HomeMy WebLinkAbout840321.tiff RESOLUTION RE: APPROVE OF USE BY SPECIAL REVIEW FOR DOG KENNEL - KAREN KEEL WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 6th day of June, 1984, at the hour of 2 :00 o 'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Karen Keel, 10446 Independence Street, Westminster, Colorado 80020, for a Use by Special Review for a dog kennel on the following described real estate, to-wit: Tract B Casa Grande Estates located in Section 17 , Township 2 North, Range 67 West of the 6th P .M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons : 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4. 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not encourage urban use to expand in a rural area. The subject site is in a platted rural subdivision. b. The large lot size, small number of dogs (eight (8) ) , the applicant's design and proposed operation of the facility and the Operation Standards prepared by staff provide compatibility with the existing surrounding rural residential uses as well as future development of the surrounding area. d. No overlay districts affect the site. e. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application fox a Use by Special Review for a dog kennel on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . No building or electrical permits shall be issued for the Use by Special Review Permit area until the Standards for the Use by Special Review have been placed on the Use by Special Review plat and the plat has been delivered to the Department of Planning Services office. The permitted use shall be a dog kennel operation for a maximum of eight (8) Rottweiler dogs as described in the application materials on file in the Weld County Department of Planning Services. 2. The Use by Special Review Permit shall not be transferrable to any successors in interest to the described property shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. 3. Animal wastes shall be removed at least daily from the kennel and stored in an enclosed container. The waste shall be removed on a weekly basis. 4. All dogs shall be kept inside the house from 10:00 p.m. until 6:30 a.m. Dogs may be permitted outside between the hours of 6:30 a.m. to 10:00 p.m. only when the owner is home. 5. The drainage system from the dog run area shall be constructed per the Weld County Health Department recommendation. Either a 200-300 gallon treatment tank and small trench shall be built on the west side of the back yard to hold the waste water from the dog run area or a drain shall be installed that runs along the back inside wall of the runs and along the outside of the outdoor runs with the end of the pipe extending fifty (50) feet or more from the septic tank and leach field. 6. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 7. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 8. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 9. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 10. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET ND. 84-22 RE: USE BY SPECIAL REVIEW, DOG KENNEL, KAREN KEEL A public hearing was conducted on Jim= 6, , 1984, at 2:00 P.M. , with the following present: Commissioner Norman Carlson, Chairman Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner Commissioner Chuck Carlson Commissioner John Martin Also present: Acting Clerk to the Rnard, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department Representative, James Mayerl The following business was transacted: I hereby certify that pursuant to a notice dated April 9, 1984, and duly pub- lished May 3, 1984, in the La Salle Leader, a public hearing was conducted to consider the application of Karen Keel for a Use by Special Review for a dog ken- nel. Lee Morrison, Assistant County Attorney, read this request into the record. Jim Mayerl, Planning Department representative, read the recommendation of the Planning Commission into the record. The applicant stated that she proposes to build four indoor-outdoor runs, two indoor runs. She shows and travels with her dogs and does not use them for any commercial activity. She will provide security tar_ her dogs by fencing the area. Ms. Keel stated the dogs will be kept inside whenever she is gone and throughout the night. She presented a picture to the Board and described the Rottweiler dogs as being medium to large dogs originally bred as herding dogs. Veronica Bilger stated that she had read in the American Kennel Club book that the dogs originated as guard dogs. Kathie Lashaway pre- sented letters from Linda and Jerry Merks and Linda Chambers who were unable to attend this hearing. Ms. Lashaway further stated there are already two kennels in Casa Grande Estates and she and her husband are opposed to further dog kennels in the area, citing noise and declining property values. Patricia Heese stated that there are ten young children in the neighborhood. Veronica Bilger again came forward to make further comments. The applicant stated that her application is for only eight dogs and she would be allowed to have four dogs without the Use by Special Review. Commissioner C. Carlson commented that if the Board chooses to grant this request, the permit should be only for the applicant and not go with the property. Mr. Morrison stated this is contained in Operation Standard #2, however, the word "and" should be deleted and replaced with the word "in" in this Operation Standard. Commissioner Martin commented on the fact that dogs in kennels must be controlled, and many problems are created by dogs running loose. Ms. Lashaway said they have complained about dogs in the area before and nothing seems to be done. Mr. Mayerl stated that the Planning Department and the Health Department will enforce the Operation Standards if o complaints are received. Commissioner C. Carlson moved to approve the Use by Special Review requested by Karen Keel, including the Operation Standards, with Operation Standard #2 amended as requested by Mr. Morrison. Commissioner Johnson seconded the motion, stating that this neighborhood is open and rural in nature and a dog kennel would be com- patible with the neighborhood and that the Operation Standards provide adequate protection. Commissioner Brantner urged the neighbors present to call if the Operation Standards are not adhered to• The motion carried unanimously. Com- missioner Brantner further questioned the procedure which would be followed if a complaint would be received. May 15, 1984 Commissioners : Since you the commissioners issued a permit for a dog kennel to Debbie Zubco, you have set a preference for each and everyone of us out here in Casa Grande Estates to have one. You have no regard or compassion for the homeowners in this area. We do not want or need another dog kennel in Casa Grande Estates, because all of the homes here are in close proximity of each other. We are sick and tired of paying Weld County taxes and then having no say in what goes on in our neighborhood. I live within five hundred feet of the Zubco kennel and I have to put up with the howling dogs and the smell, thanks to you, the commissioners. I just wish that one of you had to put up with all this mess that we do. We just want to live in a quiet and peaceful neighborhood like it was seven years ago. The neighborhood out here has literally gone to the dogs since you issued the Zubco kennel permit. And also, even though I do not live within five hundred feet of the proposed kennel, we will still be able to hear the dogs because sound carries out here. Animal wastes shall be removed at least daily from the kennel and stored in an enclosed container. The waste shall be removed on a weekly basis. 