RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #110 - LEWIS
CHICHESTER
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #710339, dated August 25, 1971, the Board of County
Commissioners approved Use by Special Review Permit#110 for expansion of an existing egg
production operation for Lewis Chichester, Route 1, Box 31, Erie,Colorado 80516,on the following
described real estate, to-wit:
Lot 8, Block 3 of Ranch Eggs Subdivision, being part
of the NW1/4 of Section 34, Township 1 North,
Range 68 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, the Board has received a request from Jeffrey and Cheri Freeburg,
14137 Whitney CR, Broomfield,Colorado 80020-4510,current property owners,to vacate said Use
by Special Review Permit#110, since the use is no longer being performed on the property, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present,studied the request of the applicants and the recommendation of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#110 be, and hereby is, vacated.

The Department of Planning Services has received the attached letter dated September 11,
2006 from Jeffrey and Cheri Freeburg. The property owners are requesting that SUP-110 be
vacated from the following parcel, 1467 34 203005 since the use is no longer being performed
on the property.
Background information:
Legal Description: Lot 8, Block 3 of Ranch Eggs Subdivision being part of the NW4 of
Section 34, T1N, R68W of the 6th P.M., Weld County
Location: South of County Road 4 and east of County Road 7
SUP-110: SUP-110 was approved by the BOCC on August 25, 1971, for a Site
Specific Development Plan and Special Review Permit for an expansion
of an existing egg operation in the A (Agricultural) Zone District.

Dear Mr. & Mrs. Jeffrey Freeburg:
This letter is regarding your property located on Lot 8, Block 3 of Ranch Eggs Subdivision being
part of the NW4 of Section 34, T1N, R68W of the 6th P.M., Weld County, Colorado, parcel
number 1467 34 203005.
The Department of Planning Services conducted a site visit of your property and noticed the
Use by Special Review SUP-110 for an expansion of an existing egg operation originally
approved on August 25, 1971 by the Board of County Commissioners is no longer being
conducted on the property.
The Department of Planning Services request that you submit in writing to our office a request
to either vacate the Use by Special Review or submit written evidence that the approved uses
are still in operation. I have enclosed a form for you to indicate your wishes and sign along with
an envelope for you to mail the form back to the Department of Planning Services.
If no response is received the Department of Planning Services will be setting up SUP-110 for a
probable cause hearing before the Board of County Commissioners to review compliance with
the permit. All conditions of the original permit must be in compliance by October 30, 2006 or a
Probable Cause public hearing, pursuant Chapter 23, Article II (2), Division 4, Section 23-2-270
of the Weld County Code, will be scheduled.
If the Probable Cause Hearing is scheduled, the purpose of this public hearing will be to review
case numberSUP-110, for compliance with the Development Standards and Conditions of
Approval, as approved by the Board of County Commissioners on August 25, 1971 to determine
if probable cause exists to hold a hearing on revocation of the permits.
The Department of Planning Services has determined that per section 23-2-200 of the Weld
County Code the Use by Special Review (SUP-110) for an expansion of an existing egg
operation is not being conducted on site.
