HomeMy WebLinkAbout20062828 RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO OCTOBER 9, 2006 TAPE #2006-36 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, October 9, 2006, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner M. J. Geile, Chair Commissioner David E. Long, Pro-Tem Commissioner William H. Jerke Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Elizabeth Strong Controller, Barb Connolly MINUTES: Commissioner Jerke moved to approve the minutes of the Board of County Commissioners meeting of October 4, 2006, as printed. Commissioner Long seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Vaad moved to approve the Certification of Hearings conducted on October 4,2006, as follows: 1)SD0131 -Creation of the Weld County Pioneer Community Law Enforcement Authority; 2) PF#1090-Eagle View Farms, LLC, do Casseday Creative Designs, LLC; 3) USR #1561 - Strear Farms Company, c/o Duke Energy Field Services, Inc., do Witwer, Oldenburg, Barry, and Johnson, LLP; 4) USR #256 - David and Carol Howard, D. Gary Howard, and John Howard, Go Duke Energy Field Services,do Witwer,Oldenburg, Barry,and Johnson, LLP;5)USR#1559-Eleanor B. Fransen Trust, c/o William and Linda Snyder. CommissionerJerke seconded the motion,which carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed. Commissioner Masden seconded the motion, and it carried unanimously. 2006-2828 BC0016 (e) —(1 COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. WARRANTS: Barb Connolly, Controller, presented the following warrants for approval by the Board: All Funds $612,269.85 Commissioner Masden moved to approve the warrants as presented by Ms. Connolly. Commissioner Jerke seconded the motion, which carried unanimously. NEW BUSINESS: CONSIDER EXPENDITURE AUTHORIZATION AND MODIFICATIONS FOR WORKFORCE DEVELOPMENT PROGRAMS AND AUTHORIZE CHAIR TO SIGN: Walt Speckman, Director of Human Services, stated all of the grants related to the Workforce Development Program are receiving an additional amount of money from the State. Commissioner Long moved to approve said authorization and modifications. Seconded by Commissioner Vaad, the motion carried unanimously. CONSIDER EXPRESSION OF SUPPORT TO THE WATER SUPPLY AND STORAGE COMPANY FOR PROTECTION OF THE GRAND RIVER DITCH REGARDING BILLS TO DESIGNATE ROCKY MOUNTAIN NATIONAL PARKA WILDERNESSAREA: Bruce Barker,County Attorney,stated he worked with Bill Fisher, Attorney for The Water Supply and Storage Company, to construct the Resolution. He stated for political reasons Mr. Fisher is requesting the Board remove two paragraphs from the Resolution. Commissioner Jerke stated the two paragraphs do not contain any negative references and only offer support for the bill. He stated he is in support of the Resolution, in its entirety. Commissioner Masden concurred with Commissioner Jerke. Commissioner Jerke moved to approve said expression of support. Seconded by Commissioner Masden, the motion carried unanimously. CONSIDER APPOINTMENT OF DREW SCHELTINGA AS COUNTY ENGINEER: Commissioner Vaad moved to approve said appointment. Seconded by Commissioner Long,the motion carried unanimously. SECOND READING OF ORDINANCE#2006-7, IN THE MATTER OF REPEALING AND REENACTING, AMENDMENTS, CHAPTER 8 PUBLIC WORKS, OF THE WELD COUNTY CODE (CON'T FROM 10/02/06): Commissioner Long moved to read Ordinance 2006-7 by title only. Seconded by Commissioner Jerke, the motion carried unanimously. Mr. Barker read Ordinance 2006-7 into the record by title only. David Bauer, Department of Public Works, stated the Department does not have a presentation, however,he is available to answer questions. In response to CommissionerJerke,Mr. Bauer stated there is a statement in the Ordinance which discourages channelization since it interrupts the flow of natural drainage paths. Further responding to Commissioner Jerke, Mr. Bauer stated channelization is addressed in the addendum and the criteria that Urban Drainage publishes. He stated the text provided by the Urban Drainage district, in the first volume, states a general policy to avoid channelization, unless necessary for safety purposes. He stated the addendum in the Ordinance supports discouraging channelization due to the disruption to natural drainage pathways and increased erosion caused by channelization. In response to Commissioner Jerke, Mr. Bauer stated there is a section in the Ordinance where the preference against channelization is stated, however, he does not know the page number. Mr. Barker stated on page 16, there is an addition to Section 3.2.3.2 which states, "For constructed or natural channels with sideslopes steeper than 2:1, appropriate construction setbacks from the channel edge may be required to allow potential future channel meandering. Access for maintenance may require easement." Commissioner Jerke stated he has a concern about the growth of vegetation due to lack of channelization which has caused the river to become wider, and has created difficulty for the South Platte River area. He stated he is also concerned about endorsing the standard since the County may desire channelization at some point. He stated he wants to better understand why channelization is the preferred method. Mr. Barker suggested conducting a work session. Commissioner Jerke stated he may bring an Minutes, October 9, 2006 2006-2828 Page 2 BC0016 individual to articulate another perspective on channelization. Mr. Barker stated a work session will be scheduled for October 18, 2006 to further discuss the issue. Commissioner Vaad moved to continue the matter to October 23, 2006. Seconded by Commissioner, the motion carried unanimously. SECOND READING OF ORDINANCE#2006-8, IN THE MATTER OF REPEALING AND REENACTING, CHAPTER 3 PERSONNEL, OF THE WELD COUNTY CODE (CON'T FROM 10/02/06): Commissioner Vaad moved to read Ordinance 2006-8 by title only. Seconded by Commissioner Masden, the motion carried unanimously. Mr. Barker read Ordinance 2006-8 into the record by title only. He stated the two changes are 1)as a condition of employment employees may be reassigned, and 2)to require employees to give at least two weeks notice before their date of resignation or retirement. In response to CommissionerJerke,Mr. Barker stated there is not a penalty for employees providing less than two weeks. He stated the request is only a matter of professional courtesy. There was no public testimony. Commissioner Jerke moved to approve Ordinance 2006-8 on second reading. Seconded by Commissioner Long, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
