The Weld County Health Department has reviewed this proposal. This request is to amend the Final plat
to further subdivide Lot 17 into 4 lots. The minimum lot size is 3.46 acres and with an overall density of 1
septic system per 4.4 acres (using the 17.4 acres of Lot 7 only) does meet current Department policy.
The total acreage of Shiloh: 75.54
Originally 14 lots= 1 septic system/5.4 density (total overall density)
Proposed 17 lots= 1 septic system/4.4 lots (total overall density)

The application has satisfactorily addressed water and sewer service. Water will be provided by the
North Weld County Water District and sewer will be provided by the individual sewage disposal
systems.
The applicant proposed a new lot numbering scheme for clarity with emergency response personnel on
page 1 of the Specific Development Guide. The same numbering scheme should be carried out in
Exhibits B and C of the covenants (with regard to animal units and irrigation costs) for consistency.
The application materials adequately address the potential environmental impacts as described in
Chapter 27 of the PUD Ordinance.
The Department recommends approval with the following conditions:
1. Water service shall be obtained from North Weld County Water District
2. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer
system. Sewage disposal shall be by septic systems designed in accordance with the
regulations of the Colorado Department of Public Health and Environment, Water Quality
Control Division and the Weld County Code in effect at the time of construction, repair,
replacement, or modification of the system.
3. A stormwater discharge permit may be required for a development/redevelopment
/construction site where a contiguous or non-contiguous land disturbance is greater than or
equal to one acre in area. Contact the Water Quality Control Division of the Colorado
Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit
for more information.
4. During development of the site, all land disturbances shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions, at the request of
the Weld County Health Department, a fugitive dust control plan must be submitted.

5. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and
practical methods that are technologically feasible and economically reasonable in order to
minimize dust emissions.
6. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6
months in duration,the responsible party shall prepare a fugitive dust control plan,submit an
air pollution emissions notice, and apply for a permit from the Colorado Department of Public
Health and Environment.
7. "Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall
be placed on any recorded plat.

Weld County Public Works Department has reviewed this Amended Final Plat request. Comments made during this
phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the
remaining application process.
Comments
General Comments:
❑ This amended final plat of Shiloh Estates PUD proposes to divide Lot 7 into four parcels for single family homes.
❑ The Shiloh Estates PUD Subdivision is planned for up to 4 additional single-family residential building sites.
External Roadways:
❑ CR 72 is classified by the County as a collector road(adjacent to this development)and requires an 80-foot right-of-way. CR 72
is paved and maintained by the County in the vicinity of this development.
This development will introduce approximately 38 additional vehicle trips per day to the off-site roadway system from the
proposed 4 residential homes.
U Based on the proposal of limited development and anticipated low transportation impact on surrounding roads, a traffic study is
currently not required.
Internal Roadways:
❑ Internal roads shall meet Weld County criteria for a PUD. The internal roadway right-of-way shall be sixty (60) feet in width
including cul-de-sacs with a sixty-five (65) foot radius, and dedicated to the public. The typical section of interior roadway shall
be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the final plat. The cul-de-sac edge of pavement radius shall
be fifty(50)feet. Stop signs and street name signs will be required at all intersections. The roadside drainage shall be contained
within the right-of-way.
U Cornerstone Court shall be labeled as 60' right-of-way.
U The general note describing Cornerstone Court maintenance by the Shiloh Estates PUD Homeowners Association shall be
referred to as 60' of right-of-way. The applicant intends to privately maintain the internal roadway.
❑ The development is urban-scale in design, which normally curb, gutter and sidewalk are required. Curb & gutter influence the
handling of stormwaters. The existing subdivision does not currently have curb, gutter and sidewalk. Public Works would
support a waiver from curb,gutter and sidewalk based on the existing structure of the PUD.
o The applicant must request a waiver for curb,gutter and sidewalk from the Board of County Commissioners.
❑ The applicant shall provide a pavement design prepared by a professional engineer along with the final plan submittal.
U Easements shall be shown on the final plat in accordance with County standards (Sec.24-7-60) and / or Utility Board
recommendations.

