USES LOCATED ON TRACT A- DON AND LINDA OWENS
A public hearing was conducted on November 1, 2006, at 10:00 a.m., with the following present:

Commissioner David E. Long, Pro-Tern
Commissioner William H. Jerke

Commissioner Glenn Vaad
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated August 11,2006,and duly published August 16,2006,
in the Fort Lupton Press, a public hearing was conducted on August 30, 2006, to consider the
request of Don and Linda Owens for a Site Specific Development Plan and Planned Unit
Development Final Plan,PF#521,for 19 lots with E(Estate)Zone uses,along with 15 acres of open
space, in addition to 36 acres of open space and equestrian uses located on Tract A. At said
hearing, the matter was continued to September 27, 2006, and then to November 1, 2006. On
November 1,2006, Bruce Barker, County Attorney, made this a matter of record, and advised the
applicant's representative,Steven Janssen,that he has the option of continuing this matter to a date
when the full Board will be present. However, if he decides to proceed today, it will require three
affirmative votes, or in the case of a tie vote, Commissioner Masden will listen to the record and
make the determining vote. Mr.Jansen indicated he would like to proceed today,and explained the
applicant is requesting an indefinite continuance of this case due to various issues that need to be
resolved.
Kim Ogle, Department of Planning Services, stated the applicant has been diligently pursuing the
outstanding issues, and staff supports the request for a continuance. No public testimony was
offered concerning this matter.
Commissioner Jerke moved to refer the request of Don and Linda Owens for a Site Specific
Development Plan and Planned Unit Development Final Plan, PF#521,for 19 lots with E(Estate)
Zone uses,along with 15 acres of open space,in addition to 36 acres of open space and equestrian
uses located on Tract A, back to the Department of Planning Services. The motion was seconded
by Commissioner Long,and it carried unanimously. There being no further discussion,the hearing
was completed at 10:10 a.m.
