Explain, in detail, the proposed use of the property. The proposed use of the site will remain consistent with the Second Amended USR-894 with the addition of a 25 by 25 foot helicopter pad. Fuel tanks for vehicles and trucks exist on site. A fuel tank will be added to service the helicopter and will be placed adjacent to the existing permitted fuel tanks. Appropriate permits will be pulled. The location of this additional site amendment is illustrated on attached plats. This amendment is consistent with Use allowed by Special Review in the Agricultural (A) Zone District per Weld County Code Section 23-3-40.A.2 (Existing Oil and Gas Service and Support Operation). Other uses of this property include administration of the business, to fuel company trucks during the day, work on pumps and other equipment (shop) and parking area for employee vehicles during the day and for trucks overnight. Generally,a helicopter will not be stored on site. A helicopter may stay overnight in unusual circumstances. An unusual circumstance includes poor weather that prevents the return to Centennial Airport. The helicopter will be dispatched from Denver to inspect lines and efficiently transfer management and repair crews to operation sites. Up to five helicopter landings will take place per day. However,there are many days that the helicopter will not be on this site. An additional benefit of this helicopter pad is if and when damage occurs to lines and other equipment,the helicopter can quickly find the problem spot, assess the situation, and relay messages to repair crews in a more efficient manner. The use of the helicopter from this site will allow for a much higher capacity of safety in the location and containment of any potential line leaks. The environmental benefits of this proposal are numerous for the citizens of Weld County. Thus, the use of a helicopter greatly increases the public safety, environmental safety,compliance with local, state and federal agencies, and compliance of the KP Kauffinan operations. 2. Explain how this proposal is consistent with the intent of the Weld County Code,Chapter 22 (Comprehensive Plan). The Second Amended Use by Special Review permit found the application to be consistent with the Weld County Comprehensive Plan. The Guiding Principles of the Comprehensive Plan found in Section 22-1-120 state, "Land use changes must afford flexibility based on the specific location and the particular circumstances encountered within this locality. It is also important to weight the cumulative impacts that specific land use changes will have." This proposal represents an addition in use that is consistent with the existing use as approved by Weld County. The impact to surrounding properties is anticipated to be minimal as the helicopter pad will be used on an as needed basis. The flight pattern proposed takes the existing and proposed surrounding land uses into consideration. The uses proposed will be compatible with the future development of the surrounding area as permitted by the existing zone district and with future development as projected by Chapter 22 of this Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The addition of a helicopter pad to the existing Use by Special Review permit does not prevent surrounding properties from developing or continuing existing uses. The operations conducted on site are confined to the enclosed area and buildings. Most activities occur on contract jobsites. • The property is not located within the I-25 Mixed Use Development area. • The site is located within the Intergovernmental Agreement area between Firestone and Weld County. The definition of Development in Section 19-2-40 states, "Any land use requiring regulatory approval by the elected governing body of the applicable party in the Urban Growth Area except for an amendment to a plat or a down-zoning, neither of which creates any additional lots, and except for a Subdivision Exemption." This application is for an amendment to an existing Use by Special Review plat and therefore does not meet the definition criteria for"Development" and thus does not require an Annexation Agreement. In the Board of County Commissioner's Resolution for the Second Amended USR-894, Conditions of Approval note, "Section 4.3 (b) is not intended to apply to applications for the expansion of an existing use" • Surrounding land uses include a commercial turkey operation to the east, agricultural uses to the south,and Glora Loma Estates Change of Zone PZ-521 to the north and west. Also to the north and west are agricultural uses. • Roy Teeter, Senior Vice President for Kauffman Well Service, Inc. verified the nearest residential structure to the northeast is 830 feet from the proposed helicopter pad. The nearest residential structure to the west is 1,230 feet. This proposed helicopter pad would be further off the county road than the Fort Lupton Fire Department pad. Efficient and orderly land development and the use of existing facilities, increasing safety for the welfare of the citizens of Weld County has been considered. K.P. Kauffman Company,Inc.leased the property in October 1995 and Kauffman Land and Development,L.L.C.,purchased the property in November, 1996. The field office is owned by Kauffman Land and Development, L.L.C., but leased by K.P. Kauffman Company,Inc.and Kauffman Well Service, Inc. Previously,the site had been used for other commercial activities such as decorative rock fabrication and contractor shops through the Use by Special Review permit process as early as 1989. The site has been under an existing Use by Special Review permit since 1989. Weld County,in their previous reviews of such applications, determined the uses were compatible with existing and future surrounding land uses. The addition of a helicopter pad should not alter the character of the area. