.

The following business was transacted:
I hereby certify that pursuant to a notice dated January 4, 1982,
duly published January 7, 1982 in the Johnstown Breeze, a public hearing
was held on the request regarding the assessment of cost of improvements for
local improvement district #1981-2 regarding Elmore Road in Seemore Heights.
Several of the adjacent landowners were present. No one had any complaints
or objections. The Board determined to aaaess the cost of improvements
against the property included within the district and specifically benefited
by the construction of improvements. A statement showing the whole cost of
the improvements and an assessment role showing the amount of each assessment
has been prepared and filed in the Office of the County Clerk and Recorder.
After discussion, Commissioner Kirby made a motion to approve the final cost
of $29,246.68, Weld County will pay $1,361.64 for County rights-of-way,
frontage and school bus turn-around, and each citizen will be assessed
as specified in the notice dated January 4, 1982. Commissioner C. Carlson
seconded the motion. Commissioner C. Carlson stated that the signs will
be set as soon as possible: The motion carried unanimously. The Commissioners
present thanked the citizens and further stated that they were proud of the
citizens involved for their cooperation.

TO ALL PERSONS INTERESTED GENERALLY and to the owners of
property to be assess with the cost of paving improvements
for one-half mile of Elmore Road , located in Seemore Heights
Subdivision , Section 30, Township 3 North , Range 68 West of
the 6th P. M. , Weld County, Colorado, notice is hereby given :
That the whole cost of construction and installing
asphalt paving improvements has been definitely ascertained
and is the amount of $29 , 246. 68 said amount including costs
of inspection, collection , incidentals and interest as allowed
by law.
The County of Weld will pay for county rights-of-way
frontage and school bus turn around in the amount of $1361. 64 .
That the share apportioned to each lot or tract of land
within the District and assessed for the improvements is as
follows :

Local Improvement District No. 1980-1 , in the County of Montrose ,

definitely ascertained and is the amount of $70,220.23 said amount
including costs of inspection, collection, incidentals and inter-
est as allowed by law. .
(b ) The County of Montrose will not pay any part of the
cost of the improvements.
