This site plan review is approved with the attached conditions:
1. Prior to recording the Site Plan Review plat, the applicant shall address the following to the
Department of Planning Services' satisfaction:
�� The Environmental Health Services Division was unable to locate a septic permit for the
septic system serving the existing structure. The septic system shall be reviewed by a
Colorado Registered Professional Engineer. The review shall consist of observation of
the system and a technical review describing the systems ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health Services
Division of the Weld County Department of Public Health and Environment. In the event
the system is found to be inadequately sized or constructed the system shall be brought
• into compliance with current Regulations. Evidence of their approval shall be submitted
to the Weld County Department of Planning Services. (Department of Public Health and

Commercial Zone District shall be covered. Land shall not be deemed covered if
it is used for growing grass, shrubs, trees, plants or flowers or if covered by

3� That portion of a lot in any Commercial Zone District which abuts a public or
�� private street right-of-way shall be landscaped for a distance of ten (10)feet,
measured at a right angle from the lot line towards the interior of the lot.

equipment, or materials when permitted shall be screened from public rights of-

� The applicant shall submit a Private Improvements Agreement according to policy
regarding collateral for improvements and post adequate collateral for all landscaping,
transportation (access drive, parking areas, etcetera) and non-transportation (plant
materials, fencing, screening, water, signage etcetera). The applicant shall submit to the
Department of Planning Services an itemized landscaping bid for review. The agreement
and form of collateral shall be reviewed by County Staff and accepted by the Board of
County Commissioners prior to recording the Site Plan Review piat. Or the applicant
may submit evidence that all the work has been completed and approved by the
Department of Planning Services and the Department of Public Works. (Department of

��� evidence of how the existing and proposed plant material will be irrigated. The existing
well 69526 cannot be used to serve the existing landscaping and or proposed plant

"2� The Site Plan Review Map shall be prepared in accordance with Section 23-2-

� The vicinity map shall be delineated on the plat in compliance with Section 23-2-
�« 160.V.6 of the Weld County Code, specifically iilustrating the parcel and

The dimensio�s of the parking stalls shall adhere to Section 23-4-30 and
Appendix 23-A of the Weld County Code. This site will be required to meet all
requirements of the American Disability Act (ADA). ADA parking spaces are
twenty (20) feet by eight (8) feet with five (5) foot aisles. A minimum of one
space must be van accessible with an eight (8) foot aisle. An accessible path
shall be required from the building to the public right-of-way. Further, the ramps
from the parking area shall identify a landing area for non-ambulatory users of

� The applicant shall show the type of lighting that will be used on site in

� The location and dimensions of any proposed signs per Articie IV Division 2 of

� Section 23-3-250.A.6 of the Weld County Code addresses the issue of trash
collection areas. Areas used for storage or trash collection shall be screened
from adjacent public rights-of-way and adjacent properties. These areas shall be
designed and used in a manner that will prevent wind or animal scattered trash.

� County Road 2.25 is classified by the County as a local paved road,which
�J requires 60 feet of right-of-way at full build out. The applicant shall verify the
existing right-of-way and the documents creating the right-of-way. If the right-of-
way can not be verified, it shall be dedicated. The plat shall delineate the existing
right-of-way and the documents which created it along with any additional right-

H. The following notes shall be placed on the plat:
1. All proposed or existing structures will or do meet the minimum setback and
offset requirements for the zone district in which the property is located.
Pursuant to the definition of setback in the Weld County Code, the required
setback is measured from the future right-of-way line.
2. In the event that a portion of the building is proposed to be leased or sold to
another party in the future, the applicant shall submit a copy of the lease of sales
agreement and information regarding the proposed use of the leased portion to
the Weld County Building Inspection Department, Brighton Fire Protection District
and the Department of Planning Services for review. Based upon the proposed
use and/or impacts of the leased portion, the Department of Planning Services
may require a new Site Plan Review application. (Department of Planning

