We understand that in order to do this work a Division of Minerals and Geology permit for reclamation is required. It is our understanding that the pond reclamation will have no negative effect on our utility or any significant, valuable, and permanent manmade structure located within two hundred feet of the affected land. It is also our understanding that the Operator of the site, Siegrist Construction Company, is ultimately liable for operations pertaining to the reclamation of the ponds, Carma (Colorado), Inc. agrees to compensate any damage to any utility's structure, should such damage occur. Adequacy Review Response Job No. 3811-DMG Dear Deb, This letter addresses the items in the Division of Minerals and Geology (DMGI's Second Adequacy Letter dated July 6, 2006. Meurer & Associates has been authorized by Siegrist Construction Company to process an amendment of the existing DMG permit referenced above. The amendment includes construction of a slurry wall around existing gravel pits so that the pits can be used as a recreational amenity and storage facility for a proposed community to be constructed by Carma (Colorado), Inc. • The community, zoned as St. Vrain Lakes in Weld County, is now called Bayshore. The following responds to your Second Adequacy Review Letter, in the same order as your comments: 1 . Due to the addition of riprap and geotextile fabric along the ponds' southern berm, the DMG has required the applicant to re-publish and re-notify adjacent owners of the permit amendment. Republishing occurred on July '13, 20 and 27, and on August 3, 2006. Notifications have been sent out to the entities listed on the attached listing. Also attached is the Affidavit of Publication from the Longmont Daily Times. Tab 1 2. Notarized letters from utilities within 200 feet of the proposed riprapped berm are being processed. The DMG comments are provided below in italics. 1) The Applicant states that they have submitted a revised copy of the Storm water Management Plan, however the copy submitted appears to be the same version that was sent with the original application. Did the Applicant intend to send a revised stormwater management plan? Please clarify. Also, In the adequacy comments the Division refers to Stormwater Management Plan maps not the Stormwater Management Plan itself Were maps submitted, and if so, which maps should the Division refer to? If not, the Applicant will need to submit the maps requested. Please clarify. We have enclosed revised Stormwater Management Plan (SWMP) maps that are intended to cover the lake reclamation activities only. The grading activity associated with the adjacent development is covered under a separate SWMP map. However, since both projects are closely related, we have illustrated some of the BMP's from the development project on the lake reclamation maps. These particular BMP's consist of sediment basins and are noted on the lake reclamation SWMP maps as being part of the development project and are not a requirement of the reclamation project. These sediment basins will serve to capture sediment from the adjacent development upon the completion of the lake reclamation. The sediment basins will be removed at such time the disturbed development area has been re-vegetated. 3) The applicant has specified that the velocity and volume of flows expected on site from a 100-year flood event, as well as the elevation of the 100-year base flood event and its relation to the elevation of the spillways and lakeshore berm is provided in the Conditional Letter of Map Revision (CLOMR) previously submitted. Please clarify where in the CLOMR this information is located, or provide if not previously submitted. Also, please quantify or characterize the expected groundwater surface between the stream channel and the adjacent floodplain to the north under such an event. We have attached excerpts from the CLOMR report to identify the velocity, flow, and 100- year base flood elevation within the lakes, along the river and at the spillways. We have Memo-Lkwd.2005 also included a Spillway Location Map that identifies the location and 100-year flow rate for each spillway. A Post-Project Conditions Work map is also provided. This map identifies the location of HEC-RAS cross-sections, as well as the 100-year base flood elevations within the lake area and along the river side of the embankment. The question regarding the expected groundwater surface is addressed separately in the Memorandum by Don Frick of the Applegate Group, Inc. dated August 8, 2006. 