RESOLUTION
RE: DENIAL OF REQUEST TO INSTALL SPEED BUMPS AT SPANISH COLONY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 20th day of September, 1982, the Board re-
viewed a petition submitted by certain residents of the Spanish
Colony requesting that speed bumps be installed in their neigh-
borhood, and
WHEREAS, the Board deemed it advisable to refer this matter
to the Weld County Engineering Department for their recommenda-
tion, and
WHEREAS, after study and review, the Department of Engin-
eering has submitted a recommendation for denial concerning the
installation of speed bumps at the Spanish Colony, and
WHEREAS, said recommendation for denial is based on the fact
that the installation of such speed bumps could legally place
Weld County in a potentially libelous position.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request to install
speed bumps at the Spanish Colony be, and hereby is, denied.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of
October, A.D. , 1982.

This is in response to the petition you and others submitted to the Board of Weld
County Conmissioners requesting speed bumps to be installed on the streets of your
neighborhood. It was submitted to the Board on September 20, 1982, and discussed
in a work session on September 27, 1982.
Courts of law have consistently given the opinion in their consideration of libel
suits, that the placement of any obstacle in a public roadway that has the po-
tential to create a hazard is improper, The County cannot place itself in a
' potentially 11helous position by installing speed bumps or dips to control speeding
traffic. Therefore, it was my recon¢rendation and the Commissioner's decision that
your request for speed bumps not be approved.
We understand your concern for safety in your neighborhood. The proper remedy for
your problem is the enforcement of traffic laws by the proper authorities. I am
sure that if you contact the Highway Patrol or the Weld County's Sheriff's office,
they will work with you on this natter.