3. All port-a-potties shall be stored in an enclosed structure/building per the Board
of Adjustments Determination BOA-1041 on August 1, 2006.
4. In accordance with the Weld County Code, no land, building or structure shall be
changed in use or type of occupancy, developed, erected, constructed,
reconstructed, moved or structurally altered or operated in the Commercial and
Industrial Zone District until a Site Plan Review has been approved by the

5. Ali liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100, C.R.S., as amended), shall be stored and removed for
final disposal in a manner that protects against surtace and groundwater

6. No permanent disposal of wastes shall be permitted at this site. This is not meant
to include those wastes specifically excluded from the definition of a solid waste
in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,C.R.S., as

7. Waste materials shall be handled, stored and disposed of in a manner that
controls fugitive dust, blowing debris and other potential nuisance conditions.

8. The applicant shall operate in accordance with the approved "waste handling

9. The facility shail adhere to the maximum permissible noise levels allowed in the
Commercial Zone District, as delineated in 25-12-103, Colorado Revised

10. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement

11. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems. (Department of Public Health

12. Adequate hand washing and toilet facilities shall be provided for employees and
patrons of the facility. (Department of Public Health and Environment)
13. The facility shail utilize the existing commerciaily permitted well. (Well # 69526
for 1 single office building) (Department of Public Health and Environment)
14. All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's)and volatile organic compounds (VOC's).

15. The operation/property shall comply with all applicable rules and regulations of
the State and Federal agencies and the Weld County Code. (Department of

16. A buiiding permit application must be completed, and two complete sets of
engineered plans bearing the wet stamp of a Colorado registered architect or

17. A plan review must be approved and permit must be issued prior to the start of

18. The new construction and/or change of use shall conform to the requirements of
the 2003 International Building Code, the 2005 National Electrical Code and

19. Setback and offset distance shall be determined by the 2003 International

21. Landscaping materials as indicated in the approved Landscape/ Screening Plan
shall be maintained at all times. Dead or diseased plant materials shall be
replaced with materials of similar quantity and quality at the earliest possible

22. Lighting shall comply with the requirements and standards for off-street parking
spaces per Section 23-4-30.E, Section 23-2-250.D and Section 233-250.B.6 of

23. All structures, including signs, on site must obtain the appropriate building

24. Effective January 1, 2003, Building Permits issued on the proposed lots will be
required to adhere to the fee structure of the Weld County Road Impact Program.

Dear Ms. Martin:
I wanted to respond to the comments directly that did not have a place on the
plat submittal or required further clarification. Please review enclosed submittals
and responses to previous comments as noted on the site plan, Administrative
Review.
• E-1, E-2, E-4 - Existing landscaping to remain along N/E corner of lot as
shown on site plan. New river rock to be installed along the relocated
fence to the north and east of the access gate to the outside storage.
Fabric screening to be installed on Northern and Eastern boundaries
adjacent to public ROW and Agricultural zoned lots. I-3 and C-3
neighboring lots are not required to be screened per Sec 23-3-230, Weld
County Zoning Ordinance. Completion of the fence screening and rock
landscaping to be finalized by September 1, 2007 as noted in Private
Improvement Agreement supplied with this letter.

�X of confusion regarding specific criteria. The most significant is your note
°�" regarding storage of "port-a-potties" within a building—then specifying the criteria
�o� being created by a Board of Adjustment Hearing on August 1, 2006 (item H-3 in
�z a the Site Plan Review notes).