4) The applicant has proposed installation of three (3) spillways along the riverside of the reclaimed pond embankment(s) during final reclamation. Please specify where in the CLOMR document the Division may find the criteria used to determine the number of spillways to install in the reclaimed lake(s) and the spacing between spillways. Since the reclaimed lake and slurry wall installation will be adjacent to a reach of the St. Vrain River that is over 1 mile in length, the applicant will need to verify the number of spillways needed and the spacing interval needed to ensure that floodwaters from a 100-year flood event will be discharged back safely to the main channel of the St. Vrain River within a reasonable period of time and also maintain the structural integrity of the slurry wall installation as well as the surrounding area. Please respond. HEC-RAS software was used to develop and define the spillway requirements within the reclamation area. An existing conditions HEC-RAS model was prepared to determine where the 100-year flood currently overtops the embankment area. This existing conditions model also determined the flow rate at each of these locations. We then created a post-conditions HEC-RAS model based on anticipated grading activities, which included spillways in each of the historic overtopping locations. The spillways were located and sized to pass historic flow rates as determined in the existing conditions model. Based on our modeling, three inflow spillways (lateral weirs) are proposed along the river embankment and two in-line spillways are proposed within the lake area. Each of the spillways is defined on the enclosed Spillway Location Map. An in-line spillway is located between the two lakes, as well as at the east end of the large lake. These in-line spillways are sized to convey the inflow floodwaters from the St. Vrain River along with any inflow storm flows from basins north of the lakes. Therefore, the spillways were modeled and sized to not attenuate inflows from exiting the lakes and returning to the St. Vrain River. The HEC-RAS post-conditions model demonstrates this condition. The enclosed excerpts from the CLOMR labeled as "Reach Within River" and "Reach Within Lakes" tabulate the 100-year flows, velocities and elevations at each modeled cross-section. We have also identified the location of each in-flow spillway on these tabulations for your reference. 7) In conformance with Rule 6.4.12(1), please provide material quantities and itemized costs for the following items pertaining to the embankment stabilization: • Volume of backfill & grading needed to reconfigure the existing pond/riverside embankment • Surface area of synthetic filter fabric needed beneath riprap • Volume of imported riprap (Type L) needed • Cost for project supervision (registered P.E. or other qualified person) • Cost for compaction or finish grading embankment, if necessary • Cost for filter fabric • Cost for importation of 12"diameter riprap • Cost for placement of Type L riprap • Cost for placement of 12"diameter riprap We have revised the itemized cost estimate to include the items requested above. 8) Please clarify the status of the applicant's mapping of jurisdictional wetlands within or adjacent to the affected land, and the status of their 404 Permit application with the US Memo-Lkwd.2005 Army Corps of Engineers (COE), particularly with respect to the proposed plans for fill of several or more wetlands within the permit area. Please affirm whether the applicant has notified the COE of the proposed bank stabilization project and has submitted a copy of the proposed stabilization plans for their review. Also, please provide a copy of any written responses received from the COE verifying whether a 404, Nationwide or other COE permit is needed for any of the applicant's proposed activities. Please respond. This comment will be fully addressed under a separate response by Denise Larson of ERO Resources Corp, along with correspondence with the COE. However, this project has filed for and received a Nationwide Permit for our anticipated wetland/waters of the US impacts. Jurisdictional wetlands and Waters of the US were delineated by ERO and acknowledged by the COE prior to when the Nationwide Permit was issued. Impacts are limited to the jurisdictional wetland area that lies east of our development area. The construction activities associated with the reclamation work do not impact the wetland/waters of the US areas. In the previously referenced letter, several items were outlined which required clarification/additional information. This current report addresses item nos. 2, 5, and 6 (restated below from referenced July 5, 2006 letter by DMG). 2. The "Supplemental Geotechnical Engineering Report" prepared by Terracon in Amendment Application submittal indicates that the slurry cut-off walls should be "keyed"or "socketed"into the relatively impermeable competent/intact claystone or sandstone bedrock to reduce groundwater seepage. The report further states that supplemental coring and packer permeability testing in the areas of Boring Numbers 45, 47, and 48 indicated that the upper 5 to 10 feet of the sandstone layer was moderately to severely fractured and that "keying" or "socketing" into this type of sandstone bedrock could result in excessive seepage losses, and that deeper keyways for the slurry cut-off walls will likely be required in this area. In response, the applicant has provided assurances that the slurry wall will be keyed into a competent layer or equivalent using excavations and grouting if necessary, and indicates that a geotechnical engineer will be onsite to determine when adequate key materials were penetrated. Please commit to providing the Division with a copy of the QaQc Specifications for the Slurry Wall Installation currently being prepared by Terracon. Also, there are certain locations of the slurry wall installation where underground utilities run along or run perpendicular to the slurry wall. Will the presence of the utilities impact the structural integrity of the slurry wall? Are there risks to the utilities during the installation of the slurry wall? What steps will be taken to ensure problems from occurring. Please respond. 