4. All dogs shall be kept inside the house from 10:00 p.m. until 6:30 a.m. Dogs may be permitted outside between the hours of 6:30 a.m. to 10:00 p.m. only when the owner is home. 5. The drainage system from the dog run area shall be constructed per the Weld County Health Department recommendation. Either a 200-300 gallon treatment tank and small trench shall be built on the west side of the back yard to hold the waste water from the dog run area or a drain shall be installed that runs along the back inside wall of the runs and along the outside of the outdoor runs with the end of the pipe extending fifty (50) feet or more from the septic tank and leach field. 6. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 7. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 8. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Development Standards stated hereon and all applicable Weld County Regulations. 9. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Most, if not all, homes are set up for the keeping of horses or livestock. The closest residence, 9712 Sierra Vista Rd. , appears to be approximately 300 feet away. This residence has two horse corrals and a dog house/pen setup. Because the proposed kennel is much lower due to slope conditions , I feel the kennel site would pose no noise or odor problems to this residence. No residence appears to be close enough in proximity for noise or odor complaints, and the area of the kennel is shielded by fencing and Lombardy Poplar trees. I foresee no problem in maintaining a kennel on this property, and it should not cause any problems with neighbors or other animals . The first part shows that this proposal is consistant with the existing land uses and the second part explains my plans and background. This use is being asked for in an area that is currently a "country" suldivision. It is in an agricultural zone district but with residential use. The surrounding area is "country" residential which includes acreages with room for animals. Those adjacent to the one I propose to buy are current- ly used for horses, goats, dogs, rabbits, and chickens. Though zoned agricul- turally, the property does not sit in an agricultural area so as to interfer in any way with agriculture. Due to the landscaping and improvements I intend to make, I feel this will only increase and imprrove the risen. and not c•a.nse a detriment in any way. The use I am appling for is for the purpose of establishing a small breeding; and training kennel for my private use. There would be no outside hoarding and all dogs on the property would be mine.Any money made from the selling of puppies or adult dogs would be used to support the dogs and for show traveling. I do not intend to derive a profit as a means to support myself as I enjoy and use them as a hobby to relax with. I am interested in improving the breed and working toward this goal. I have been training and showing dogs approximately eight years as a hobby. I also run obedience classes for the Westminster Parks and Recreation for the last three years. All the properties adjacent to the proposed area are separated by land used for animals. The runs themselves, I propose to come out from the back of the house. The house has a walkout basement with a deck on the upper level. The runs would sit directly under the deck. (see picture) I am proposing to build six runs. Four of the runs would he twenty three feet long with six feet on the inside and seventeen feet on the outside. The other two (due to the location of the septic ) would be inside runs of six square feet. (see picture) The inside and outside of the runs would be enclosed in chain link with a cement floor and chain link and a cement wall will he used to separate the runs. The runs would be seven feet in height with the bottom four feet being cement and the top three feet being chain link. A stainless steel door on runners would be used to allow the dogs in and out. Drainage would be provided inside and out. A drain would run along the the back inside wall of the runs and along the outside of the outdoor runs with it then draining into an area just behind the septic tank. Florescent lighting would be installed on the inside and an exhaust fan would be used for ventila- tion. Heat would be provided by ducting out from three heat vents located just inside the basement level of the house. A water faucet already exist as a means of providing water. A six foot privacy fence would then enclose the entire back- yard area.The entire project will take approximately eight to twelve months to complete. The runs would be cleaned daily. Waste would be picked up twice a day and the runs would be hosed down daily. The waste would be put in a plastic bag,secured tightly, then placed in a closed recepticle. It would be removed from the property weekly. Flys would be controlled through cleanleness and spraying as needed. Veternary care would be provided by my own vet. She is a mobile vet and would administer all shots and check the animals annually or as often as needed. The dogs I intend to breed are rottweilers. Rottweilers are large dogs usually weighing about eighty-five to ninety-five pounds. They are great family dogs as well as good protectors. Their temperment is confident and out- going. They are good with kids as well as adults. Due to their va'ue, montary and personal, and as a means of noise control, they would only be in the out- side run when I am home. I plan to have only six to eight dogs on the property. This is because of the fact that they mature slowly (two to three)their prime showing time for obedience is after three years of age. So in order to have a dog to work with it is necessary to have them at different age levels. Example) I have a poppy(11/2 years) I am just starting with, two female adults I will show this year and a young puppy that I showed young(six months) and now will wait till she grows out to continue her. Plus if a dog does not work out for some reason or dies then I will always have one to work with so I am constant- ly showing and will not have any year that I can not. The runs are necessary to keep the dogs separated due to personalities (not all dogs get along), heat cycles, and for puppies. Buyers for the dogs would be found through advertisements in the local papers. No signs would be posted on the property. Since I only propose to breed two or three litters a year, vehicular traffic would not be signifi- canly increased in the area. I intend to clean up, fence, grass, and plant trees on the entire property as a means of improving it. The house would also be cleaned and up- dated. I would be willing to have the operation cease should I sell the pro- pery. As far as I am conce- rned the Weld County Commissioners office have no regard or compas- sion for the home owners who object to having a dog kennel in their neighborhood. I feel that a permit for a dog kennel should not be issued to individuals in such a populated area as we have out here with the homes being so close together. A permit should be issued to indi- viduals only on five acres or more. Maybe then the barking and ev- erything associated with a kennel would not interfere with the liv- es of everyone else in the neighborhood.