m x� Since you did not have the opportunity to be in attendance at this hearing, let me
o r m explain my perspective from our presentation and the comments that are noted in
�m� the minutes of that meeting. First, staff— Chris Gathman and Bethany Salzman
"determined" that portable toilets were not allowed in a C-3 zoning designation,
but then changed to saying that only the storage "outside" was not allowed.
We did talk about this in the hearing and Chris was able to give his perspective of
the ordinance. I was able to give the owner's perspective and from that,
discussion ensued from the Board. One final question raised by Chair Fitzgerald
was if the owner was willing to screen the site —we stated we would. (Paragraph
3, page 4 minutes) He then asked if other items would be reviewed other than
the screening. At that time Chris Gathman indicated — "They would need to
submit drawings with outdoor storage use location, screening, water, septic, all
applicable standards, There would be referrals sent to various agencies. A final
approval plat would be recorded with the layout of the parking layout, storage
and landscaping. There will need to be some screening as well as notes on the
plat. There will also be Development Standards and Conditions of approval that
will need to be adhered to." At no time during this discussion was the
"requiremenY' of storing portable toilets inside, noted.
N I would submit, again, that this issue of storage outside has been resolved by the
i owner accepting the criteria of screening and proposing the enclosed
; improvement timeline for completion. If this is not acceptable, other data than
' the "Board of Adjustment ruling" needs to be brought to our attention, since the
� Board specifically allowed this issue to fail without formal comment.

� o As you can see, the Brienza's have attempted with due diligence to resolve this
.� J � issue —going to great lengths, finding 30 year old data for the county's files - to
Q make this site file complete. Please help us find a solution so they may continue

External Roads: The external roadways are capable of handling anticipated traffic from the proposed facility.
WCR 2.25 north and adjacent to the property is a local paved road and requires a 60-foot right-of-way at full build out.
There is presently a 60-foot right-of-way. The applicant shall verify the existing right-of-way and the documents creating
the right-of-way shall be noted on the site p/an map. If the right-of-way cannot be verified, it will be dedicated on the
final plat.
Access: The applicant shall utilize the main access point to the site from WCR 2.25.
Parking: During a field site visit it was observed that parking was occurring on the north edge of the property in the
designated "pazking" area and the gravel surface area adjacent to the main access. All parking for the site must be off
street and intemaL The applicant shall identify and separate employee and visitor parking spaces on delineate on the site
plan map. Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles
from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or
planting.
ADA requirements shall be met for this site. Pazking Lots shall conform to all standards of the Americans with
Disabilities Act. Public Works recommends striping of the parking and to identify the ADA space(s) with the appropriate
symbols and signs.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner
that it will reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best management
practices.

Environmental Health Services has reviewed this proposal for a plumbing business and
warehousing of portable toilets. We have no objections to the proposal, however, we do
recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The Environmental Health Services Division was unable to locate a septic permit
for the septic system serving the existing structure. The septic system shall be
reviewed by a Colorado Registered Professional Engineer. The review shall
consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. The facility shall utilize the existing commercially permitted well. (Well # 69526
for (1) single office building)
10.A11 potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to
satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
According to the submitted information the water for drinking and sanitary purposes
is provided by existing weil no. 69526. That well is permitted for drinking and sanitary uses
for a single office building. The well cannot be used for irrigation of the landscaping or any
other outdoor purposes. The existing well can be used to serve the existing plumbing
company as long as the well is operated in accordance with the terms and conditions on the

Upon review of my case files and computer, an active Zoning Violation (VI-0600031)was noted. This
violation was initiated due to the presence of a port-a-potty/plumbing company without an approved Site
Plan Review. This case has not been presented to the Board of County Commissioners through the
Violation Hearing process.
This application if approved and once a plat is recorded would correct the violation. If a plat is not
recorded within 60 days of approval, this case will be scheduled before the Board of County
Commissioners to proceed through the Violation Hearing process accordingly.

We are writing tliis letter in regards to our neighbor's property to the west of us,
Empire Plumbing and Portables, located at 12636 WCR 2.25. We ha�e owned
our home next ta this site for several years and prior to Empire purchasing the
neighboring property for their business.
We have seen various businesses operate from this site and have found that
Empire has kept tfie building and yards clean—even improving the sibe from
previous owners. They've also gone to the expense of txeating a drainage area
so water from the street is kept from running into our bt in heavy rains. Their
vehicles do not cxeate excessive noise or dust and the storage is kept clean and
ordetiy
We would support them in their business ventures since they have been
responsible neighbors.