5. Please commit to providing an "As Built" certification from a registered, professional engineer or other qualified person within 60 days of completion of the embankment stabilization project that the embankment stabilization has been completed according to the approved designs so as to provide adequate protection against a bank-full stream flow event or from floodwaters resulting from a 100-year flood event, whichever is greater. Also, the applicant will need to commit to providing revised maps and engineering design for any significant changes required due to unforeseen field conditions. Please respond. 6. The applicant has specified two (2) distinct scenarios for the height of riverside embankment to receive riprap installation, and these scenarios are based on the proximity of the St. Vrain River to the existing ponds. Please clarify the criteria that the applicant will use to differentiate when each treatment will be applied, and please commit to providing riprap armoring or other slope protection measures for any riverbank location that is not currently stable from either vegetation or existing riprap or concrete installation. Based on these concerns/comments, we submit the following clarifications/responses: 2. In response to the DMG concerns, the applicant commits to providing QaQc specifications to the DMG to be implemented during slurry wall construction prior to beginning construction of the slurry wall. The quality control (Qc) will be provided by Geo-Con (slurry wall contractor) and Terracon will provide quality assurance. The quality assurance (Qa) plan will consist of providing confirmatory testing to compare to the Qc testing in accordance with local or other recognized standards for slurry wall construction. The specific testing to be performed will be in general accordance with the recommendations outlined in the "Guide to Specification Preparation for Slurry Walls and Clay Liners as a Component of a Colorado Mined Land Reclamation Permit" prepared by DMG dated September, 2000. The report gives a general outline of the specific tests to be performed, testing frequency, and other design criteria. In response to utility impacts, the applicant has performed field verification including non-destructive "pot-holing" in order to locate the existing utilities. Coordination has been performed with each of the utility owners in order to avoid 2 Clarification/Response to "2nd Adequacy Review Comments" prepared by DMG Terracon Bayshore Development —Weld County, Colorado Terracon Project No.25045300 conflicts and to inform the utility owners of the proximity of the slurry wall. The utilities do not pose a hazard to the structural integrity of the slurry wall provided that the utilities which cross or intersect wall are properly located and protected prior to/during slurry wall construction. As previously outlined, a reasonable degree of care has been taken to locate these utilities in the field. Prior to construction of the slurry wall, any utilities which intersect the wall will be located, protected with a suitable sleeve, and care will be taken as necessary to avoid damage. Backfill consisting of bentonite will be placed around the sleeved utilities in order to prevent leakage around the perimeter of the protected utilities through the slurry wall. Placement and installation of the utilities will be observed prior to backfill of the slurry trench by a representative of the contractor and by Terracon. 5. As requested by the DMG, an "as-built" certification prepared and sealed by a professional engineer will be submitted within 60 days of completion of the embankment stabilization indicating that the work has been performed in accordance with the approved design and specifications which were developed to provide adequate protection against a bank-full stream flow event or from floodwaters resulting from a 100-year flood event, whichever is greater. Any change to the engineered design due to unforeseen conditions in the field will be documented and provided to the DMG in the form of revised maps and engineering designs (if applicable) and incorporated into the "as-built" plans. 6. It is important to note that a distinction should be made between the "river embankment" and the southern "lake embankment" edge. Only in a few cases does the river embankment become an extension to the bottom of the southern edge of the lake embankment (during normal flow conditions). This is due to the - fact that the river flows "touches" or is directly adjacent to the lake embankment in these areas (during normal flow conditions). As shown on the information/mapping previously provided to the DMG, armoring of the existing river embankment will only be performed in areas where the river flows will contact the southern lake embankment edge during normal flow conditions. In these areas, existing concrete erosion materials are currently in place, and it is our opinion that these materials will be sufficient to resist undercutting of the base of the embankment edge. Therefore, the new rip rap protection will be placed up to (and keyed into) the