RE: APPROVAL OF RECORDED EXEMPTION NO. 435 - GREAT NORTHERN
INVESTMENT COMPANY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 16th day of January, 1980 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 435, being the property of Great Northern Investment
Company, described as part of the Southwest Quarter of Section 23 ,
Township 5 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows :
The Southwest Quarter of Section 23, Township
5 North, Range 66 West of the 6th P.M. , County
of Weld, State of Colorado, excepting those
parcels of land previously conveyed in the Real
Estate Records of the Clerk and Recorder of
Weld County, Colorado as follows:
Book 530, Reception No. 1452029 and
Book 598 , Reception No. 1520020 and
Book 603, Reception No. 1525264
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definitions of "subdivision" and "subdivided land, "
pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the hereinabove described

parcel of land owned by Great Northern Investment Company be,
and hereby is, exempt from the definition of the terms "subdi-
vision" and "subdivided land" pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973 , as amended.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado that approval of said Recorded Exemption
No. 435 is condition upon the applicant agreeing to remove the
existing access to Lot A and sharing a common access with the
parcel to the north of this property (described in Book 598 ,
Reception No. 1520020) , and further conditional upon the applicant
submitting a legal instrument describing the common access agree-
ment prior to recording the Recorded Exemption plat.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
January, A.D. , 1980.

RE: Recorded Exemption #435
Dear Commissioners :
The attached application, plat, and related items are in reference
to a request from Great Northern Investment Company for a recorded
exemption. The parcel of land on which this request has been made
is described as Pt . SW* Section 23, T5N, R66W of the 6th P.M. , Weld
County, Colorado. This property is located 1/2 mile south and 1/2
mile west of the City of Greeley City Limits. The property contains
approximately 151 acres of Class II , III and IV irrigated soils.
The request is to split the property into parcels of 2. 5 acres and
148. 5 acres.
The applicant, Great Northern Investment Company, wishes to lease
Lot B to a neighboring farmer whereas Lot A would be sold as a
residential unit .
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons:
1. The request conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural Zone District
(Section 3.3 A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that the use will be compatible
with surrounding agricultural uses.

2. The City of Greeley has set forth no objections to this request
providing the applicant agree to share a common access with the
parcel to the north of this property.
3. This request complies with the provisions of Section 9-4 A of the
Weld County Subdivision Regulations.
The Department of Planning Services recommendation for approval is
conditional upon the applicant agreeing to removing the existing
access to Lot A and sharing a common access with the parcel to the
north of this property (described in Book 598 Reception No. 1520020) .
The Department of Planning Services recommendation for approval is
also conditional upon the applicant submitting a legal instrument
describing the common access agreement prior to recordation of the
recorded exemption plat in order that the agreement may be recorded
with the recorded exemption plat .

Dear Ms. Traxler:
Great Northern Investment Company has given a great deal of thought to
the reevaluation of the parcel of land described at Pt. SW14 Section 23,
T5N, R66W of the 6th P.M. , Weld County, Colorado.
In order to preserve the most farm land we have approached the neighboring
farmer, who is farming the property now and who is most interested in pur-
chasing the farm land to add to his existing farming operation. As you
know, when we purchased this parcel orginally, we had hoped to offer it as
a complete farming unit and lease it to a farmer until such time as the
City of Greeley's growth pattern would enable us to subdivide and build
residential housing. In the pursuit of making this parcel a liveable farm
we moved a house onto the property. The neighboring farmer does not need
nor does he want an extra house.
Consequently, we have approached the neighbor whose property is adjoining
the parcel upon which the house is located, and he has agreed to a common
access driveway for this house as well as his own.
We would like, at this time, to apply for a recorded exemption and we are
submitting the following exhibits:

2. legal description
3. mylar

Great Northern Investment Company for a recorded exemption at
their meeting on January 8 , 1980 . The Commission recommended