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. This application has been filed in accordance with Article 2, Division 4, Chapter 23 of the Weld County Code, starting with Section 23-2-200. Application materials submitted comply with Article V of Chapter 23 of the Weld County Code (Overlay Districts). o The property is not located within the I-25 Mixed Use Development area. o The property is located in an Intergovernmental Agreement Boundary as discussed previously. This application is in compliance with the IGA as it is an expansion of an existing use. o Use by Special Review Design Standards found in Section 23-2-240 of the Weld County Code were consulted in preparing this application. o The site is not in an Overlay District,verified by documentation supported by and/or created by the Department of Planning Services. Adequate provision has been made to protect the health, safety and welfare of the inhabitants of the neighborhood and the County. Operation Standards as found in Section 23-2-260 of the Weld County Code were consulted in preparing this application as stated previously in application materials. This application proposes the addition of a helicopter pad. The helicopter will be dispatched from Denver to inspect lines and transfer employees critical to operations. Employee transfer is critical to operations for environmental compliance, especially when water is involved. Time is of the essence when containment booms need to be placed. An additional benefit of this helicopter pad is if and when damage occurs to lines and other equipment,the helicopter can quickly find the problem spot, assess the situation, and relay messages to repair crews in a more efficient manner. Thus,the use of a helicopter greatly increases the safety of the KP Kauffman operations. Conditions of Approval and Development Standards will ensure the proposed use upholds the purpose and intent of the Weld County Code, Chapter 23 as listed in Section 23-1-40. Such Conditions of Approval and Development Standards as found in the Weld County Code, Referral Agency responses and Staff Comments shall be considered and appropriately incorporated into the final use and site design. 4. What type of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. Surrounding land uses include agricultural and rural residential. The nearest residential structure to the northeast is 830 feet from the proposed helicopter pad.The nearest residential structure to the west is 1,230 feet. Surrounding land uses include a commercial turkey operation to the east. To the south are existing agricultural uses. To the immediate north and west of this site is a Change of Zone for Glora Loma Estates. The existing land uses north and west of the site are all agricultural in nature. The existing facility was in permitted and in place prior to the residential change of zone adjacent to the site. The addition of a 25'x25'helicopter pad will not change the character of or negatively impact surrounding properties. The pad is delineated on the amended site plan. A 6' screening fence is in the process of being constructed on the northern boundary and is proposed for the western boundary of the site. Construction on the western fence has been delayed until further notice at the request of the neighboring landowner, Linda Owens. The fence will be consistent with the existing screened fence on the other boundaries of the property. The current fences were voluntarily constructed with screening to appease the surrounding neighbors. The fence will not only allow for screening but also security of the facility. The approved storage area on the west portion of the site is proposed to be moved to the northern portion to allow complete clearance in the pad area as delineated on the site plan. The proposal is consistent and compatible with the existing and future land uses. This proposal has been reviewed and approved by the FAA and meets and/or exceeds the requirements set forth by the FAA. 5. Describe, in detail, the following: a. How many people will use this site Eighty-three/two(82)Employees will use the site. Forty-three(43)Employees come to the field office for daily assignments at 6:00 a.m. and leave for the field by 6:30 a.m. These same employees return to the field office and leave for the day by 6:00 p.m.Thirty-three(33) Employees come to the office by 7:00 a.m., leave by 7:30 a.m. and return to the site and leave the site by 6:00 p.m. Six(6)Employees come to work on site at 8:00 a.m.and leave by 5:00 p.m. K.P. Kauffman's total employees at this site will increase by another 10—25 in the next years as a drill rig is erected. However, most employees associated with this operation will arrive early, drive to the site in a company car and go to the job site. These same employees may not ever access the site but go directly to the drill rig. The number of employees may change due to the normal fluctuations of the industry, but not due to the addition of a helicopter pad to the site. b. How many employees are proposed to be employed at this site? Please see item 5.a above. 