However, there is a conflict concern if a tower were to fall into PSCo's overhead electric facilities. The owner of the tower would be responsible and expected by PSCo to pay for all damages to PSCo's electric transmission line. At present PSCo has 180 foot fee owned right-of-way for their electric transmission line on the west and north sides of the proposed site for the towers. Also PSCo has a great concern for safety and to preventing injury, PSCo would like to remind the applicant that any activity near existing electric and gas facilities must be performed with PSCo approval. The applicant should contact PSCo's Engineering Department at 1400428-2121 (Builder's Call Line) regarding gas and electric service and/or any grading activities on or near existing facilities. Lupton, Colorado Mr. Freeman: This letter is to respond to your request to provide comments concerning the unlikelihood of a tall guyed tower collapse and in particular the expected debris field potential from such a tower collapse should the ERI 12' faced guyed tower be extended to 1459' AGL on the Ft. Lupton site. This structure is designed to be extended to this height and comply with the ANSI\TIA-222-G Standard for a 90 mph wind region, as a Class II structure. The professional opinions I offer are based upon my past experience and research work in the tower and insurance related industries. For the record my professional history includes engineering work from 1973 until 1990 for the Factory Mutual Engineering Association in which I had extensive experience in property damage loss investigations including collapses of buildings,tanks and towers for the"Factory Mutual Group"of insurances companies. From 1990 to date I have been in responsible charge of designing,fabricating and installing guyed and self supporting towers for Electronics Research, Inc., an antenna and tower manufacturing company. I have been a participating member of the TR14.7 Committee, which is responsible for developing/writing the ANSI/TIA/EIA-222 Standard entitled"Structural Standards for Steel Antenna Towers and Antenna Supporting Structures", since 1985. I am also chairman of the technical subcommittee for the ANSI/TIA-1019"Structural Standards for Steel Gin Poles Used for Installation of Antenna Towers and Antenna Supporting Structures"which is currently being revised to comply as a full construction standard for towers. EXHIBIT 1 _ Summary: Based upon my professional expertise in the field of tower engineering along with a review of past tower failures it is my professional opinion that: • This tower structure would be expected to fall in a zig-zag pattern with the majority of steel in the tower mast falling in an area within a radius of 450 feet around the tower base, with some scattered lighter debris extending to an area of up to 700 feet from the tower base. Any significant debris, other than small and relatively light parts and pieces,beyond this distance would be quite unusual and is not expected. • I do not expect guy lines to extend much beyond the outer guy radius defined by the outer set of guy anchors (approximately a 910 foot distance from tower mast base along guy paths and extending+/-40 feet from the centerline of guy paths. Tower Failure Potential: In researching broadcast industry tower failures, I have reviewed documentation, references,and have industry experience that includes around 240 structures, of which about 95%have been guyed structures. These towers have failed because of many factors including extreme winds,high wind in combination with ice, large accumulations of ice with low or no winds, construction errors,manufacturing defects, deterioration, vandalism, and airplanes or other objects colliding with the tower mast or their guys. Properly designed, constructed,erected and maintained towers, in which the integrity of each of these items can be verified through proper review and evaluation,have an extremely high reliability against collapse. I have designed and been responsible for fabrication of close to 1600 towers installed in the U.S. over the past 20 years and none of them have experienced a structural failure. This is not to say that towers cannot fail for reasons unrelated to design and fabrication, as I have stated above. I have yet to know of a tower designed to today's standards falling when exposed to statistically predictable wind and ice storm loadings. However, in cases of towers being hit by tornado like wind forces, or being directly in line with the maximum forces of hurricane winds,or exposed to extreme icing conditions failures have occurred. Tower failures will unfortunately continue to some degree of probability, in particular, in regions prone to these types of weather events. Fall Collapse Mode of Guyed Towers in General: The mode of failure of a guyed tower depends upon its actual geometry in relation to guy foundation layout, the strength of its mast and supporting guy wires, and the type of adverse loading conditions which cause failure. A typical tower is guyed with the outermost set of guy anchors a distance from the tower base ranging from 40%to 70%of the towers height. 2 When failure does occur, a guyed tower's mast typically folds back on itself. The top portion of the tower mast creates a greater wind resistance as it has to travel further in the same amount of time to reach the ground as the lower mast portion. Also, any remaining non-broken guys force the tower mast to fold and twist as it falls in a downward direction. The typical guyed tower mast is very flexible and vulnerable to buckling without support of its guys. So in the event of a falling guyed tower mast the result is simply a gross overload of mast leg compression strength,or the tensile strength of the tower mast splice bolt leg connections, resulting in mast buckling and failing in a folding configuration. While there are rare examples of towers with single anchor points in each direction collapsing similar to a chopped-down tree, I know of no guyed towers with double or triple anchor points(like in this structure)that fell straight out without some type of folding configuration. If two or more guy cable anchors are in a row in at least three directions it is virtually impossible for a commonly designed guyed tower mast to fall without folding back on itself. By code the factors of safety for the guys, their connections, guy anchors and their foundations are greater than those for the mast sections which helps force this folding of the mast situation should collapse occur. Section 33: Part of the N/2 Weld County, Colorado Dear Mr. Gathman: This letter is being sent to inform you that Kerr-McGee Oil & Gas Onshore LP ("KMG") holds valid and subsisting oil and gas lease rights in the captioned property. KMG's rights may be adversely affected by the Site Specific Development Plan and Amended Special Review Permit being proposed by Longmont Broadcasting LLC. KMG is submitting this comment and objection timely, in accordance with State of Colorado and Weld County's procedural requirements. KMG's recorded oil and gas leases are real property interests entitling it to produce oil and gas from the leased lands. The company has the right to produce from existing wells, to maintain, rework, recomplete, and fracture those existing wells to enhance production, and to drill new wells to produce oil and gas, in accordance with applicable Colorado Oil and Gas Conservation Commission regulations and Colorado Statutes. KMG's oil and gas assets have significant value, and the company is consequently concerned about any development, surface use, plan of use, HID, zoning or rezoning, or other action by the Weld County that would impair or preclude its ability to develop its property. KMG's preferred practice is to meet with surface owners and attempt to conclude a mutually acceptable surface use agreement. It is essential that such an agreement be in place before the Weld County approves the developer's application. However, as of this date, KMG and Longmont Broadcasting have not concluded such an agreement. Any future surface development plans should incorporate and designate lands to be set aside for mineral development and expressly provide protection for KMG's current and future well, pipelines, gathering lines and related oil and gas facilities and equipment. Weld County has a constitutional obligation to ensure that the property rights of mineral interest owners are accommodated in its land use planning process. Approval of any surface development plan that forecloses the rights of mineral owners may be a compensable taking.