existing protection within the St. Vrain river channel as shown on the previously submitted plans. During this work, the applicant will not encroach upon the "Waters of the U.S." designated area. In all of the other areas along the lake embankment in which the St. Vrain River does not encroach the "lake embankment" edge during normal flow conditions 3 Clarification/Response to "2"d Adequacy Review Comments" prepared by DMG Terracon Bayshore Development —Weld County, Colorado Terracon Project No. 25045300 (100-year flood event only), the "lake embankment edge" will be protected with rip rap and graded to a 2 1/2 to 1 slope as indicated on the plans in order to protect the "lake embankment" edge from erosion during the 100-year flood event when the lake embankment will serve as the edge of the river channel. In these areas, the newly placed riprap erosion protection will by keyed into the subgrade at the base of slope in contrast to the other scenario in which the new rip rap erosion protection was keyed into the existing concrete armoring along the river edge. It is our opinion that the areas of the St. Vrain river channel which are not encroaching (either touching or directly adjacent) upon the existing/proposed lake embankment edge appear to be stable without modification either from existing concrete erosion protection or from established vegetation and/or riparian areas. Furthermore, the addition of the slurry wall/lake embankment will not encroach, disturb, or impact these areas. Therefore, further improvements or alteration of the existing river channel will not be performed in these areas, and is not addressed herein. The applicant commits to having a responsible person on site to observe/direct the placement of the erosion control/stabilization measures in order to assess proper placement of materials and that the construction meets the intent of the designer. As previously outlined in Item No. 5 above, an "as built" certification will be provided to the DMG within 60 days of the completion of the work. Specifically,the following is in response to the comments provided by Tom Schreiner in a letter to Ms.Gonima dated July 5,2006. For clarity,I have provided DMG's comments followed by our respective responses. 3.b. Revised Map— The applicant will need to provide a revised copy of the Tab 14 Map ("Lake Reclamation Exhibit") which shows the locations of proposed groundwater monitoring stations and the location(s) of where mitigation measures such as perimeter drains will be installed A map showing the locations of the ground water monitoring stations and the locations of the perimeter drain will be provided to the DMG on a separate exhibit 3.c. Baseline Data—The applicant has proposed to use the existing lake water levels as baseline water elevation. Please provide existing lake water surface data and a discussion of how the applicant will collect a set of baseline water levels, prior to slurry wall installation, that are representative of the existing groundwater levels in the area. Such determination will need to be representative of either a "worst case"scenario or the full range of natural groundwater fluctuations expected during the course of a 12 month period The existing lake water levels were shown on the"St Vrain River and Existing Lake Cross Sections"drawing included in Tab 13 of the First Adequacy Review response package. The surface elevation of the eastern lake,around which the proposed monitoring wells will be placed,is 4818 feet. With the construction of the monitoring wells, and with monthly monitoring of the water levels prior to construction of the slurry wall,additional baseline data will be available. The range of elevations between the existing lake surface elevation of 4818 feet, and monthly measurements of water table elevations at the monitoring wells prior to construction of the slurry wall will provide adequate base line data which to compare measurements following construction of the slurry wall. The use of the existing lake surface elevation and the data from the monitoring wells prior to construction of the slurry wall should be sufficient to establish the "worst case"scenario. 3.d Trigger Criteria — The applicant has proposed a "trigger" of three (3) feet beyond natural baseline elevations for determining when mitigation measures will be implemented. Please discuss how this criteria was determined, and whether this criteria is adequate to ensure no adverse impacts to structures to the west of the slurry wall, such as the CDOT bridge foundations. (The Division request that the applicant use a trigger criteria that provides enough sensitivity to determine when adverse groundwater conditions may be occurring at or near a nearby,permanent man-made structure). The proposed three-foot trigger is adequate to protect existing structures. The only known existing structures located to the west and north west of the slurry wall which might be impacted by mounding of ground water up-gradient of the slurry wall are the existing roads (US Interstate 25 and the Frontage Road). The existing elevations of the road bases are at an elevation of approximately 4830 to 4835 immediately west of the east lake — over 12 feet above the existing surface elevation of the lake. Thus,implementing the proposed mitigation measures at a trigger elevation of three feet above existing water levels will more than adequately protect the existing structures. 