HomeMy WebLinkAbout20062602 HEARING CERTIFICATION DOCKET NO. 2006-62 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1561 FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING AN OIL AND GAS SUPPORT AND SERVICE FACILITY,IN THE A(AGRICULTURAL)ZONE DISTRICT - STREAR FARMS COMPANY, C/O DUKE ENERGY FIELD SERVICES, INC. A public hearing was conducted on October 4, 2006, at 10:00 a.m., with the following present: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tern - EXCUSED Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Kim Ogle Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated September 15, 2006, and duly published September 20, 2006, in the Fort Lupton Press, a public hearing was conducted to consider the request of Strear Farms Company, do Duke Energy Field Services, Inc., for a Site Specific Development Plan and Use by Special Review Permit#1561 fora Mineral Resource Development Facility, including an Oil and Gas Support and Service Facility,in the A(Agricultural)Zone District. Cyndy Giauque, Assistant County Attorney, made this a matter of record, and advised the applicants'representative,Patrick Groom,Witwer,Oldenburg,Barryand Johnson,LLP,that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Long will listen to the record and make the determining vote. Upon conferring with the applicant, Mr. Groom indicated they would like to continue the matter to another date. He explained the surrounding property owners expressed various objections at the Planning Commission hearing, which the applicant is working to resolve, and they want a full quorum in attendance when they present the application. In response to Chair Geile, Esther Gesick,Acting Clerk to the Board,advised the Board that the next available hearing date is November 8,2006. At the requestofa member of the public,the Board and the applicant agreed to move the continuance to November 22,2006; however,Mr.Ogle indicated he will not be present and a substitute Planner will have to attend. In response to another member of the audience, Ms. Giauque advised that testimony should not be received today, but rather when the case is presented on the future date. Mr. Groom stated the applicant prefers Mr.Ogle be present for the hearing,therefore, Ms. Gesick indicated the next available hearing date is December 6, 2006. 2006-2602 P Pal) , / PL1855 HEARING CERTIFICATION - STREAR FARMS COMPANY, C/O DUKE ENERGY FIELD SERVICES, INC. (USR#1561) PAGE 2 • Commissioner Vaad moved to continue the request of Strear Farms Company, c/o Duke Energy Field Services, Inc.,fora Site Specific Development Plan and Use by Special Review Permit#1561 fora Mineral Resource Development Facility,including an Oil and Gas Support and Service Facility, in the A(Agricultural)Zone District,to December 6,2006,at 10:00 a.m. The motion was seconded by Commissioner Masden, and it carried unanimously. There being no further discussion, the hearing was completed at 11:45 a.m. This Certification was approved on the 9th day of October 2006.
