RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST CINTHIA, KEVIN, BRIAN AND CHRISTOPHER BEAMAN FOR
VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Cinthia, Kevin, Brian and Christopher Beaman, VI#0500327, are allegedly in
violation of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of April, 2006, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS,Cinthia and Kevin Beaman, property owners,were present at said hearing,and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until July 11, 2006, to allow adequate time for the property owners to remove the
mobile homes and remove all vehicles not currently registered to the occupants or owners, and to
maintain the screening on the site to bring the subject property into compliance and for an
inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0500327 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Cinthia,Kevin,Brian and Christopher Beaman to remedy the violation
of the Weld County Code, and any other persons occupying the properties, any persons claiming
an interest in the properties, and any persons acting in active concert with the identified parties,
with an instruction for delay of action upon such referral until July 11, 2006, to allow adequate time
for the property owners to remove the mobile homes and remove all vehicles not currently
registered to the occupants or owners, and to maintain the screening on the site to bring the
subject property into compliance.

REMEDY
To bring the property into compliance the following shall occur:

► All vehicles not currently registered or lastly registered to the occupants or owner shall be

RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

Dear Ms. Beaman & Mr. Beaman:
The property referenced above remains in violation of the Weld County Code. I have scheduled a
meeting with the Board of County Commissioners on April 11, 2006, at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property remains in violation of the
following Section(s) of the Weld County Code:
Chapter 23, Article III, Div 1 "A (Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.F "Mobile homes subject to the additional requirements of Article IV,
Division 3 of this Chapter."
Section 23-3-30.1 "Noncommercial Junkyard."
Section 23-3-40 "Uses by special review."
Section 23-3-40.G "Junkyards or salvage yards."
Section 23-3-40.R "Any use permitted as a Use by Right, an Accessory Use,or a Use by
Special Review in the Commercial or Industrial Zone Districts, provided that the property is
not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed
prior to adoption of any regulations controlling subdivisions. PUD development proposals
shall not be permitted to use the special review permit process to develop."

To bring the property into compliance:
➢ The 3r° mobile home shall be removed (sitting along the Western side of the property).
➢ During an inspection conducted on 11/17/05, I noted a 4th mobile home(which shall also
be removed from the property).
➢ As I previously indicated, my records indicate that a building permit was obtained to
connect the 2 (two) mobile homes (BC-0000849), but that the building permit was never
completed. Therefore,a new building permit application shall be completed and submitted
to the Department of Building Inspections.
➢ All commercial storage, staging and operations related to the operation of a commercial
scrap iron/salvage yard/commercial junkyard shall be removed or permitted. Since you
are located within a subdivision, I would recommend you speak to one of our "On-Call"
Planners. To better serve the public, we have 2 locations open. Our North office is
located at 918 10th Street, Greeley, Colorado. At North office, an "On-Call" Planner is
available, Monday thru Thursday from 7:30 a.m. - 11:30 a.m. Our Southwest office is
located at 4209 CR 24.5, Longmont, Colorado. At our Southwest office, an "On-Call"
Planner is available Monday thru Thursday from 12:30 p.m.-4:30 p.m. You do not need
to schedule an appointment, because individuals are seen on a sign in basis. Neither
office will have a planner available on Fridays for walk-ins. To better serve you, please
bring this letter with you.
During our office meeting on 10/25/05, I agreed to grant a 60 day extension after this initial 30 day
extension. Furthermore in November I agreed to grant you another 60 day extension to allow you time
to complete the following 4 (four) items:
1.) Complete and submit a new building permit application to replace BC-0000849 (to
connect the 2 mobile homes together) along with the fee of$736.75.
2.) Either relocate the mobile home to a new lot or complete and submit a building permit
application to Temporarily Store 1 (one) additional mobile home (the other one shall be
removed. The Weld County Code does not make allowances for multiple mobile homes.)
along with $75.00.
3.) Either relocate the mobile home to a new lot or complete and submit a Zoning Permit
for a Mobile Home to Temporarily Store 1 (one) additional mobile home (the other one
shall be removed. The Weld County Code does not make allowances for multiple mobile
homes.) along with $300.00.
4.) Fencing shall replaced or all derelict vehicle shall be removed from the property. No
new vehicles shall be brought onto the site. It is my understanding that you are in the
process of clearing out the derelict vehicles.
This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of
County Commissioners might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent properties
the business day before or as soon as possible to the above mentioned Violation Hearing date.

Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation including the action necessary

Bethany,
I do not know what you have done with this situation, but it is getting worse. They now have a mobile home parked out
along the road, the double wide is still sitting in the front yard, rafters are still standing in the front yard.
It appears that they are doing nothing. So, I am wondering what the process is? How long does a person have to take
care of a situation like this?
They are running a junk yard at this location, they use the street as if it were part of their property, blocking the road at
times when they are moving junk cars around.
We need your help with the situation.

Dear Ms. Beaman & Mr. Beaman:
The uses on the above described property are being considered as a zoning code violation of Sections of the
Weld County Code. Currently your property is in violation of the following Section(s)of the Weld County Code:
Chapter 23, Article III, Div 1 "A(Agricultural)Zone District"
Section 23-3-20 "Uses allowed by right."
Section 23-3-30 "Accessory uses."
Section 23-3-30.F "Mobile homes subject to the additional requirements of Article IV,
Division 3 of this Chapter."
Section 23-3-30.1 "Noncommercial Junkyard."
Section 23-3-40 "Uses by special review."
Section 23-3-40.G "Junkyards or salvage yards."
Section 23-3-40.R "Any use permitted as a Use by Right, an Accessory Use, or a Use by
Special Review in the Commercial or Industrial Zone Districts, provided that the property is
not a Lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior
to adoption of any regulations controlling subdivisions. PUD development proposals shall not
be permitted to use the special review permit process to develop."
Chapter 29, Article V11(7) Mobile, Manufactured or Factory-Built Home Permits."
Section 29-7-10 "Permit required."
Section 29-7-30 "Connection of two mobile or manufactured homes for human habitation."
Section 29-7-30.F "Construction and all required inspections shall be completed and
finalized within one (1) year from the date of issuance of the building permit."

To bring your property into compliance with the Weld County Code:
S. The 3rd mobile home shall be removed (sitting along the Western side of the property).
> As I previously indicated, my records indicate that a building permit was obtained to
connect the 2 (two) mobile homes (BC-0000849), but that the building permit was never
completed. Therefore, a new building permit application shall be completed and submitted to
the Department of Building Inspections.
➢ All commercial storage, staging and operations related to the operation of a commercial
scrap iron/salvage yard/commercial junkyard shall be removed or permitted. Since you are
located within a subdivision, I would recommend you speak to one of our"On-Call"Planners.
To better serve the public,we have 2 locations open. Our North office is located at 918 10th
Street, Greeley, Colorado. At our North office, an"On-Call"Planner is available,Monday thru
Thursday from 7:30 a.m. - 11:30 a.m. Our Southwest office is located at 4209 CR 24.5,
Longmont, Colorado. At our Southwest office, an"On-Call"Planner is available Monday thru
Thursday from 12:30 p.m. - 4:30 p.m. You do not need to schedule an appointment,

It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from
October 18, 2005, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the County
Attorney's Office for legal action.

➢ After completing substantial research of my case files and computer, I could not find a
completed building permit to join the 2 (two)mobile homes in which you are currently residing. I
did find a building permit(BC-0000849)which expired due to lack of inspections and therefore,
was never completed.
To bring this aspect into compliance a new building permit shall be completed and submitted to
the Department of Building Inspections.
>The operation of a scrap iron/salvage yard/commercial junkyard without the necessary zoning
permits. If it is determined to be commercial, simply screening it will not correct this issue.
To bring this aspect into compliance, I recommend you speak to one of our on-call planners to
determine which, if any applications might be able to assist you in correcting this violation.