❑ Intersection sight distance triangles at the development entrance will be required. All landscaping within the triangles must be
less than 3'h feet in height at maturity,and noted on the final roadway plans.
�u The applicant shall submit to Public Works stamped, signed and dated final plat drawings and roadway/construction& grading
plan drawings for review and approval. Construction details must be included.
❑ The applicant has submitted the Improvements Agreements According to Policy Regarding Collateral for Improvements. These
agreements have been accepted by Public Works. The agreement shall be approved by the Board of County Commissioners
(BOCC)prior to recording the final plat.
Drainage:
❑ The Drainage Design Considerations for Shiloh Estates PUD, Resubdivision of Lot 7, dated January 2, 2006 by Wohnrade Civil
Engineers, Inc. is satisfactory.
❑ Final drainage construction and erosion control plans (conforming to the drainage report) stamped, signed and dated by a
professional engineer licensed in the State of Colorado shall be submitted with the final plan application.
Recommendation
❑ The Public Works Department has no conflict with this Amended Final Plat.
The applicant shall address the comments listed above at the specific step of the review process stated. The review
process will continue only when all appropriate elements have been submitted. Issues of concern must be resolved
with the Public Works Department prior to any decision or recording.'

1. A separate building permit shall be obtained prior to the construction of any structure.
2. A plan review is required for each building for which a building permit is required. Two complete sets of
plans are required when applying for each permit. Residential building plans may be required to bear the wet
stamp of a Colorado registered architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 2003 International Residential Code; 2003 International
Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International
Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each residential building will require an engineered foundation based on a site-specific geotechnical report
or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose
of determining the maximum building size and height for various uses and types of construction and to
determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height
shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance
with offset and setback requirements. When measuring buildings to determine offset and setback
requirements, buildings are measured to the farthest projection from the building. Property lines shall be
clearly identified and all property pins shall be staked prior to the first site inspection.

RE: AmPF-354-Replat of Lot 7, Shiloh Estates-James and Cheri Scott
Dear Mr. Mueller:
The Town of Windsor Planning Commission reviewed this referral at its regular meeting of
February 15, 2006. The subject property is depicted as Low Density Single Family
Residential on Windsor's Land Use Plan Map. The Windsor Comprehensive Plan states
that the Low Density Single Family Residential land use depiction provides for "...single-
family residential detached homes at very low densities at a maximum density of one
dwelling unit per acre." The application proposes four(4) lots, each four(4)acres or greater
in size, this appears to be consistent with the Low Density Single Family Residential land
use depiction and the Town's Land Use Plan map.
The Town's Parks and Recreation Department would like to point out that there is a
proposed trail system that runs along the Lake Canal Ditch north and west of the subject
property.
The subject property is located within the Town's Growth Management Area (GMA) and
the Town of Windsor Comprehensive Plan states, "The GMA is intended to define those
specific areas within the planning area where it is most logical to extend urban services in
the near term, that is, within the next five to ten years." Although the subject property is
located within the GMA, it would not be feasible to extend Town services to the area in
order to serve such a low density. Therefore, staff does not recommend that annexation be
required at this time.
However, an agreement requiring future annexation is recommended and the Town and
County should make every attempt to avoid future enclaves of unincorporated county within
the corporate limits of Windsor. Such enclaves lead to confusion over jurisdictional
authority, potential maintenance problems should streets ever be publicly maintained and
other general inefficiencies.
Therefore, the Town of Windsor Planning Commission recommends approval of this replat
to the Weld County Department of Planning Services subject to the condition that the
applicant enter into an annexation agreement with the Town of Windsor prior to recording
the replat. Such annexation agreement shall require the subject property to annex to the
Town at such time in the future that the property becomes an enclave as defined by
Colorado state statutes, with such annexation agreement being recorded with the Weld
County Clerk and Recorder.

Re: 4 Lot subdivision of Shiloh Estates Lot 7
North Weld County Water District has reviewed the request and intends to provide additional
potable water to the development. Upon review of the application,the District recognizes the
proposal for the installation of additional irrigation water system. North Weld County Water
District would like to review and inspect the installation of such system to ensure that
contamination from such irrigation system to the potable system is prevented. Additionally the
District will need to know the fire requirements from the Windsor-Severance Fire District that
will be placed on North Weld County Water District for fire suppression.
Therefore; North Weld County Water District requests to receive any additional information that
may be received or added to this application during the review process.