1499 West 120th Avenue, Suite 200 • Denver,Colorado 80234-2728 • (303)452-6611 • Fax: (303)452-2759 • With respect to the specific concerns about CDOT bridge foundations, the supports that are not currently in the St. Vrain River itself(i.e.,the abutments on the north bank of the river), are located down-gradient of the slurry wall alignment. As described in our memorandum dated June 7,2006,the ground water flow in the area is generally from the west-northwest. The nearest bridge supports are located roughly 250 feet to the southwest of the slurry wall alignment. Further,the bridge supports are located at an elevation of over 10 feet above the existing water surface elevation of the east lake. Thus, even if mounding does occur in the vicinity of the bridge supports,the impacts will be mitigated at the proposed 3-foot trigger,well before the mounding ever reaches the elevation of the bridge supports. 3.f Representative cross sectional diagram — Please provide a representative cross-sectional diagram of a typical monitoring well installation. Please note that piezometers may be adequate for measurement of groundwater monitoring levels. Attached with this memorandum is a representative cross-sectional diagram of a typical monitoring well installation. 3. The applicant has specified that the velocity and volume offlows expected on site from a 100 year flood event, as well as the elevation of the 100-year base flood event and its relation to the elevation of the spillways and lakeshore berm is provided in the Conditional Letter of Map Revision (CLOMR) previously provided Please clarifil where in the CLOMR this information is located, or provide if not previously submitted Also,please quanta or characterize the expected groundwater surface between the stream channel and the adjacent floodplain to the north under such an event. The question regarding the CLOMR will be addressed separately. With respect to the ground water'surface'between the stream channel and the adjacent floodplain to the north under the 100-year flood event, changes to the ground water flow or elevation of the ground water table will have little or no impact on surrounding structures relative to the effects of the flooding. In the worst case scenario,the 100-year flood event may temporarily completely saturate the ground in the floodplain north of the river. In May 2004, ERO Resources Corporation (ERO) delineated wetlands at the Bayshore Development site. The Corps accepted this delineation on September 30, 2004 and provided a jurisdictional determination for the wetlands and other waters. Attached are the Corps' wetland delineation acceptance letter and a figure showing the locations of wetlands and other waters. As stated in the Corps' letter, the Corps took jurisdiction over the wetlands adjacent to the St. Vrain River and the water within the river(W10, W11, and W/WUS 12), and wetlands fringing the south side of the gravel lakes (W9). The Corps did not take jurisdiction over the three gravel ponds (open water of the ponds adjacent to the St. Vrain Creek). Because the gravel ponds are currently under an active mining permit, I called Mr. Terry McKee of the Corps on June 1, 2006 to clarify the status of the wetlands fringing the gravel ponds (W9). Mr. McKee stated that the wetlands associated with the gravel ponds (W9) are not under the Corps'jurisdiction as long as the area is under an active gravel mining permit. Wetlands adjacent to the St. Vrain River(W10, W 11, and W/WUS12) are jurisdictional and would require a Corps' permit for any filling of wetlands. As requested by the Colorado Division of Mining and Geology (DMG), attached is a letter sent to the Corps requesting a written confirmation that the proposed bank stabilization of the Siegrest pits would not impact current jurisdictional wetlands. This site is located in Sections 25, 35, and 36 in T3N, R68W,in Zone 13,448750mN, 504000mE,in Weld County. To protect the proposed gravel ponds,riprap with geotextile fabric would be placed outside of the jurisdictional wetlands and other waters of the U.S. as shown on the attached St. Vrain Lakes Embankment Section. The boundaries of wetlands and other waters of the U.S. are based on ERO Resources Corporation's (ERO)delineation of May 2004, which was accepted by the Corps on September 30,2004 (#200480464). As part of the planning process, ERO flagged the wetland boundaries on May 25, 2006. No jurisdictional wetlands or other waters of the U.S. would be affected by the proposed bank stabilization. An accurate measurement of acreage for the developing wetlands mitigation site. 1 2.6. If the work authorized for the project has not started or the mitigation has not been completed prior to the expiration date of this verification letter,please state this as your annual mitigation monitoring report. 3. After the mitigation area has been successfully established,and before final release from all mitigation monitoring and reporting requirements,the permittee shall place a conservation easement(approved by the Corps of Engineers),on the mitigation area and file it with the Weld County Clerk and Recorder or appropriate office.
