HomeMy WebLinkAbout20060421.tiff 239 RESOLUTION RE: APPROVE PARTIAL CANCELLATION AND RELEASE OF COLLATERAL FOR NESTING CRANE RANCH - STENERSON, OLSON AND LOWRY DEVELOPMENT, LLC WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,by Resolution dated May 11, 2005, the Board approved the application of Stenerson,Olson and Lowry Development, LLC,3040 South Newcombe Way, Lakewood,Colorado 80227,fora Planned Unit Development Final Plan, PF#1000 on the following described real estate, to wit: W1/2 W1/2 NE1/4 of Section 30, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on June 15, 2005, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements(Public Road Maintenance)for Nesting Crane Ranch, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Stenerson,Olson and Lowry Development, LLC,with terms and conditions being as stated in said agreement, and accepted collateral in the total amount of$445,139.00, and WHEREAS,the Board subsequently,through Resolutions#2005-3396 dated November21, 2005, and #2005-3681 dated December 21, 2005, released collateral to the applicant as improvements were completed, and WHEREAS,the Board is currently holding cash collateral,in the amount of$16,891.00,and WHEREAS, staff from the Weld County Departments of Planning Services and Public Works have conducted a visual inspection and recommends a partial release of said collateral, in the amount of$6,255.00,retaining 15 percent($10,636.00)fora one-year period as paving warranty, and WHEREAS,upon the recommendation of staff,the Board deems it advisable to release said collateral. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that a portion of collateral being held,in the amount of$6,255.00 be,and hereby is, cancelled and released. The applicant is requesting that the remaining collateral be released. Stenerson, Olson & Lowry Development LLC will provide a cash collateral for the paving warranty in the amount of ten thousand and six hundred and thirty six dollars ($10,636.00). The Final PUD (PF-1000) was accepted by the Board of County Commissioners on May 11, 2005 The original Improvements Agreement in the amount of four hundred forty five thousand, one hundred and thirty nine dollars ($445,139.00) was approved by the Board of County Commissioners on May 11, 2005. A partial release of collateral was approved on November 21, 2005 retaining one hundred and eight thousand, nine hundred and ninety one dollars and eighty one cents ($108,991.81) to complete the work on site and 15% for a paving warranty. A second partial release of collateral was approved on December 21, 2005 retaining sixteen thousand eight hundred and ninety one dollars ($16,891.00) for remaining landscaping items and a paving warranty. The Department of Planning Services is in support of a partial release of collateral in the amount of six thousand two hundred and fifty five dollars ($6,255.00) for the items that have been completed on site. The Department of Planning Services request that the remaining collateral in the amount of ten thousand and six hundred and thirty six dollars ($10,636.00) as a paving warranty be retained for the one year.