82 Full-time employees are currently associated with this site but do not spend much time on this site. It is the estimate of the applicant that an additional ten (10) drivers will be added in the next few years. c. What are the hours of operation? Operation hours are during daylight hours. In special instances, these hours may be extended. d. What type and how many structures will be erected (built) on this site? The only addition proposed through this application is a helicopter pad and an additional fuel tank. Future facility expansion may occur on site as illustrated on the application plat and is consistent with the existing approved facility. Site features include the following: • On the previous USR plat,a future office is delineated in the northern portion of the property. This future office has been removed from this proposal. In addition, a Mobile Home used as an office is noted on the previous plat. This has been removed and replaced with a permanent office structure in the location of the former Mobile Home. • A future building site was proposed with the previous USR as is with this application. • A storage area is planned in the northern portion of the property. • The southwestern portion is a detention area. • A 6' privacy fence will be constructed along the remaining western property perimeter. • The helicopter pad is planned to be located in the western portion of the property north of the detention area. e. What type and how many animals, if any,will be on this site? This is not applicable. f. What kind (type, size,weight) of vehicles will access this site and how often? Trucks of many sizes access the field office including water trucks, tankers, oil field equipment and vehicles. These vehicles do not approach the helicopter pad. Vehicles of employees who come to the site and leave in a company car will be parked consistent with the prior approved amendment. Forty(40)to fifty(50)vehicles will be parked overnight. g. Who will provide fire protection to the site? The Platteville Fire Protection District will provide fire protection to the site. The applicant has been in contact with the Platteville Fire District concerning this proposal. Please see a letter regarding this communication in application materials. h. What is the water source on the property? Central Weld County Water District currently serves the site and will continue to do so. Please see the attached warranty deed and tap fee agreement. i. What is the sewage disposal system on the property? Evidence of two Septic Permits are included in application materials,Number SE-0500093 and Number SP-0500368 were both approved by the Weld County Department of Public Health and Environment in October and November of 2005. j. If storage or warehousing is proposed,what type of items will be stored? Oilfield parts, equipment and trucks as specified in item f above are stored on site. The storage area the applicant utilizes is on the northern portion of the property. In addition, a fuel tank will be installed on site. Fuel storage will be conducted in a manner consistent with all state and local regulations. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. Landscaping approved through the Second Amendment USR-894 will not be changed by this addition. No additional landscaping is proposed. As stated above, a 6' screening fence is in the process of being voluntarily constructed on the northern portion of the property and bu request from Weld County, one has been constructed on the remainder of the southern portion of the property. A drainage report was completed in 1999 by Alpha Engineering. Weld County approved a detention pond in 2001 (BC 0100815). An updated drainage plan has been submitted with this proposal. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. The site is currently being operated under the existing Second Amendment to USR-894. The FAA has approved the construction and location of the helicopter pad to expedite construction. The applicant has completed an extensive FAA approval process and has installed lighting. A 6'privacy G fence is to be installed on the western property boundary. The fence will be consistent with the existing fence on the other three boundaries. The fence is shown on the amended site plan. Additional landscaping is not proposed for this site. 10. Explain where storage and/or stockpile of wastes will occur on this site. Wastes will not be stockpiled. A dumpster is located on site and is emptied once a week. Waste Management handles the office trash. Four(4)dumpsters are located on site and are emptied once a week.
